Abstract

ABSTRAK  Selama ini pengaturan kedudukan Kejaksaan tidak diatur secara tegas dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 hanya disebut secara eksplisit dalam Pasal 24 ayat (3) UUD NRI Tahun 1945 yang menyatakan, Badan-badan lain yang fungsinya berkaitan dengan kekuasaan kehakiman diatur dalan undang-undang. Pasal 2 ayat (1) Undang Undang Kejaksaan No. 16 Tahun 2004 tentang Kejaksaan menyebutkan bahwa Kejaksaan adalan lembaga pemerintah yang melaksanakan kekuasaan Negara dibidang penuntutan serta kewenangan lain yang berdasarkan undang-undang. Sehingga secara kelembagaan berada di bawah kekuasaan eksekutif namun dalam menjalankan tugas dan fungsinya   merupakan bagian dari kekuasaan yudikatif yang menjadikan ketidakjelasan kedudukan Kejaksaan dalam struktur ketatanegaraan Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi penelitian yang bersifat preskriptis analitis. Jenis data yang digunakan dalam penelitian ini adalah data sekunder, yaitu data yang diperoleh melalui bahan hukum primer, sekunder dan tersier. Simpulan yang diperoleh dari hasil penelitian ini adalah kedudukan Kejaksaan yang secara kelembagaan berada di bawah kekuasaan eksekutif dan secara kewenangan dalam melaksanakan tugas dan fungsinya termasuk bagian dari kekuasaan yudikatif menyebabkan Kejaksaan rawan terhadap intervensi kekuasaan lainnya dalam melaksanakan   tugas dan fungsinya sebagai pelaksana kekuasaan negara di bidang penuntutan. Serta untuk mewujudkan kekuasaan penuntutan yang independen maka perlu untuk melakukan reposisi kedudukan Kejaksaan Republik IndonesiaABSTRACT  So far, the regulation of the Public Prosecutor's Office is not expressly stipulated in the 1945 Constitution of the State of the Republic of Indonesia. It is only mentioned explicitly in Article 24 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia which states, "Other bodies whose functions relate to the judicial authority are regulated in legislation" Article 2 paragraph (1) of the Prosecutor's Law No. 16 of 2004 on the Prosecutor's Office. It states that the Attorney is a government institution that exercises state power in the field of prosecution and other authorities based on the law. So that institutionally, it is under the executive authority but in carrying out its duties and functions it is part of the judicial power that makes the ambiguity of the position of the Prosecutor in the structure of the state administration. This research used normative juridical method with analytic prescriptive research specification. The type of data used in this study is secondary data, data were secondary data which gained from primary, secondary and tertiary legal materials. The conclusion derived from the results of this study is the position of the Attorney which is institutionally under the authority of the executive. Further, its authority in carrying out its duties and functions includes part of the judicial power, it causes the Attorney is prone to other power intervention in carrying out its duties and functions as the executor of state power in the field of prosecution. To realize the power of independent prosecution, it is necessary to reposition the position of the Prosecutor of the Republic of Indonesia.

Abstract

The aim of this research is to examine the influence of ecological literacy and environmental awareness on the implementation of green economy policies in Grobogan Regency MSMEs. The research method used is quantitative research. The sampling technique is purposive sampling which has criteria for MSME business actors in Grobogan Regency who operate in the food and beverage sector. Data collection uses a questionnaire distributed directly to respondents. The research results simultaneously show that ecological literacy and environmental concern influence the implementation of Green Economy policies. Partially, ecological literacy and environmental concern influence the implementation of green economy policies in Grobogan Regency MSMEs.

Abstract

This study aims to examine in depth the phenomenon of increasing online gambling practices in Indonesia from the perspective of positive law and Islamic criminal law. The focus of the study is directed at the legal basis of prohibition, the similarity of principles, and the efforts of the two legal systems in tackling these crimes. This study uses a normative legal approach by analyzing various relevant legal provisions, especially Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) and its amendments, as well as the principles of Islamic criminal law related to jarimah ta'zir. The novelty of this study lies in its integrative normative analysis that reconstructs legal policy by harmonizing positive law and Islamic criminal law, thereby contributing theoretically to the development of legal policy studies on online gambling in Indonesia. The study's findings show that Article 27, paragraph (2), of the ITE Law serves as the legal basis for prohibiting and sanctioning the dissemination of content containing gambling elements through electronic media. On the other hand, Islamic law expressly prohibits any form of gambling because it is considered to bring more harm than benefit. It can be concluded that both positive law and Islamic law have a harmony of views in viewing online gambling as a destructive act and have the potential to hurt morality, social order, and the economy of society, so both emphasize the importance of prevention and enforcement of the practice.

Abstract

This research was conducted to examine the effect of Net Performing Loan (NPL) and Operational Costs on Operating Income (BOPO) on Return On Equity (ROE) in PT. Rakyat Indonesia Bank, for theperiod 2011-2018 period. The sampling technique in this study is 32 quarterly data obtained from the bank’spublished financial statements for the period 2011-2018. The analysis technique used is multiple regression analysis. Because the data used are secondary data, then to determine the accuracy of the model it is necessary to test some basic assumptions, linearregression analysis, hypothesis testing and coefficient of determination. Testing the basic assumptions usedin this study include the normality test, linearity test and homogeneity test. While the linear regressionanalysis includes multiple linear regression and classical assumption tests (multicollinearity, autocorrelationand heterokedastisitas) and hypothesis testing which includes t test and f test. The dependent variable in this study is ROE while the independent variables are NPL and BOPO. The results of tis study, among others, indicate that the R square is 0,519 or 51,9 %, the NPL and BOPOvariables have a partial effect on ROE as well as the NPL and BOPO variables also have a simultaneouseffect against ROE. Based on the results of the above research, it is suggested to be able to add knowledgeabout NPL and BOPO to the level of ROE so that it can be input into research that is in line with this.Keywords: NPL, BOPO dan ROE

Abstract

The rapid development of technology has brought humanity into a wave of modernization characterized by digitalization, leading to significant changes in all aspects of human life. The role of technology today offers various conveniences. The transformation of payment systems from cash-based to cashless transactions provides ease for customers and helps reduce the risk of crimes such as robbery, theft, and counterfeiting. One of the most widely used cashless payment methods that is frequently misused by irresponsible individuals for criminal purposes today is the credit card. The focus of this study is to examine the legal accountability of banking institutions in relation to a specific type of cybercrime, namely carding, which causes financial losses to customers. This research employs a normative juridical method. The findings indicate that the bank’s liability from a civil law perspective refers to Article 1338 paragraph (1) of the Indonesian Civil Code and Article 19 paragraph (1) of Law No. 8 of 1999 concerning Consumer Protection. Customer losses resulting from carding crimes are viewed as a consequence of inadequate protection by the issuing bank in maintaining network security. Errors or negligence by bank employees can be construed as the bank’s responsibility; however, if it can be proven that the carding crime did not occur due to the issuing bank’s negligence, then the bank is not obliged to compensate for the losses suffered by the customer.

Abstract

The Constitution of Republic of Indonesia 1945 has not explicitly regulated the requirements to become a member of House of Representatives. The requirements of prospective members of the House of Representatives as contained in Article 51 of Law Number 8 of 2012 has not fully impactedto the improvement of the legislative function of Parliament. In addition, another problems related to the main function of Parliament as a legislator is about how well the quality of act by Indonesian Parliament. Need a restructuring of internal and external factors relating to the poor performance of legislative function by the House of Representatives. So that the performance of legislative function by the House of Representatives can be implemented better in the future
