Abstract

AbstractThat the crime is greatly enhanced both in terms of quantity and its quality. An increasingly complex conditions not only make a lot of conflicting interests. The struggle will be fine but always wanted to under-unite these demands should be coupled with legal protection as a basic struggle to obtain fair treatment for an act or result of criminal act itself. The discovery that the perpetrators of crime as any other human being who should be protected on behalf of human rights more regulated in the Penal Code and Criminal Procedure Code, but viewed from the other side of so many victims that it does not get his rights, whether by conviction of perpetrators of crime victims' rights are met what about the losses suffered by victims, things are not yet properly addressed in the Criminal Code and Criminal Procedure Code as a sense of justice.SimakBaca secara fonetik

Abstract

Abstract Forests are not only ecological but also used to function as a source of livelihood. In the forest, the people have the perception that they are not part of forest management institutions that are not bound to the rules of forest management institutions. This perception is certainly wrong, because the prevention and control of pollution and degradation must be addressed seriously and are responsible not only government but community participation. With the enactment of Law No. 19 of 2004 as a replacement for the Law No. 41 Year 1999 on Forestry. In it has arranged a variety of things, including the rights and obligations of communities in forest conservation. Key Note : Management, Protection and Preservation

Abstract

Abstract Potensi  pertambangan  batubara  membawa dampak  positif  dan juga   berdampak  negatif. Dampak  positifnya  adalah  bahwa kesejahteraan  masyarakat  di  wilayah  pertambangan  secara  umum  terlihat meningkat  karena  efek  dominan  dari  keberadaan  perusahaan  telah  mampu mendorong dan menggerakkan sendi-sendi ekonomi masyarakat, Struktur sosial di  masyarakat  juga  mengalami  perubahan  karena  masyarakat  sekitar pertambangan termotivasi untuk mampu menyesuaikan perubahan struktur sosial yang  disebabkan  banyaknya  masyarakat  pendatang  yang  menjadi  karyawan  di perusahaan  tambang  batubara  maupun  masyarakat  setempat yang membuka  usaha  di sekitar perusahaan batubara. Sedangkan dampak negatif, baik pada perubahan  struktur  sosial, budaya, ekonomi masyarakat maupun  pada kualitas lingkungan. Pengaruh  negatif  struktur  sosial  masyarakat  di  sekitar  perusahaan pertambangan  yang  mungkin  bisa  terjadi adalah  perilaku  dan  atau  kebiasaan yang  bersifat  negatif  seperti  perjudian,  kebiasaan  minum-minuman  keras  dan pola  hidup  konsumtif,  para  karyawan  yang  bisa  mendorong  perubahan masyarakat  lokal  menjadi  lebih  konsumtif dan  bila  hal  tersebut  tidak  didukung oleh  perubahan  kemampuan  daya  beli  masyarakat  lokal  akan  menyebabkan kecemburuan  sosial yang  pada akhirnya bisa menyebabkan  ketidak harmonisan (konflik sosial) antara warga di sekitar perusahaan pertambangan. Hal  lain  yang  tidak  boleh  diabaikan  adalah  dampak  negatif  terhadap kualitas lingkungan. Tidak dapat di pungkiri bahwa aktivitas pertambangan dapat dipastikan  menyebabkan  rendahnya  kualitas  lingkungan.  Untuk  mengendalikan kerusakan  lingkungan  yang  disebabkan  oleh  aktivitas  perusahaan  tambang batubara tersebut maka diperlukan  kontrol  yang  kuat dari  seluruh  steakeholder (perusahaan, pemerintah dan seluruh masyarakat).

Abstract

The principle of law country is started with the right of equality before the law. The meaning of balance is meant that police doesn’t need to cut it’s job and function. However positive control is needed on order to execute law enforcement duty by paying attention to human rights especially to a suspected or a defendant. The function of positive control is better to be done in the circle of POLRI organization it self by keeping the objectivity and professionalism improvement in every police individuals. Key Note : Law enforcement in human rigths
