Abstract

The management of conservation areas in Indonesia is important not due to the fact that Indonesia is  a mega biodiversity country,  to its close relationship with is local cultural diversity. The policy in managing the conservation areas is applied for those where the community, in terms of local wisdom, has applied the conservation values themselves. But it is the community  possesing the local wisdom values that is not protected  or marginalized. Viewed from the analysis of legal substance, there are some aspects that may result in  why any policies on  the management of conservation areas of the natural resources  haven’t given any legal protection  for reservation and the continuation of the functions of the natural resources:   biocentrism of the management of conservation areas, too dominant roles of the government/country, no recognition and protection of access to conservation areas and rights to master and to make use of the natural resources for local people; quasi roles of the people; prerequisite to  regulate the state’s rights. Phylosophically, juridically, and sociologically, local wisdoms posses important (strategic) values as a base for making policies on conservation in an unique way in Indonesia.  In order to reach a policy with a local wisdom-based conservation management , legal regulations accommodating local wisdoms and   bureaucrats  (managers of National Parks) have bravery in positioning themselves to solve any hindrances in formal legality to create substantive justice are needed.

Abstract

Permasalahan perlindungan pengetahuan tradisional merupakan hal yang cukup pelik. Disatu sisi negara menganggap bahwa pengetahuan tradisional sebagai suatu economic asset/capital untuk menjawab tantangan kompetisi perdagangan internasional. Di sisi lain terdapat fakta bahwa banyak masyarakat asli (indigenous people) maupun masyarakat non urban di tingkat lokal merupakan masyarakat yang termarjinalisasi dari sistem pembangunan ekonomi. Untuk itu bagaimana konsep perlindungan pengetahuantradisional (traditional knowledge) dalam dimensi Hak Asasi Manusia untuk menganalisis upaya harmonisasi hukum dalam kerangka pembangunan hukum di Indonesia. Pokok permasalahan dalam penelitian ini dikaji secara yuridis-normatif dan yuridis-filosofis. Dilengkapi juga dengan pendekatan yuridis-empiris, pendekatan historis, dan pendekatan yuridis-komparatif. Data dan informasi yang diperoleh dianalisis secara kualitatif dengan pendekatan deskriptif-analitis dan preskriptifanalitis. Hasilnya adalah Pembangunan hukum yang mencakup perencanaan, pembentukan, dan pembaharuan hukum nasional secara ideal dilaksanakan dengan berorientasi pada sistem. Dengan demikian pembangunan sistem hukum nasional di dalamnya terletak harmonisasi hukum dalam rangka mengintegrasikan berbagai sistem hukum sehingga tersusun dalam satu tatanan yang harmonis, selaras, serasi, seimbang dalam kerangka sistem hukum nasional.

Abstract

University students have an essential role in developing ecotourism services and supporting environmental education. The research aims to explore students' perceptions of the object of tourism, group behavior in travel and problems in tourist destinations. Surveys and interviews were conducted on students who conducted a field study in Coban Tengah tourism destination, Indonesia.  Students of Undergraduate (S1) and Master’s (S2) programs were interviewed regarding tourism objects, group interactions, and problems found in the tourism site. Descriptive analysis and chi-square statistics were carried out to meet research objectives. The results revealed that students show a positive and significant perception of the beauty of Coban Tengah waterfall. S1 students indicated the halo effect phenomenon in perceiving tourism objects regarding beauty, educational element, and trekking paths. Grouping in tourist travel provides benefits to protect or keep safety and serves as a place to discuss environmental conservation.  S2 students are less interested in forming groups because they have more experience and independence in travel than S1 student.  Groups build cooperation and empathy, and these can provide innovation for quality provision of tourism services.JEL Classification I28; Q26; Q58

Abstract

This article reviews the implementation of the marriage traditions of the Dayak Tobag traditional community in Tayan Hilir District, Sanggau Regency from a socio-anthropological perspective which is still maintained today. The aim is to identify, describe and explain marriages in the Tobag Dayak sub-tribe from a socio- anthropological perspective in Tebang Benua Village, Tayan Hilir District using empirical legal research methods to see the types of traditional marriages carried out by the Tobag Dayak indigenous community. Indigenous peoples often have deep reasons for maintaining traditional marriages and rituals. Indigenous peoples tend to highly value their traditions and cultural heritage. Weddings and traditional rituals are an integral part of their cultural identity that has been passed down from generation to generation. Maintaining traditions is considered a way to honor ancestors and maintain the integrity of their culture. From the results of this research it can be revealed that there are 4 types of Tobag Dayak traditional marriage ceremonies, namely: hanging marriage customs, simple marriage customs, ordinary marriage customs, and large wedding customs

