Abstract

Abstract_To realize a state of law, legal instruments are needed that are used to regulate balance and justice in all areas of life and people's livelihoods through laws and regulations by overriding the jurisprudential function. Mining business or mining business is an activity within the framework of mineral and coal exploitation which includes the stages of general investigation, exploration, feasibility study, construction, mining, processing and refining, transportation and sales activities, as well as post-mining activities. Efforts that can be made by the government in reducing the negative impact of mining activities in Indonesia include reforming regulations by revoking policies in the mining sector that are hierarchically contrary to the 1945 Constitution, being careful in making policies in the mining sector, and setting standards. high environmental management in the mining industry. Keywords: Criminal liability, Illegal mining, Criminal law Abstrak_Untuk mewujudkan suatu negara hukum diperlukan perangkat hukum yang digunakan untuk mengatur keseimbangan serta keadilan dalam segala bidang kehidupan dan penghidupan masyarakat melalui peraturan perundang-undangan dengan cara mengesampingkan fungsi yurisprudensi. Usaha pertambangan atau mining business merupakan kegiatan dalam rangka pengusahaan mineral dan batubara yang meliputi tahapan kegiatan penyelidikan umum, eksplorasi, studi kelayakan (feasibility study), konstruksi, penambangan, pengolahan dan pemurnian, pengangkutan dan penjualan, serta kegiatan pasca tambang. Tidak lama setelah mendapat laporan, 3 orang personil kepolisian dari Polda Jawa Barat kemudian datang ke lokasi dan menemukan para pelaku di tempat pengolahan emas milik H disertai penemuan barang bukti berupa palu, tongkat besi, sekop, dan satu buah karung yang berisi lumpur sisa pengolahan emas tersebut. Dari segi istilah, penambangan ilegal atau dalam bahasa Inggris illegal mining terdiri dari dua kata, yaitu: illegal, yang artinya tidak sah, dilarang, atau bertentangan dengan hukum, dan mining, yang artinya penggalian bagian dari tanah yang mengandung logam berharga di dalam tanah atau bebatuan. Selain sanksi administratif dan/atau sanksi pidana, pelaku tindak pidana bidang pertambangan juga dapat dikenai pidana tambahan berupa:1. perampasan barang yang digunakan dalam melakukan tindak pidana; 2.perampasan keuntungan yang diperoleh dari tindak pidana; dan/atau 3.kewajiban membayar biaya yang timbul akibat tindak pidana. Dampak negatif pada kegiatan pertambangan di hutan lindung tersebut terjadi pada udara yang berdampak pada kesehatan manusia dan hidupan perairan, penurunan kualitas air dan banjir serta pertanian lokal, perubahan temperatur udara akibat pemanasan global pada iklim, flora dan fauna yang terancam populasinya, tanah yang terkontaminasi serta erosi dan bentang alam yang hancur. Upaya-upaya yang dapat dilakukan oleh pemerintah dalam mengurangi dampak negatif kegiatan pertambangan di Indonesia antara lain dengan pembenahan regulasi dengan mencabut kebijakan-kebijakan di bidang pertambangan yang secara hierarki bertentangan dengan UUD 1945, berhati-hati dalam membuat kebijakan di bidang pertambangan, dan membuat standar pengelolaan Lingkungan Hidup yang tinggi dalam industri Pertambangan. Abstract

