Abstract

The application of diversion in the juvenile criminal justice system aims to prevent children from undergoing formal legal proceedings that could negatively impact their development. This study analyzes the implementation of diversion in Decision Number 5/Pen.Div/2023/PN Kot Jo and Number 18/Pid.Sus-Anak/2023/PN Kot, involving a 15-year-old minor as the perpetrator of a minor offense. The study highlights the judge's considerations in determining diversion, including the child's age, the type of offense, and the offender's social background. Furthermore, this research examines how the principles of restorative justice are applied through diversion deliberations involving the offender, the victim, their families, and other relevant parties. The findings indicate that diversion in this case successfully reached a voluntary agreement, requiring the offender to return the item and compensate the victim. This agreement not only aims to prevent the negative impact of formal judicial proceedings but also provides an opportunity for the child to rehabilitate and reintegrate into society. These findings emphasize that when implemented effectively, diversion mechanisms can serve as an efficient solution for resolving juvenile delinquency cases without resorting to litigation.

Abstract

The development of technology and social media has significantly changed the way people communicate, including in searching for life partners. However, this advancement has also created opportunities for cybercrimes, one of which is love scamming, a form of extortion using romance as a pretext through online platforms. Law enforcement against perpetrators of this crime is more relevant when applied under Article 27B paragraph (1) in conjunction with Article 45 paragraph (8) and Article 29 in conjunction with Article 45B of Law Number 1 of 2024, which amends Law Number 11 of 2008 concerning Electronic Information and Transactions. Although the primary element of love scamming is extortion, many cases also involve threats, making it possible to apply multiple legal provisions under the Indonesian Penal Code and the Electronic Information and Transactions Law. Legal protection for victims is carried out through two approaches: preventive and repressive. Preventive protection involves raising public awareness through education and outreach regarding romance-based scams on social media, while repressive protection includes concrete actions by the government and private organizations to help victims obtain legal protection and restore their rights. Therefore, social media users must be more cautious when interacting online, be able to distinguish between real and fake accounts, and avoid trusting strangers too easily to prevent becoming victims of love scamming.

Abstract

In the era of digital technology disruption 4.0, forcing people in the world, especially in Indonesia to use digital technology in almost all daily activities, especially the arrival of the Covid 19 pandemic accelerated the development of digital technology and forced almost all people to use it. This includes the revolutionary financial sector using digital technology as a means for interaction between debtors and creditors as well as investors in carrying out financial activities. The rapid pace of technological development, especially in the financial sector, should be balanced with the development of laws and regulations governing digital economic activities so that in the implementation of digital economic activities, especially in the financial sector, the Indonesian people are protected by legal rules to ensure the implementation of digital technology activities in accordance with the principle of justice.

Abstract

Kendaraan sudah menjadi kebutuhan mendasar bagi masyarakat untuk menunjang mobilitas dalam kehidupan sehari-hari, selain menggunakan fasilitas umum masyarakat banyak yang memilih untuk memeiliki sendiri kendaraan karena dirasa lebih leluasa dalam beraktifitas. Untuk mendapatkan kendaraan dipermudah dengan layanan pembiayaan atau kredit kendaraan bermotor yang disediakan oleh Lembaga penyedia layanan keuangan (leasing). Banyaknya kemudahan yang diberikan oleh penyedia layanan keuangan dalam pemberian kredit membuat mayoritas masyarakat menggunakan fasilitas kredit dalam pemenuhan kebutuhan transportasi. Ketika terjadi pandemi covid19 terjadi semua sektor menjadi terganggu termasuk sektor ekonomi sehingga berdampak sangat signifikan terhadap kemampuan ekonomi masyarakat pada khususnya masyarakat yang mendapat fasilitas kredit kendaraan dari Lembaga pembiayaan (leasing). Debitor kesulitan untuk memenuhi kewajibanya terhadap kreditor karena kemampuan ekonomi keluarga turut berdampak. Dalam keadaan tidak biasa seperti ini pemerintah melalui regulator mengambil keputusan untuk memberlakukan relaksasi kredit untuk sebagai Langkah untuk menunjang keberlangsungan kegiatan perekonomian ditengah pandemic covid 19.

