Abstract

Keberadaan pidana mati dalam suatu sistem hukum pidana suatu negara seringkali diperdebatkan secara global tidak hanya tentang pembenaran keberadaan pidana tersebut tetapi juga terkait bagaimana pidana tersebut dijalankan. Terdapat berbagai permasalahan dalam pelaksanaan pidana mati saat ini seperti fenomena deret tunggu eksekusi pidana mati hingga implikasinya terhadap kondisi terpidana. Penelitian ini bertujuan untuk menganalisis proyeksi ke depan pelaksanaan pidana mati di Indonesia dalam RKUHP. Adanya pembaruan hukum pidana di Indonesia melalui Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) diharapkan menjadi solusi akan pandangan pro-kontra atas keberadaan sanksi pidana mati itu sendiri dan formulasinya dapat memberikan keadilan dan kepastian hukum dalam pelaksanaannya. Penelitian ini dilakukan dengan metode penelitian kualitatif, dengan pendekatan social legal research. Hasil penelitian menunjukkan bahwa jika RKUHP disahkan maka kedepannya keberadaan pidana mati tetap dipertahankan namun tidak lagi menjadi jenis pidana pokok. Adapun hal yang patut diperhatikan bahwa terdapat kelemahan dalam formulasinya, sehingga ke depannya masih belum menjamin kepastian hukum dalam pelaksanaan pidana mati.Kata kunci: Pelaksanaan Pidana Mati; Proyeksi; RKUHP  The existence of the death penalty in the criminal law system is often debated globally, not only the justification for the existence of the crime but also how the crime is carried out. There are various problems in the implementation of the death penalty, such as the death phenomenon which has an impact on psychologically attacking the convict. Draft Criminal Code (RKUHP) in Indonesia is expected to be a solution to the pros and cons of the existence of the death penalty itself and its formulation can provide justice and legal certainty in its implementation. Therefore, this study aims to analyze future projections of the implementation of the death penalty in Indonesia in the RKUHP. The research was conducted using qualitative research methods, with a social legal research approach. The results show that if the RKUHP is ratified, in the future the existence of the death penalty will be maintained but will no longer be the main criminal sanction. As for things that should be noted that there are weaknesses in the formulation, so that in the future it still does not guarantee legal certainty in the implementation of the death penalty.

Abstract

Sovereignty of the Rupiah is mandatory or grand design in Law Number 7 Year 2011 on The Currency, sovereignty of the Rupiah has resulted in the obligation to use Rupiah within the territory of the Republic of Indonesia in every payment transaction or business obligations. Every act that violates this obligation is responded by the law with punishment, while the times show that there are more acts of not using the Rupiah which not only occur in border areas but also in ordinary urban areas. This article discusses how the urgency of criminalization of Rupiah protection and how criminalization was formulated. The discussion is carried out with a normative approach to provide an overview of how criminalization was formulated in a law. The conclusion is that the use of the criminalization policy has urgency to protect the sovereignty of the Rupiah because actions that attack could result in economic instability which create various other types of criminal acts. Even so, the criminalization policy has not been formulated effectively because the details of the prohibited acts are too simple so that it creates interpretive bias, especially the ultimum remedium principle is not formulated so it is worrief that the formulation will contribute overcapacity in prison

Abstract

Restorative justice in the investigation is carried out by using the penal mediation method which provides an opportunity for the Victim and the Perpetrator in a participatory way to formulate a peace agreement facilitated by the Investigator. Penal mediation comes from civil mediation with problems in the process of drafting an agreement which must be ensured that it comes purely from the Parties. This research is a socio legal research conducted at the Directorate of General Criminal Investigation of the Regional Police of Central Java and the Indonesian Advocates Association of the Semarang Branch of the Leadership Council with the methods of interviewing, observing, and reviewing case files. This research examines two problems: how the process of preparing a penal mediation agreement fits into the application of restorative justice at the investigation stage, and how to supervise the implementation of a penal mediation agreement at the investigation stage. The results of the study show that the penal mediation agreement was prepared by the Parties themselves, facilitated by the Investigator, but did not involve the community so that the orientation of returning to social harmonization was not felt. Abstract