ABSTRACT- Corruption is a serious crime that tends to be committed by officials in Indonesia. The high number of corruption crimes in Indonesia has forced law enforcement officers and the Corruption Eradication Commission (KPK) to have a special strategy to catch the perpetrators, one of which is the Justice Collaborator service. A Justice Collaborator is a person who is an actor who participates in committing the crime but wants to help law enforcement officials solve the case by telling everyone what he knows about the case, either from new perpetrators or new evidence, making it easier for law enforcement officers to resolve the case. . However, in practice, Justice Collaborators often do not receive legal protection from the services they have provided for legal officials. The purpose of this study is to find out the reasons why the judge rejected the Justice Collaborator's request in the case of Decision No.7/Pid.Sus-TPK/2021/PN.Mdn and to provide definite legal protection for the Justice Collaborator in corruption crimes in Indonesia. In this writing, the author uses normative research methods, then approaches with a normative approach, the type of research conducted is doctrinal research, the specification of the research used is analytical descriptive, the data collection method used is library research, and uses qualitative methods. The results of this study the defendant's application to become a Justice Collaborator was rejected by the judge because there was no clarity from the public prosecutor's office, giving rise to doubts for the judge to accept the defendant's request Keywords- Justice Collaborator, Corruption Crime, Legal Protection ABSTRAK Tindak Pidana korupsi adalah tindak pidana berat yang cenderung dilakukan oleh para pejabat di Indonesia. Tingginya angka tindak pidana korupsi di Indonesia membuat para apparat hukum dan Komisi Pemberantas Korupsi (KPK) harus mempunyai strategi khusus untuk menangkap para pelaku, salah satunya jasa Justice Collaborator. Justice Collaborator adalah orang yang merupakan pelaku yang ikut serta dalam melakukan tindak pidana tersebut namun mau membantu apparat hukum untuk memecahkan kasus tersebut dengan memberi tahu semuanya apa yang dia tau dalam kasus tersebut baik dari pelaku baru ataualat bukti baru sehingga memudahkan apparat hukum untuk menyelesaikan kasus tersebut. Namun, dalam prakteknya seringkali Justice Collaborator tidak mendapatkan perlindungan hukum dari jasa yang telah dia berikan untuk apparat hukum. Tujuan dari penelitian ini untuk mengetahui alasan mengapa hakim menolak permohonan Justice Collaborator dalam kasus Putusan No.7/Pid.Sus-TPK/2021/PN.Mdn dan memberikan perlindungan hukum yang pasti untuk Justice Collaborator dalam tindak pidana korupsi di Indonesia. Dalam penulisan ini, penulis menggunakan metode penelitian normatif, lalu pendekatan dengan pendekatan normatif, jenis penelitian yang dilakukan adalah penelitian doktrinal, spesifikasi penelitian yang digunakan adalah deskriptif analitis, metode pengumpulan dala yang digunakan adalah studi kepustakaan, dan meenggunakan metode kualitatif. Hasil dari penelitian ini permohonan terdakwa untuk menjadi Justice Collaborator ditolak oleh hakim karena tidak adanya kejelasan dari kejaksaan penuntut umum sehingga menimbulkan keraguan untuk hakim menerima permohonan terdakwa Kata kunci : Justice Collaborator, Tindak Pidana Korupsi, Perlindungan Hukum

Abstract

Abstract. The application of sanctions in the Minangkabau customary law itself, especially the crime of theft, has existed for a long time, although there are no rules that regulate it beforehand. Furthermore, in customary settlements, there are no social differences in imposing sanctions. In addition to the sanctions that have been regulated in the material sanctions, customary law has moral sanctions that are borne by the perpetrator and his family and for life. The position of customary criminal law in Indonesian criminal law policies deserves to be considered, because the existence of customary criminal law in the legal system in Indonesia is recognized in several laws and regulations, court decisions, so that the location of customary criminal law in the formation of national criminal law is a source for national law. Then in the 2008 RKUHP the position of customary criminal law is used not only as a source of criminal law, but also as a source of material legality of criminal law as stated in the provisions of Article 1 paragraph (3), (4) of the 2008 RKUHP, the source of material legality as a counterbalance to the principle of formal legality as regulated in article 1 paragraph (1) of the 2008 RKUHP. Abstrak. Penerapan sanksi dalam pidana adat Minangkabau sendiri khusunya pidana pencurian sudah ada sejak dulu, walaupun tidak ada aturan yang mengatur sebelumnya. Selanjutnya dalam penyelesaian adat tidak ada perbedaan sosial dalam menjatuhkan sanksi,Selain sanksi yang sudah diatur dalam yaitu sanksi material, hukum adat mempunyai sanksi moral yang ditanggung pelaku dan keluarganya dan seumur hidup. Kedudukan hukum pidana adat dalam kebijakan hukum pidana Indonesia patut untuk dipertimbangkan, dikarenakan keberadaan hukum pidana adat dalam sistem hukum di Indonesia diakui dalam beberapa peraturan perundang-undangan, putusan Pengadilan, sehingga letak hukum pidana adat dalam pembentukan hukum pidana nasional adalah sebagai sumber untuk hukum nasional. Kemudian dalam RKUHP Tahun 2008 kedudukan hukum pidana adat digunakan bukan saja sebagai sumber hukum pidana, tetapi juga sebagai sumber legalitas materiil hukum pidana sebagaimana tertuang dalam ketentuan pasal 1 ayat (3), (4) RKUHP Tahun 2008, sumber legalitas materiil tersebut sebagai penyeimbang asas legalitas formal yang diatur dalam pasal 1 ayat (1) RKUHP Tahun 2008.