Abstract

Digitalisasi adalah sebuah fenomena yang terus berkembang dan tidak dapat dihindari baik oleh masyarakat maupun oleh Lembaga seperti perbankan, dalam perkembangan digitalisasi diperlukan upaya untuk menjaga keseimbangan antara kemudahan akses dengan keamanan sehingga dalam perkembanganya kemajuan teknologi digital dapat menekan angka pepelanggaran  yang dilakukan secara digital dengan cara meberikan regulasi yang jelas untuk menyelenggarakan sebuah kegiataan secara digital dan memiliki dasar hukum yang jelas.

Abstract

Peralihan kewenangan pengawasan koperasi simpan pinjam ke Otoritas Jasa Keuangan (OJK) merupakan konsekuensi dari reformasi regulasi sektor keuangan melalui Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan. Kebijakan ini dimaksudkan untuk memperkuat tata kelola, meningkatkan perlindungan anggota, serta menjaga stabilitas sektor jasa keuangan. Penelitian ini bertujuan menganalisis dampak peralihan kewenangan pengawasan koperasi di bawah OJK terhadap pertumbuhan usaha koperasi simpan pinjam. Metode penelitian yang digunakan adalah yuridis-empiris dengan pendekatan deskriptif-analitis. Data diperoleh dari regulasi terkait, laporan resmi OJK, publikasi Kementerian Koperasi dan UKM, serta literatur ilmiah sepuluh tahun terakhir. Hasil penelitian menunjukkan bahwa pengawasan oleh OJK berdampak positif terhadap peningkatan tata kelola, transparansi, dan kepercayaan anggota yang berimplikasi pada pertumbuhan aset dan keberlanjutan usaha koperasi simpan pinjam. Namun demikian, peningkatan standar kepatuhan dan biaya penyesuaian regulasi menjadi tantangan bagi koperasi simpan pinjam skala kecil. Penelitian ini menyimpulkan bahwa peralihan kewenangan pengawasan ke OJK berdampak signifikan terhadap pertumbuhan usaha koperasi simpan pinjam, dengan efektivitas yang sangat bergantung pada pendekatan pengawasan berbasis risiko dan kebijakan transisi yang proporsional.

Abstract

The development of digital technology has had a significant impact on both global and national financial systems. The emergence of technology-based financial service institutions (financial technology or fintech) such as peer-to-peer lending, digital banking, and electronic payment systems has accelerated financial inclusion among the public. However, this phenomenon has also introduced new legal risks, including the misuse of personal data, illegal lending practices, and weak consumer protection. As an independent institution, the Financial Services Authority (Otoritas Jasa Keuangan/OJK) has an urgent need to strengthen its supervisory and regulatory roles in the digital financial sector to ensure that it operates in a fair, transparent, and accountable manner. This research employs a normative legal method with statutory (statute approach) and conceptual (conceptual approach) perspectives. The findings indicate that the OJK holds a high degree of urgency in responding to the digital transformation of the financial sector. Strengthening technology-based regulations, fostering inter-agency synergy (OJK–Bank Indonesia–Ministry of Communication and Information Technology), and enhancing digital financial literacy constitute the main pillars that must be reinforced to maintain the stability and fairness of the national financial system.

Abstract

The rapid development of technology has brought humanity into a wave of modernization characterized by digitalization, leading to significant changes in all aspects of human life. The role of technology today offers various conveniences. The transformation of payment systems from cash-based to cashless transactions provides ease for customers and helps reduce the risk of crimes such as robbery, theft, and counterfeiting. One of the most widely used cashless payment methods that is frequently misused by irresponsible individuals for criminal purposes today is the credit card. The focus of this study is to examine the legal accountability of banking institutions in relation to a specific type of cybercrime, namely carding, which causes financial losses to customers. This research employs a normative juridical method. The findings indicate that the bank’s liability from a civil law perspective refers to Article 1338 paragraph (1) of the Indonesian Civil Code and Article 19 paragraph (1) of Law No. 8 of 1999 concerning Consumer Protection. Customer losses resulting from carding crimes are viewed as a consequence of inadequate protection by the issuing bank in maintaining network security. Errors or negligence by bank employees can be construed as the bank’s responsibility; however, if it can be proven that the carding crime did not occur due to the issuing bank’s negligence, then the bank is not obliged to compensate for the losses suffered by the customer.
