Abstract

The Constitutional Court has the authority to protect the constitutional rights of citizens and provide interpretations of the constitution, ideally in an election which is a political contestation that is built up by many things in its implementation. The Constitutional Court's function is to keep the Election in line with Election Principles which are regulated by Positive Law. Based on the above assumptions, it is worth discussing whether the process of proving PHPU in the Constitutional Court has been able to guarantee the implementation of an overly judicial election, or simply whether the proof of PHPU is ideal. This activity is about providing understanding to Participants of Evidence and Evidence Tool on Election Result Disputes; Providing understanding to Participants regarding updated matters regarding the Legal Evidence of Election Result Dispute; and especially for Lecturers as a means of Community Service which is part of the Tri Dharma of Higher Education. Keywords: Evidence, Evidence Tool, Election Result Disputes Abstrak Mahkamah Konstitusi memiliki kewenangan untuk melindungi hak konstitusional warga negara dan memberikan interpretasi terhadap konstitusi, idealnya dalam Pemilu yang merupakan kontestasi politik dipengaruhi oleh banyak hal dalam pelaksanaanya. MK berfungsi untuk menjaga agar Pemilu sejalan dengan Asas Luber dan Jurdil sebagaimana yang diatur Hukum Positif. Berdasar pada anggapan di atas, maka patutlah didiskusikan, apakah proses pembuktian PHPU di MK telah mampu menjamin terlaksanya Pemilu yang Luber Jurdil, atau sederhananya apakah Pembuktian PHPU tersebut telah ideal. Kegiatan ini dimaksudkan untuk memberikan pemahaman kepada Peserta tentang Pembuktian dan Alat Bukti Perselisihan Hasil Pemilu; Memberi pemahaman kepada Peserta tentang hal-hal update tentang Pembuktian Hukum Acara PHPU; dan khusus Dosen sebagai sarana Pengabdian Kepada Masyarakat yang merupakan bagian dari Tri Dharma Perguruan Tinggi. Abstract

ABSTRACTArticle 18 of the Constitution of 1945, is not set explicitly on the model either local elections before the change and after the change, giving rise to multiple interpretations. Legislature to interpret the model in accordance with the local elections of political will at the time. Prior to the 1945 changes in the regulation of local government such as the Act No. 5 of 1974, No. 22 of 1999, and after the 1945 changes governed by Act No. 32 of 2004 on regional governance. Setting the local elections in the legislation are inconsistencies between laws that regulate each other electoral models vary. The inconsistency of these legal norms have implications for the implementation of regional autonomy within the system of the Republic of Indonesia. Under the decentralized form an autonomous region, the system is essentially delegated to the local government administration (the law) is given the right to administer their own affairs of the household. The goal is for people to participate in democratic governance, inorder to realize social justice welfare in the area.Key words : Implications, Local Elections, Autonomy

Abstract

MK sebagai wajah konstitusi di Indonesia dengan kewajibannya untuk melindungi dan memberikan interpretasi terhadap konstitusi, idealnya haruslah menyadari bahwa Pemilu sebagai kontestasi politik dipengaruhi oleh banyak hal dalam pelaksanaanya. Maksudnya adalah, patut diduga bahwa tidak semua hal yang menciderai asas Luber Jurdil telah di atur dalam peraturan perundang-undangan atau dapat disebut sebagai pelanggaran atau kejahatan Pemilu secara positivistik. Berdasar pada anggapan di atas, maka patutlah diajukan pertanyaan, apakah proses penyelesaian PHPU di MK telah mampu menjamin terlaksanya Pemilu yang Luber Jurdil?, atau sederhananya apakah Penyelesaian PHPU tersebut telah ideal?. Pertanyaan tersebut patut untuk didiskusikan secara ilmiah dengan mendalam dan menyeluruh dalam Pelatihan yang Pengabdi jadikan sebagai Pengabdian Kepada Masyarakat untuk Semester Genap T.A.2019/2020. Kegiatan ini dimaksudkan untuk memberikan pemahaman kepada Peserta tentang Mekanisme Perselisihan Hasil Pemilu; Memberi pemahaman kepada Peserta tentang hal-hal update tentang Hukum Acara Perselisihan Hasil Pemilu; Menciptakan Praktisi hukum yang dapat memformulasikan serta memetakan permasalahan Hukum Pemilu; dan Teruntuk Dosen yang menjadi Narasumber juga sebagai Pelaksanaan Pengabdian Kepada Masyarakat yang menjadi bagian dari Tri Dharma Perguruan Tinggi.