Abstract

Urgensi penelitian ini berkaitan dengan sinergitas hubungan antara Komisi Yudisial dengan Mahkamah Agung dalam hal menjalankan fungsi sebagai penyelenggara negara demi menyelenggarakan peradilan serta penegakan hukum. Tujuan penelitian ini adalah untuk mengetahui sejauh mana hubungan antara Komisi Yudisial dan Mahkamah Agung dalam melakukan fungsi sebagai penyelenggara negara dalam hal pelaksanaan kekuasaan kehakiman yang merdeka demi menyelenggarakan peradilan guna penegakan hukum. Metode pendekatan dalam penelitian ini adalah yuridis normatif dengan spesifikasi deskripsi analitis. Jenis data yang digunakan adalah data sekunder yang dikumpulkan dengan studi pustaka, adapun jenis penelitian ini adalah kualitatif. Tugas yang dilakukan oleh Mahkamah Agung dan Komisi Yudisial  adalah pengawasan terhadap hakim yang berfungsi sebagai kontrol demi tegaknya kehormatan, martabat, serta perilaku hakim sebagai aparatur penegak hukum. Dengan demikian tercapainya tujuan hukum, yaitu keadilan, kepastian hukum, serta kemanfaatan hukum sebagaimana amanat dalam Konstitusi Negara Republik Indonesia.

Abstract

This research aims to determine criminal law enforcement regarding acts of misuse of Cytotec drugs which provides legal certainty. Legal regulations concerning abortion practices in Indonesia have evolved to address societal changes and ethical considerations in medicine. According to Indonesian law, medical professionals are prohibited from performing abortions, aligning with religious doctrines and ethical standards. The Indonesian Doctor's Oath, based on the Geneva Declaration and enhancing the Hippocratic Oath, underscores the commitment to respect human life from conception onwards. This normative research utilizes secondary data initially, followed by primary data collection, to examine empirical-juridical aspects related to the enforcement of laws concerning Cytotec misuse for abortions, considering legal certainty principles. This research found that the previous Health Law until now is still consistent in prohibiting abortion except in cases that have been determined by law.

Abstract

Abstract. Cikurubuk Village, which is located in Buahdua Sub-district, Sumedang Regency, has invaluable wealth in the form of abundant water sources spread over 10 points of the village area. So that it becomes a source of life for the people in the Cikurubuk Village area and its surroundings. This considerable natural potential can be empowered in the agricultural sector. Currently, there are problems with subsidized fertilizers, so farmers must continue to innovate in dealing with them. Organic farming is one of the proposed solutions. The Cikurubuk community's awareness of the need for healthier foodstuffs, namely organic foodstuffs, is expected to grow. Community service activities are carried out by a team of lecturers and students, and the writing of this article uses an analytical descriptive method. The results of community service activities are in the form of a business plan for developing organic agricultural cultivation consisting of making organic fertilizer, pre-harvest implementation, post-harvest implementation, marketing and business analysis per farmer group. With the gradual development of sustainable agriculture, it is hoped that farmers can change their mindset so that they do not continue to depend on government subsidized fertilizers which are increasingly difficult to obtain and at high prices. Abstrak. Desa Cikurubuk yang terletak di Kecamtaan Buahdua Kebupaten Sumedang, memiliki kekayaan yang tak ternilai yaitu berupa melimpahnya sumber mata air yang tersebar 10 titik wilayah desa. Sehingga menjadi sumber kehidupan bagi masyarakat yang ada di wilayah Desa Cikurubuk dan sekitarnya. Potensi alam yang cukup besar tersebut dapat diberdayakan pada sektor pertanian. Saat ini terdapat permasalahan pupuk subsidi sehingga para petani harus terus berinovasi dalam menghadapinya. Pertanian organik merupakan salah satu usulan solusinya. Kesadaran masyarakat Cikurubuk terhadap kebutuhan bahan makanan yang lebih sehat yakni bahan pangan organik diharapkan akan semakin tumbuh. Kegiatan pengabdian masyarakat dilakukan oleh tim dosen dan mahasiswa, dan penulisan artikel ini menggunakan metode deskriptif analitik. Hasil kegiatan pengabdian berupa rencana usaha pengembangan budidaya pertanian organik yang terdiri dari pembuatan pupuk organik, pelaksanaan pra-panen, pelaksanaan pasca-panen, pemasaran dan analisis usaha per kelompok tani. Dengan pengembangan pertanian yang berkelanjutan secara bertahap, diharapkan para petani dapat mengubah pola pikir agar tidak terus bergantung pada pupuk subsidi pemerintah yang semakin hari semakin susah didapatkan dan dengan harga yang mahal.

