Abstract

This research focuses on the state policy towards the development of Islamic business which is part of the existing Islamic economic system. In the current development, the Islamic economy is growing significantly through various policies issued by the government, such as in the field of banking, small and medium enterprises and various kinds of Islamic business products as a form of fulfillment of rights in carrying out basic religious principles. State policy through the Law of the Republic of Indonesia Number 21 of 2008 concerning Sharia Banking is a form of state policy towards the development of Islamic business in society through the fulfillment of regulations and implementation of Islamic business. This research focuses on qualitative research methods by managing data as a source of analysis.

Abstract

Tidak ada perlindungan hukum bagi direktur rumah sakit apabila terjadi kelalaian yang bukan disebabkan olehnya, namun direktur rumah sakit harus mempertanggungjawabkan kelalaian tersebut. Bentuk tanggung jawab yang diemban direktur akibat malpraktik juga belum diatur dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Hasil penelitian menunjukkan: 1) Perlindungan hukum terhadap Direktur selaku penanggung jawab rumah sakit akibat malpraktik di Rumah Sakit Umum Daerah (RSUD) belum terpenuhi. Padahal tugas, fungsi dan wewenang direktur rumah sakit telah diatur dalam Pasal 7 ayat (3) Peraturan Presiden Nomor 77 Tahun 2015, Pasal 11 ayat (2) dan (4) Perwal Serang Nomor 20 Tahun 2022 dan Peraturan Menteri Kesehatan. Profil RSUD Kota Serang Tahun 2021, Hasil penelitian menunjukkan bahwa tugas, fungsi dan wewenang direktur rumah sakit tidak hanya sebatas pada hal-hal yang diatur dalam ketentuan tersebut, namun direktur rumah sakit juga harus bertanggung jawab secara hukum tidak tertulis apabila terjadi malpraktek di rumah sakit, karena penyelenggaraan rumah sakit itu sendiri berada di bawah tanggung jawab direktur rumah sakit; 2) Bentuk tanggung jawab hukum Direktur akibat malpraktek di Rumah Sakit Umum Daerah (RSUD) sebenarnya hanya sebatas tugas, fungsi dan wewenang direktur rumah sakit sebagaimana diatur dalam Pasal 7 ayat (3) Peraturan Presiden Nomor 77 Tahun 2015, Pasal 11 ayat (2) dan (4) Perwal Serang Nomor 20 Tahun 2022 dan Profil RSUD Kota Serang Tahun 2021, meliputi pembinaan, pengawasan, dan pengendalian pelaksanaan tugas dan fungsi unsur organisasi. Namun karena direktur rumah sakit merupakan pimpinan tertinggi di rumah sakit dan dianggap sebagai penanggung jawab rumah sakit, maka mengakibatkan direktur rumah sakit bertanggung jawab dan menanggung akibat malpraktek yang dilakukan oleh tenaga medis atau tenaga kesehatan. Seharusnya dari segi bentuk tanggung jawab hukum apabila terjadi malpraktik akibat kelalaian tenaga medis di rumah sakit, maka tenaga medis yang bersangkutan dan pihak rumah sakit wajib mempertanggungjawabkan segala kerugian yang diderita pasien sesuai dengan Pasal 193 UU No. Hukum Kesehatan Kata Kunci: Perlindungan hukum; Direktur; Penanggung jawab; RSUD; Malpraktek

Abstract

The state's responsibility for efforts to create a good health service system in order to provide welfare to the community. The social security law has placed a model of protection for the community with a legal approach through social insurance with the basic principle of mutual cooperation. In January 2023, the government spent around IDR 5.3 trillion to protect public health, an increase of 12% compared to last year (2022), making the Health Social Security Administering Agency abbreviated as BPJS Kesehatan as the manager of social insurance for medical assistance need to continue to develop to meet needs. The health insurance scheme managed by the state with the provision of health equipment as an effort to fulfill the state's constitutional responsibility. This study analyzes the state's responsibility in providing health insurance for the community as an effort to fulfill citizens' rights through a legal approach.