Abstract

Paper ini membahas Original Intent Pasal 7 Ayat (1) huruf C, dan Pasal 52 Undang-Undang No.12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan (UU P3) yang mengatur Tentang Pencabutan PERPPU, dan Paper ini juga memberikan konsep Ideal Pencabutan PERPPU dalam Sistem Ketatanegaraan Indonesia. Penelitian ini adalah Penelitian Hukum Normatif dengan pendekatan perundang-undangan dan konseptual. Dalam penelitian ini disimpulkan beberapa hal, Pertama, Penulis menilai baik dari DPR maupun Ahli Hukum Tata Negara yang dihadirkan DPR menganggap PERPPU sama dengan UU jadi tata cata pembentukan, dan pencabutannya disamakan dengan UU. Kedua, Penulis memilih model pencabutan PERPPU yang diatur dalam Konstitusi RIS 1949, dan UUDS 1950, yaitu setelah dicabut oleh Parlemen, PERPPU yang ditetapkan Presiden mutatis mutandis tidak berlaku.

Abstract

Penelitian ini membahas Dinamika dan Praktik Ketetapan Majelis Permusyawaratan Rakyat (TAP MPR) yang bersifat mengatur dan berlaku umum yang Berfungsi Mencegah Krisis Konstitusional di Indonesia Dalam Kurun Waktu 1965-2001; Membahas Original Intent Undang-Undang Pembentukan Peraturan Perundang-Undangan (UU P3); dan memberikan Konsep Penguatan TAP MPR yang bersifat mengatur dan berlaku umum tersebut. Hasil Penelitian ini: Pertama, Dari Tahun 1965 Sampai 2001, TAP MPR yang bersifat mengatur dan berlaku umum berhasil mengantisipasi krisis konstitusional di Indonesia. Kedua, Penempatan TAP MPR Dalam UU P3 dimaksudkan sebagai langkah menghindari terjadinya kekosongan hukum mengingat sejauh ini masih terdapat TAP MPR yang penting untuk dipertahankan sebagai dasar yuridis penyelenggaraan Negara. Ketiga, Konsep Penguatan TAP MPR yang bersifat mengatur dan berlaku umum, yaitu: Revisi UU P3, Pembatasan Materi Muatan TAP MPR, Menjadikan TAP MPR Sebagai Konvensi Ketatanegaraan Tidak Tertulis dan Memberikan Kewenangan MK menguji TAP MPR Terhadap Pancasila. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, historis, kasus, dan konseptual.

Abstract

An agreement is an act by which one or more people bind themselves to one or more people in implementing a cooperation agreement for securing vital objects between the Bengkulu Police and Bank Bengkulu, whether the agreement is valid as per Article 1320 of the Civil Code and has been implemented by both parties, the obstacles faced in implementing the cooperation agreement, and the resolution of the dispute if a breach of contract occurs. In the cooperation agreement for securing vital objects between the Bengkulu Police and Bank Bengkulu, it has been implemented by both parties in accordance with the contents of the agreement containing the rights and obligations of the parties, as well as the fulfillment of the valid conditions of the agreement, both subjective and objective conditions, in accordance with Article 1320 of the Civil Code. The obstacles faced in implementing the cooperation agreement are from the underutilization of security facilities such as CCTV, external obstacles, namely the large number of customers at the beginning of the month which causes the security personnel to be overwhelmed. In the agreement, if one party causes a breach of contract due to the agreement, it can be resolved in a non-litigation manner, namely mediation and deliberation, but if it is unsuccessful, the court will take the form of.

