Abstract

Ahead of the syncronous Regional Elections (Pilkada) that to be run in November 2024, there is still a polemic related to the legal guidelines for the acting of regional heads’s levitation whose term of office ends ahead of the 2024 simultaneous elections. The legal basis for the Minister of Home Affairs Regulation Number 4 of 2023 concerning Acting Regional Heads issued by the Minister of Home Affairs is considered to have many irregularities. This paper reveal the absence of statutory delegation in the issuance of the Permendagri and the use of legal considerations of the Constitutional Court judges in the Constitutional Court Decision Number 15/PUU-XX/2022 as a consideration in the Permendagri. The research method used in this paper is normative juridical through a statutory approach as a source of existing law. The results of this study conclude that the issuance of Permendagri No. 4 of 2023 is unfounded if only viewed through the presence or absence of delegation of the formation of implementing regulations. If viewed more broadly through the theory of discretion, then this is considered valid, in order to fill the legal vacuum. The legal deliberations of the Constitutional Court judges in MK’s Decision Number 15/PUU-XX/2022 also strengthen the legitimacy of the issuance of Permendagri No. 4 of 2023, this is because the content of the legal considerations is considered to be commensurate with the ruling, even though the ruling was rejected. Unfortunately, the implementing regulation chosen by the government to regulate the inauguration of acting regional heads is in the form of a Minister of Home Affairs Regulation, not a Government Regulation.

Abstract

National defense is not only related to military defense, but also encompasses the active role of citizens in maintaining social and economic stability. Workers are a vital element in national development. Therefore, protecting workers' rights is an integral part of national defense efforts. This article aims to analyze the legal protection of workers' rights under Law Number 13 of 2003 concerning Manpower and relate it to the values ​​of national defense. The method used is a normative juridical approach through literature review. The results of the study indicate that labor regulations have regulated various workers' rights, but implementation challenges in the field remain high. The active role of all parties is needed to ensure legal protection is truly realized as a form of civil national defense. This indicates that legal protection for workers needs to be strengthened through the active roles of the government, employers, and workers themselves to create social and economic stability, which is an integral part of national defense. Therefore, an active role is needed from all parties, including the government, employers, and workers themselves, to realize optimal legal protection as a form of civil national defense that supports the sustainability of national development.

Abstract

Perjanjian pinjam nama atas Hak Milik tanah oleh Warga Negara Asing (WNA) merupakan praktik yang sering digunakan untuk menghindari pembatasan subjek hak dalam Undang-Undang Pokok Agraria (UUPA). Praktik ini menimbulkan ketegangan antara asas nasionalitas, kebebasan berkontrak, dan kepastian hukum, terutama ketika WNA bertindak sebagai pemilik manfaat (beneficial owner) melalui rangkaian akta yang secara substansi mengalihkan penguasaan tanah. Penelitian ini bertujuan menganalisis keabsahan perjanjian pinjam nama, kedudukan hukum beneficial ownership dalam sistem pertanahan nasional, serta pertimbangan Mahkamah Agung dalam Putusan 4223 K/Pdt/2022. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa perjanjian pinjam nama merupakan perjanjian dengan causa terlarang karena bertentangan dengan Pasal 21 dan Pasal 26 ayat (2) UUPA serta tidak memenuhi syarat objektif perjanjian menurut Pasal 1320 KUHPerdata. Beneficial ownership tidak memiliki kedudukan hukum dalam pertanahan karena sistem hukum tanah Indonesia bersifat monistik dan hanya mengakui pemilik yang tercantum dalam sertifikat. Putusan Mahkamah Agung menegaskan bahwa pendanaan oleh WNA tidak menimbulkan hak apapun atas Hak Milik dan menyatakan seluruh rangkaian perjanjian nominee batal demi hukum sejak awal.

Abstract

The delay in issuing land title certificates after the repayment of Home Ownership Loans creates legal uncertainty and potential losses for debtors. This study aims to analyze the responsibility of Bank Tabungan Negara and the role of the National Land Agency regarding delays in issuing land title certificates after loan repayment, to assess whether such delays fulfill the elements of default or constitute an unlawful act and to evaluate the forms of legal protection and dispute resolution mechanisms available to debtors. The object of this study is the legal issue related to delays in issuing land title certificates after loan repayment. The research subjects include Home Ownership Loan debtors, Bank Tabungan Negara and the National Land Agency. This study applies a normative legal research method using juridical analysis and case studies. The results indicate that Bank Tabungan Negara bears moral and administrative responsibility in ensuring the rights of debtors, while the National Land Agency plays a role in the issuance of certificates and supervision of the bank’s obligations. Delays in certificate issuance may fulfill the elements of administrative default if negligence occurs in fulfilling obligations by Bank Tabungan Negara. The bank needs to strengthen its internal task force, while the National Land Agency should optimize the implementation of Electronic Mortgage Rights, Electronic Land Certificates and apply a Service Level Agreement to ensure accountability and timeliness of certificate issuance which provides legal certainty and legal protection.
