Abstract

This study aims to be able to analyze the problem of sexual harassment in the workplace from a criminological perspective. The method used is normative juridical research. Criminology is a study that looks at the causes of a crime, as well as how the efforts and efforts to overcome the crime. One of the sad forms of crime that occurs in society is Sexual harassment or what we know as sexual harassment. Sexual harassment can happen anywhere, without exception in the workplace. One form of sexual harassment is “Quid pro quo” (this is for that). Causes of Evil behavior can arise due to social, political, and many other things. The causes of sexual harassment in the workplace are power relations, gender inequality, perpetrators do not get the consequences of their actions

Abstract

Introduction: Transplantation is intended to replace a damaged or functioning organ in the recipient with another organ that is still functioning from the donor. Technological developments in the world of health not only have a positive impact on the world of medicine but also open up opportunities for illegal human organ trading syndicates. Human organ trafficking is a type of transnational crime that has occurred frequently in recent decades.Purposes of the Research: Aims to analyze human organ trafficking as a transnational crime.Methods of the Research: The research method used is normative juridical.Results of the Research: Illegal trade in human organs involving cross-border syndicates is a transnational crime. Cross-border crime is a threat that is taken seriously by each country because it threatens the security and stability of the country. To prevent this, countries can work together with each other. with each other through bilateral agreements, one of which is the extradition agreement, to stop the practice of selling and buying human organs. It is hoped that the implementation of laws and regulations related to human organ crimes will run smoothly so that the perpetrators can be charged using existing regulations. So transplants can only be carried out for humanitarian purposes and can only be carried out in certain health facilities by health workers who have the expertise and authority to do so.

Abstract

The 1945 Constitution of the Republic of Indonesia states that the earth and water and the natural resources contained therein are controlled by the state and used for the greatest prosperity of the people. The state has the right to manage and control natural resources, which will be used for the prosperity of the people. However, the polemic about the rise of illegal mining carried out by irresponsible individuals, whether carried out traditionally or using heavy equipment, is very disturbing. Law enforcement is one of the steps that can be taken to handle illegal mining cases. The use of criminal legal instruments can be used in law enforcement against illegal mining cases. Mining without a permit violates the criminal provisions of Article 158 of Law Number 3 of 2020 concerning Amendments to Law Number. 4 of 2009 concerning Mineral and Coal Mining. Mining activities have a direct physical impact on the environment, such as loss of resources and environmental damage during the mining process and even after mining is carried out.

Abstract

Latar Belakang: Penerapan sanksi pidana terhadap anak yang melakukan tindak pidana berbeda perlakuannya dengan orang dewasa yang melakukan tindak pidana. Dalam proses penyelesaian perkara anak yakni dialihkan dari pengadilan formal ke jalur non formal,dalam proses untuk diselesaikan perkaranya. Diversi membantu anak menghindari hal-hal buruk yang dapat mengganggu perkembangan mereka dan masa depan mereka. Pengetahuan masyarakat terkait penyelesaian perkara anak melalui upaya diversi masih minim sehingga untuk memecahkan permasalahan tersebut maka sangat dibutuhkan penyuluhan hukum tentang penyelesaian perkara anak. Tujuan Pengabdian: Tujuan utama dari pengabdian yang dilakukan adalah memberikan pandangan serta pamahaman kepada peserta didik SMP PGRI Rutah terkait dengan proses penyelesaian perkara anak melalui diversi Metode Pengabdian: Metode yang dilakukan dalam kegiatan pengabdian ini adalah metode pemaparan materi dilanjutkan dengan sesi tanya jawab. Hasil/Temuan Pengabdian: Hasil yang didapatkan diketehui bahwa banyak diantara mereka belum memahami terkait dengan hak-hak mereka ketika berhadapan dengan hukum. Peserta didik SMP PGRI Rutah menunjukkan antusiasme, memberikan penyuluhan hukum terkait dengan anak yang berhadapan hukum memberikan mereka pendidikan hukum terkait dengan penyelesaian perkara anak melalui diversi. Sanksi pidana yang diterapkan terhadap anak yang melakukan tindak pidana tidak sama dengan yang diterapkan terhadap orang dewasa yang melakukan tindak pidana. Para ahli hukum berpendapat bahwa untuk menetapkan aturan formal yang mengeluarkan seorang anak yang melakukan pelanggaran hukum atau melakukan tindak pidana dari proses peradilan pidana dan memberikan alternatif yang lebih baik untuk anak untuk melindunginya dari pengaruh formal sistem peradilan pidana. Diversi membantu anak menghindari hal-hal buruk yang dapat mengganggu pertumbuhan dan masa depan mereka.

Abstract

Introduction: Violence against women is still taking place. Nowadays, issues involving women are increasingly becoming one of the crucial issues in society, not only at the national level, but also at the global level.Purposes of the Research: The purpose of this study is to find out about the application of customary criminal penalties to cases involving women.Methods of the Research: Normative legal research is carried out by examining laws and regulations, jurisprudence and values that lives in society.Results of the Research: The application of penalties for violators in Negeri Amahai, Negeri Haruru, Negeri Nua Nea, Negeri Rutah, and Negeri Souhoku, Negeri Tamilouw highly respects traditional values, which always protect their regions. The customs of their ancestors, until now still exist in people's lives. In fact, until now, the existence of indigenous peoples in several countries in Central Maluku is still maintained, and customary law is maintained by the people of Central Maluku because customary law is pure and can reduce conflicts and erase the stains contained in society.

Abstract

Introduction: Cyber bullying or bullying in cyberspace is an intentional act of intimidation, humiliation, humiliation or harassment via the internet. One typical example was experienced by FS, where the victim received deliberate insults from the perpetrato, through posts on the perpetrator's social account (FB). Purposes of the Research:  this research aims to examine and discuss the elements of the criminal act of cyber bullying and the application of criminal sanctions against performers of cyber bullying.Methods of the Research: This research uses a normative juridical research method with the legal materials used, namely primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques were carried out through literature study and analyzed using qualitative methods to answer the problems in this researchResults / Findings / Novelty of the Research: The results of this research explain that Cyber bullying is a bullying behavior or annoying behavior, continuously harassing or causing trouble to someone through the internet or cyberspace, such as spreading disputes, harassment, defamation, these actions comply with the formulation of article 27 paragraph (3 ) ITE Law. One of them is insulting or defaming which can make the perpetrator threatened with article 27 paragraph (3) and threatened with imprisonment for a maximum of 4 (four) years and/or a fine of a maximum of IDR 750,000,000.00 (seven hundred and fifty million rupiah). The crime of cyber bullying cannot be completely eradicated, but it can be prevented by starting from oneself, and this crime should not be ignored and considered a joke, but we must better understand the impact of the crime of cyber bullying itself