Abstract

Fertilizer is an important element in agriculture besides seeds and water, so the state then stipulates SNI obligations for fertilizer products to make agricultural products a success and also to protect the nutrients contained in the soil so that they are not damaged. But in reality, it is often found in the field that there are certain parties who produce and distribute non-SNI fertilizers for personal gain. In fact, fertilizers that do not have SNI with unclear content will cause damage to the soil and recovery will take a long time. Unfortunately, criminal acts of product and distribution of non-SNI fertilizer continue to occur in different locations, as if there is no deterrent effect on the perpetrators because in several cases the production and distribution of non-SNI fertilizer only reaches the level of investigation due to lack of experts from the Ministry of Agriculture. Law no. 20 of 2014 concerning standardization and conformity assessment and other laws regulate them but are difficult to implement in the field because there must be coordination between institutions.

Abstract

Cikurubuk Village has invaluable wealth in the form of abundant water springs that are scattered throughout the village area, so that they become a source of life for the people in the Cikurubuk Village area and its surroundings. Based on existing data, Cikurubuk Village has 10 (ten) springs. Gradually farmers are able to change their mindset, so that they do not continue to depend on government subsidised fertilisers which are increasingly difficult to obtain and at high prices by repairing the soil ecosystem that was damaged by the use of synthetic fertilisers and pesticides used over the years. The method used is descriptive analytic, which is a method that focuses on awareness (descriptive) through situations and events that occur in the community related to the object of research, namely the behaviour of the village community when farming organic rice in an effort to local food security. Agricultural cultivation, making Cikurubuk village a role model for other farms that are able to reduce unemployment by producing one superior product developed from the innovation of patani rice from organic agricultural cultivation

Development technology No only change pattern life public everyday, but also influential in various industry, including in service known health with Telemedicine Services health through telemedicine has Lots benefits, but also risks high, so that required protection law for doctor and patient in service health through telemedicine as digital transformation. Objective from study This mapping and testing existing rules and regulations regarding digital transformation in particular For telemedicine, is it is already optimal in fulfil its function as service health to society, and is also associated with principle balance as outlined in Health Law No. 17 of 2023 Concerning Health. Methods the approach used is legal normative, with specification study nature descriptive analytical. The data used studies literature using secondary and tertiary data with technique analysis qualitative normative. Based on results study This show that; regulation protection law for doctor and patient in service health through telemedicine not yet based on principle balance. Abstract

Indonesia is one of the largest migrant worker-sending countries in Southeast Asia, with Malaysia being a major destination. Most of these migrant workers are women working in the informal sector, such as domestic helpers, who are often vulnerable to exploitation and human rights violations. The research on the protection of Indonesian female migrant workers in Malaysia aims to identify the problems faced, analyze the effectiveness of existing policies and programs, and provide recommendations to improve their protection and welfare. This research is important to contribute to improving the system of placement and protection of migrant workers, and to ensure that their rights are respected and protected. The research method used is the normative juristic method, which prioritizes secondary data, but is also complemented by primary data in the form of interviews and discussions with migrant workers who are experiencing legal problems in Kuala Lumpur Malaysia. In conclusion, female migrant workers, especially those working in the informal sector as domestic workers, are highly vulnerable to various forms of human rights violations, including exploitation, physical and psychological violence, sexual harassment, excessive working hours, inadequate wages, and poor working conditions. Illegal status exacerbates vulnerability, as illegal migrant workers do not have the same legal protections as legal migrant workers and are afraid to report abuses they experience