Maraknya kasus penipuan investasi di Indonesia menimbulkan pertanyaan substantif tentang apakah mereka yang menjadi korban berhak mendapatkan asset recovery. Tulisan ini hendak mengungkap bagaimana keterjangkauan regulasi Indonesia memfasilitasi hal asset recovery dan bagaimana proyeksi Rancangan Undang-Undang Perampasan Aset melihat asset recovery bagi korban penipuan investasi. Artikel ini merupakan penelitian normatif dengan memfokuskan pada Rancangan Undang-Undang Perampasan Aset, berbagai putusan pengadilan yang telah menguji asset recovery sebagai hak korban kejahatan investasi, dan telaah literatur dalam topik yang sama. Artikel ini mengungkap bahwa  regulasi tidak menjangkau asset recovery, dan keterbatasan ini juga dialami Rancangan Undang-Undang Perampasan Aset sebagai regulasi yang diproyeksikan berlaku di masa depan. Rancangan ini membatasi pada upaya negara untuk memiskinkan koruptor melalui kemudahan perampasan aset, tanpa mempertimbangkan bahwa pencucian uang tidak selalu berasal dari korupsi, tapi juga penipuan investasi.

Abstract

The implementation of legal aid service standards, as outlined in Regulation No. 4 of 2021 by the Minister of Law and Human Rights of Indonesia, was expected to enhance the quality of legal aid services. However, in reality, suspects continue to experience inconsistent access to their rights, especially within the criminal justice system. This study aims to investigate the application of these standards across the police, prosecutor's office, and court sectors. Employing an empirical juridical approach with a qualitative and comparative study method, data was gathered through interviews and literature review, then analyzed using content and comparative analysis techniques. The findings reveal that the enforcement of legal aid service standards in the criminal justice system has been ineffective, marked by frequent violations of suspects' rights. These violations include providing indirect assistance, inadequate representation at various stages of trials, appointing advocates not affiliated with accredited LBH (Legal Aid Institute), and advocates displaying insufficient responsiveness and engagement in assisting suspects. Such violations significantly hinder suspects' access to justice within the criminal justice system.

Abstract

Reintegrating juvenile offenders into society with a positive reception is a primary objective of education, aimed at breaking the cycle of incarceration that results in recidivism. This article aims to delineate the prison education policies within Indonesian juvenile correctional facilities (LPKA), focusing on regulatory frameworks and their practical implementation. It focuses on the issue of the LPKA's capability in Indonesia to ensure access to education, which is a fundamental right of juvenile inmates, and on whether its benefits can be felt and realized. Data collection methods encompassed interviews, regulatory assessments, institutional report evaluations, and literature reviews. Findings indicate that, despite a 270% decrease in juvenile inmate numbers from 2018 to 2022, only 68% of this population was granted educational access. Contributing factors include specific regulatory constraints on educational access and a lack of innovative collaborations, even with the reduced workload in LPKA. The study advocates for the initiation of formal educational institutions within LPKA, minimizing reliance on the Ministry of Education and allowing for curriculum adaptation to prevailing conditions. Abstract

One of the things that has been potentially overlooked in the development of criminal law during the Covid-19 pandemic is how the Prosecutor's Office and the Courts view the seriousness of property crimes. Every state has set up a social safety net to ensure that individuals are able to live without hunger despite the economic slowdown, and this initiative also comes along with a more intense social concern from the social environment. This article seeks to uncover the patterns of prosecution and imprisonment by judges for property crimes during the pandemic, which are inappropriate as everyone experiences family loss and economic hardship. The primary data in this article uses interviews with prosecutors and judges, then validates it in data on the length of prison charges and prison sentences recorded in the Case Tracking Information System (SIPP) in the Semarang District Court, Banyumas District Court, and Purwokerto District Court. The results of this research reveal two important things. First, prosecutors and judges in Indonesia during the Covid-19 pandemic did not aggravate prison charges and prison sanctions, even the Penitentiary tended to accelerate the assimilation process or shorten the duration of imprisonment. Second, property crimes committed during the pandemic are relevant to aggravate the threats and penalties, because they make life difficult for people who are financially and psychologically weak. Indonesia should consider revising the sentencing guidelines in the National Criminal Code before it becomes effective in 2026.
