Abstract

Globalization has implications for the Indonesian diaspora in various parts of the world. Indonesian diaspora groups are aggressively fighting for their citizenship status in order to have dual citizenship. Law No. 12 of 2006 concerning Citizenship of the Republic of Indonesia has not regulated dual citizenship status for the Indonesian diaspora. The purpose of the study is to identify and analyze the dual citizenship position of the Indonesian diaspora in the Indonesian Citizenship Law. The research method used is normative legal research. The study suggested that citizenship status is very important because it relates to issues of rights and obligations. The bipartite status provides the protection and identity of the two countries. However, it is not the time to grant unlimited dual citizenship status because first, it needs an in-depth study of the implications of social, economic, cultural, political, security, and legal aspects as well as changes to the relevant related laws and regulations.

Abstract

This study aimed to examine what the legal consequences are for those who are stateless persons and how the government's legal protection for people with status as stateless persons in Indonesia. The method used to achieve this goal is through normative legal research. Legal materials will be collected by means of an inventory, classification, identification, interpretation and descriptive analysis. The results indicated that there are various causes of statelessness, such as: disintegration of the nation, political factors, the application of different citizenship principles between countries, bureaucratic obstacles, racial, religious discrimination and etcetera. The state of statelessness will result in the lack of rights and obligations and protection of them from any country. Indonesia has attempted to provide legal protection for those with statelessness through concrete efforts by collaborating with UNHCR, entering into agreements between countries, discretion and regulations in existing legislation. However, the existing regulations still need to be revised the obscurity of several norms relating to protection of stateless persons.

Abstract

The Government of Badung Regency provides public services, both in the forms of services and goods, to its community as part of its duty in performing governance. In the implementation, such public services are regulated in regulation which is derived from the existence of policy in the delegation of authority. The regional regulation as such is containing what so called the substance materials. The substance materials of Regency/City Regional Regulation mean that such regulation contains typical substance materials that are not contained in other Laws and Regulation both in the local and central level. The formulations of legal norms in the Regional Regulation are conducted by using the single and pairs formulations. The targets that will be realized, the scope of regulation and drafting direction of Regional of Badung Regency on Public Services, among others: scope of public services, integrated service system, guidelines for the standrad services preparation, the proportion of community groups and categories in a tiered services and community participation in performing the service.

Abstract

Tujuan studi ini adalah untuk mengetahui perlindungan hukum khususnya dalam konteks hak asasi manusia terhadap tenaga kerja asing dalam perspektif hukum positif Indonesia. Pada studi ini menggunakan pendekatan yuridis normatif untuk menguraikan norma serta menggambarkan peraturan tertulis yang ada dalam hal perlindungan dalam konteks hak asasi manusia Berdasarkan hasil dari studi ini adalah adanya urgensi negara Indonesia dalam penggunaan tenaga kerja asing sebagai perwujudan pembangunan nasional melalui investasi serta ilmu pengetahuan sehingga pemerintah perlu memberikan perlindungan. Berangkat dari hal tersebut, penelitian ini dilakukan untuk menganalisa perlindungan hak asasi manusia bagi tenaga kerja asing berdasarkan perspektif hukum positif Indonesia.

Abstract

ABSTRAK   Tujuan studi ini untuk mengkaji mengenai kewenangan Majelis Desa Adat Provinsi Bali dalam mengeluarkan Keputusan Majelis Desa Adat Nomor: 01/Kep/Psm-3/Mdp Bali/X/2010 Terhadap Pewarisan Wanita Hindu Bali. Studi ini menggunakan penelitian hukum normatif sebagai metode penelitiannya, yakni mengkaji pengaturan melalui teknik kepustakaan serta data sekunder yang relevan dengan Kewenangan Lembaga Persatuan Masyarakat hukum adat. Penelitian ini juga dikaji melalui metode statute approach (pendekatan perundang-undangan) serta metode Institutional Approach (Pendekatan Kelembagaan). Berdasarkan hasil riset ini, diperoleh bahwasanya Majelis Desa Adat Provinsi Bali memang memiliki kewenangan dalam hal menerbitkan Keputusan Majelis Desa Adat Nomor: 01/Kep/Psm-3/Mdp Bali/X/2010 Terhadap Pewarisan Wanita Hindu Bali. Hal ini dapat dibuktikan melalui Peraturan Daerah Bali No 4 Tahun 2019 tentang Desa Adat. Keputusan Majelis Desa Adat (MDA) secara yuridis tidak tergolong sebagai bagian dari jenis peraturan perundang-undangan yang diatur secara formal dalam hierarki hukum nasional, namun keberadaannya tetap memperoleh pengakuan dalam sistem hukum Indonesia sebagai bagian dari sumber hukum tidak tertulis yang tumbuh dan berkembang di lingkungan masyarakat hukum adat. Keputusan tersebut merupakan bentuk pelaksanaan fungsi Majelis Desa Adat dalam menjaga, mengatur, dan mengembangkan adat istiadat serta kearifan lokal, khususnya yang berkaitan dengan hak waris perempuan Hindu Bali.   Kata Kunci: Hukum Adat Bali, Majelis Desa Adat, Kewenangan.   ABSTRACT   The purpose of this study is to examine the authority of the Bali Province Customary Village Council in issuing the Decree of the Customary Village Council Number: 01/Kep/Psm-3/Mdp Bali/X/2010 Regarding the Inheritance of Balinese Hindu Women. This study uses normative legal research as its research method, namely examining regulations through library techniques and secondary data relevant to the Authority of the Customary Law Community Association Institution. This research is also studied through the statute approach method and the Institutional Approach method. Based on the results of this research, it was found that the Bali Province Customary Village Council does have the authority to issue the Decree of the Customary Village Council Number: 01/Kep/Psm-3/Mdp Bali/X/2010 Regarding the Inheritance of Balinese Hindu Women. This can be proven through Bali Regional Regulation No. 4 of 2019 concerning Customary Villages. The decisions of the Traditional Village Council (MDA) are not legally classified as part of the types of legislation regulated formally in the national legal hierarchy, but their existence is still recognized in the Indonesian legal system as part of the unwritten legal sources that grow and develop within the customary law community. These decisions represent a form of implementation of the Traditional Village Council's function in maintaining, regulating, and developing local customs and wisdom, particularly those related to the inheritance rights of Balinese Hindu women.   Key Words: Balinese Customary Law, Majelis Desa Adat (Traditional Village Assembly), Authority.