Abstract

Police detainees are individuals suspected of committing criminal acts who are held in police detention centers. During their detention period, suspects are placed in the Bengkulu Regional Police Detention Center (Rutan Polda Bengkulu), under the responsibility of investigators and detention officers to ensure proper legal procedures. This study aims to analyze whether the management and care of narcotics offenders in the Bengkulu Police Detention Center are in accordance with existing legal provisions, and to identify the factors that hinder such management and care. The research used four techniques: (1) Population and Sample Determination, which included all police officers of the Directorate of Detention and Evidence (Dit Tahti) at the Bengkulu Regional Police and all narcotics detainees; (2) Data Collection using primary and secondary data; (3) Data Processing through coding and editing; and (4) Data Analysis using a qualitative descriptive method with a normative-empirical approach. The findings show: (1) Management and care of narcotics detainees at the Bengkulu Police Detention Center are in accordance with applicable laws and regulations, including: Perkap No. 4 of 2005, Perkap No. 4 of 2015, Law No. 12 of 1995, Law No. 39 of 1999, Law No. 35 of 2009, Law No. 5 of 1997, Law No. 2 of 2002, and Presidential Regulation No. 58 of 1999. (2) Factors hindering effective detainee management and care include: the classification of narcotics detainees as special detainees, ineffective service procedures, overcrowded cells, lack of officer knowledge on detainee care, limited medical personnel, short detention periods, and minimal involvement from related government agencies.

Abstract

This research aimed to provide a conceptual idea regarding legal options in resolving disputes of democratic regional head elections in Indonesia with two proposed options. The first option included revising the Election and Regional Election Law to grant authority to the Constitutional Court (MK) and Election Supervisory Agency (Bawaslu) for adjudicating disputes. The second option proposed implementing the Fifth Amendment to the 1945 Constitution to reconstruct the Constitutional Court as an election court correlating with the primary role of upholding regulations. These proposed options would grant the Constitutional Court the authority to examine and adjudicate substantial matters related to the constitutionality of elections. Furthermore, the analysis used normative legal research including statutory, comparative, and conceptual methods.

Abstract

Bureaucracy, from a societal perspective, is often perceived as complex, slow, and inefficient. Despite these criticisms, bureaucracy remains a fundamental component of governance and plays a crucial role in societal functioning. As such, bureaucratic reform has been a prominent focus of policy discussions for several decades. A technology-driven government system, coupled with a bottom-up approach, has the potential to enhance efficiency, transparency, and accountability in public administration. However, in practice, such reforms have been largely confined to central government institutions and select agencies. This study aims to explore the integration of technology within the bureaucratic system in Indonesia, with a focus on its comprehensive implementation across government structures. Employing a normative research methodology, the study emphasizes the need for the government to take proactive steps in developing a skilled workforce in information technology. The authors also recommend strategically mapping positions that can integrate technological expertise throughout government departments. Furthermore, the study proposes a comprehensive examination of the potential for replacing executive positions with artificial intelligence (AI) to streamline and simplify bureaucratic processes.  In addition to technological advancements, bureaucratic reform must be accompanied by legal reform, particularly in the areas of data security and the protection of personal information. This includes redefining bureaucratic and personal data categories to ensure robust safeguards. The Personal Data Protection Law should play a pivotal role in integrating these data types and ensuring their protection. Moreover, the Telecommunications Act and the Personal Data Protection Act should foster collaboration between the government and technology companies to develop effective security solutions. Lastly, strengthening the Ombudsman as a public service oversight institution is essential to ensuring transparency and accountability in the implementation of bureaucratic and technological reforms.

Abstract

The stagnation of human rights enforcement in Indonesia's Reformation Era has highlighted a critical imbalance: the current system prioritizes punishing perpetrators of serious human rights violations over addressing the recovery and well-being of victims. This research introduces The Constitution of Peace as a transformative, victim-centered model for resolving serious human rights violations outside the courtroom, aligning with the principles and soul of the 1945 Constitution. The proposed model comprises three innovative approaches: first, mediation facilitated by the National Human Rights Commission to foster dialogue and accountability; second, the provision of compensation, restitution, and assistance to victims through the Witness and Victim Protection Agency, ensuring tangible support for recovery; and third, an official apology by the relevant authority, accompanied by the fulfillment of economic, social, and culpability obligations. Together, these measures aim to correct the limitations of the current retributive framework by prioritizing restorative justice and victim empowerment. By embracing these victim-oriented solutions, this model not only addresses the legal and moral obligations enshrined in the 1945 Constitution but also fosters reconciliation and societal healing. The research underscores the transformative potential of the Constitution as a foundation for peace, justice, and the resolution of entrenched human rights challenges. It calls for a paradigm shift from punitive measures to a more holistic approach, ensuring that justice serves both the dignity of victims and the broader goal of national harmony.