Abstract

Penelitian ini fokus menganalisis arah kebijakan hukum nasional bagi perlindungan hukum rakyat jelata di Indonesia berdasarkan UUD 1945. Masyarakat hukum adat seringkali menghadapi tantangan dalam melindungi haknya atas wilayah dan sumber daya alam karena adanya konflik kepentingan dengan negara. Penelitian ini menggunakan metode deskriptif analitis dengan pendekatan kualitatif. Dokumen-dokumen seperti UUD 1945, peraturan perundang-undangan terkait serta literatur diperiksa untuk pengumpulan data. Tujuan analisis adalah menelusuri sejarah kebijakan dan peraturan hukum terkait komunitas hukum adat di Indonesia. Hasil survei menunjukkan bahwa pengakuan konstitusi terhadap hak-hak masyarakat mengalami pasang surut sejak tahun 1960, dan politik cenderung mengutamakan kepentingan ekonomi negara. Meskipun masa reformasi setelah tahun 1998 membawa perubahan positif dengan peraturan yang lebih inklusif, masih terdapat permasalahan dalam implementasi kebijakan. Perlindungan terhadap hak-hak masyarakat adat juga telah mendapat perhatian internasional melalui Deklarasi PBB tentang Hak-Hak Masyarakat Adat, namun implementasinya di Indonesia memerlukan upaya lebih lanjut. Oleh karena itu, kerjasama antara organisasi adat seperti AMAN dan Sekretariat Nasional MHA sangat penting untuk memajukan dan melindungi hak-hak masyarakat adat. Kajian ini merekomendasikan kebijakan khusus dan partisipasi aktif masyarakat adat dalam pembuatan undang-undang tersebut.

Abstract

Program pengabdian masyarakat ini bertujuan untuk melestarikan dan mengembangkan "Seni Malangan," kesenian tradisional di Kabupaten Malang, yang mencakup Wayang Topeng, Wayang Kulit, Ludruk, dan Tayub Malangan. Seni Malangan menghadapi ancaman dari modernisasi dan globalisasi yang mengurangi minat generasi muda terhadap seni tradisional. Program ini mengidentifikasi dan mengklasifikasikan berbagai bentuk seni Malangan serta merancang instrumen pengelolaan dan perlindungan Hak Kekayaan Intelektual (HKI) yang relevan. Edukasi dan penyuluhan menggunakan media E-Katalog/E-Brosur dilakukan untuk meningkatkan kesadaran masyarakat dan minat generasi muda terhadap seni ini. Program juga fokus pada pengembangan manajemen usaha dan pemasaran produk seni, termasuk penggunaan teknologi untuk produksi dan promosi. Partisipasi dalam event kesenian dan penggunaan media sosial membantu meningkatkan eksposur produk dan memperluas jaringan. Perlindungan HKI memastikan karya seni terlindungi secara hukum, mendukung inovasi dan pengembangan ekonomi kreatif. Hasilnya, program ini berhasil memberikan solusi konkret untuk pelestarian dan pengembangan Seni Malangan, sekaligus meningkatkan kesejahteraan ekonomi masyarakat lokal melalui sektor pariwisata dan industri kreatif.

Abstract

This study examines the integration of adat law into Indonesia’s national legal framework, focusing on the challenges and opportunities arising from the country’s legal pluralism. The objectives are threefold: to assess the historical and constitutional challenges in recognizing adat law, analyze the impact of post-Reformasi democratization, and compare Indonesia’s experience with other multi-ethnic nations. The primary problem lies in the centralist 1945 Constitution, which prioritizes state law over adat law, limiting the latter's recognition and application. The study finds that, despite constitutional amendments aimed at decentralization, adat law continues to face marginalization due to inconsistent regional regulations and the central government’s overriding legal authority. Post-Reformasi democratization has allowed for greater local governance, but the integration of adat law remains conditional and fragmented across regions. Comparative analysis with countries like Canada and South Africa reveals that a constitutional framework recognizing indigenous laws, alongside judicial clarity, can enhance legal pluralism. The study underscores the need for constitutional reforms and comprehensive judicial guidelines to ensure the full integration of adat law. This would create a more inclusive legal environment that respects Indonesia’s diverse cultural and legal traditions while promoting justice and equity for adat communities.
