Abstract

In addition to getting wages, there are other variables that also appear to be related to the performance of workers/labourers, namely bonuses. Work agreement contains a bonus calculation clause, then the bonus becomes mandatory and becomes the right of the worker/worker. However, if it is not contained in the work agreement, then the entrepreneur may consider that the bonus is something that is not mandatory. This of course creates a different perception between workers, employers and the government in interpreting bonuses. Whether the bonus is part of the workers/labor's rights or is the bonus only an award whose payment really depends on the good faith of the entrepreneur. This paper presents the discourse by explaining from socio-legal research because it is a study of law using a legal science approach and social science approach using a field approach. This paper reveals that the bonus arrangement itself is an important component in the working relationship between the employer/employer and the worker/labourer. Because in principle, bonuses are one way to increase company productivity.

Abstract

 The status of Islamic banking in dispute settlement is normatively a positive legal subject to Islamic law principles. The Financial Services Authority confirms that many conflicts involve Islamic banks and their customers. The problem of the legal and economic context of Islamic banking is more complex, considering the operational concept of Islamic banks is different from conventional banking. Islamic banking must operate based on sharia, including in dispute resolution issues. Spiritual rights are one of the interests of Islamic banking customers that require attention. This study investigates the protection of spiritual rights in the sharia banking dispute settlement based on the perspective of Indonesian sharia banking law. This study employed normative qualitative research methods on primary data, such as the sharia banking law, the consumer protection act, and the dispute resolution act. It found that Indonesia has laws to address sharia banking disputes based on Islamic principles. However, they have not been appropriately implemented. The authority of religious courts to settle disputes on sharia banking has not been effective in protecting spiritual rights because there are still processes of settlement on sharia banking through the general courts. Abstract

MK sebagai wajah konstitusi di Indonesia dengan kewajibannya untuk melindungi dan memberikan interpretasi terhadap konstitusi, idealnya haruslah menyadari bahwa Pemilu sebagai kontestasi politik dipengaruhi oleh banyak hal dalam pelaksanaanya. Maksudnya adalah, patut diduga bahwa tidak semua hal yang menciderai asas Luber Jurdil telah di atur dalam peraturan perundang-undangan atau dapat disebut sebagai pelanggaran atau kejahatan Pemilu secara positivistik. Berdasar pada anggapan di atas, maka patutlah diajukan pertanyaan, apakah proses penyelesaian PHPU di MK telah mampu menjamin terlaksanya Pemilu yang Luber Jurdil?, atau sederhananya apakah Penyelesaian PHPU tersebut telah ideal?. Pertanyaan tersebut patut untuk didiskusikan secara ilmiah dengan mendalam dan menyeluruh dalam Pelatihan yang Pengabdi jadikan sebagai Pengabdian Kepada Masyarakat untuk Semester Genap T.A.2019/2020. Kegiatan ini dimaksudkan untuk memberikan pemahaman kepada Peserta tentang Mekanisme Perselisihan Hasil Pemilu; Memberi pemahaman kepada Peserta tentang hal-hal update tentang Hukum Acara Perselisihan Hasil Pemilu; Menciptakan Praktisi hukum yang dapat memformulasikan serta memetakan permasalahan Hukum Pemilu; dan Teruntuk Dosen yang menjadi Narasumber juga sebagai Pelaksanaan Pengabdian Kepada Masyarakat yang menjadi bagian dari Tri Dharma Perguruan Tinggi.

Abstract

The appointment of Constitutional Court Judges between one country and another certainly has similarities and differences. This is greatly influenced by the history, state system and political situation of a country. Therefore, a problem is formulated regarding the characteristics of the mechanism for appointing constitutional court judges between Indonesia and Thailand. This study aims to determine and analyze the differences in filling constitutional court judge positions between Indonesia and Thailand. The study uses a normative legal method using primary, secondary, and tertiary data because by using this method, this study can produce descriptive data obtained from written words related to the object of the writing. This study also uses a comparative method between Indonesia and Thailand. The results of this study indicate that there are significant differences regarding the mechanism for appointing constitutional judges. Indonesia was proposed by three state institutions with their respective procedures, then Thailand was proposed by the Judicial institution and a special committee was formed to select constitutional judges.

Abstract

This article examines the importance of state power in regulating religion in a limited scope. This is intended to solve classic problems, such as the state immediately fulfilling the constitutional rights of local religious adherents. Even though the Constitutional Court partially recognizes the existence of local religions through decision No.97/PUU-XIV/2016, this decision does not change the legal status of local religions, which are not considered official state religions. This research contributes to efforts to fulfill the right to freedom of religion for followers of Indigenous religions through policy design that does not restrict local religions from becoming official state religions. This study employed a normative legal research method, which concludes that the state's involvement in limiting local religions is by issuing various rules that distinguish religion from belief and standardizing religion, which closes the opportunity for local religions to be recognized as an official state religion. Limitations on state power can be carried out by issuing state regulations in religion, which limits to regulate fostering harmony of religious life and upholding the freedom of religion and avoiding regulatory patterns that classify religions and standardize religion because it will hinder the fulfilment of the constitutional rights of belief adherents
