Abstract

Penelitian ini mengkaji tentang konsep dan pelaksanaan tugas Notaris secara elektronik (electronic Notary) yang belum diatur dalam Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris sehingga terjadi kekosongan Norma saat notaris menggunakan konsep tersebut. Penelitian ini bertujuan untuk menganalisa kekuatan mengikat dari akta yang dibuat dalam konsep Notaris secara elektronik (electronic Notary) di Indonesia. Jenis penelitian ini adalah penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa pada dasarnya akta yang dibuat secara sah dengan adanya kesepakatan para pihak didalamnya dan sesuai dengan syarat sah perjanjian dalam pasal 1320 KUHPerdata maka akan mengikat para pihak. Baik itu dibuat secara elektronik maupun secara konvensional. Namun, karena belum adanya aturan yang jelas terkait dengan konsep ini, maka masih dipertanyakan mengenai kekuatan mengikat dari akta yang dibuat secara elektronik ini

Abstract

Limited Liability Company is the most popular form of business. To run a Limited Liability Company, a clear line of business is needed. The list of business fields in the company is now based on the standard classification of Indonesian business fields or KBLI 2020, because companies that previously used the 2015 KBLI had to adjust the Articles of Association first and the articles of association were notified to the Minister of Law and Human Rights through a notary using the AHU Online application. AHU Online is an electronic-based legal service organized by the Directorate General of General Legal Administration and has been integrated with the Online Single Submission or OSS which is an electronic licensing service. However, it turns out that there are business fields that have been registered with online AHU that are not integrated with OSS. This type of research is empirical juridical, with a legal approach (sculpture approach), and a conceptual approach (conceptual approach). The legal materials used in this study consist of primary, secondary, and tertiary legal materials. The location of this research is in the city of Banda Aceh. The results of the study indicate that the legal consequences of a business field that is not integrated with OSS is that the business field cannot be run, because it cannot obtain a business license, so the company cannot run a business, which fulfills the absolute requirements that must be met to carry out business activities

Abstract

Abstrak – Penelitian bertujuan untuk menjelaskan, dan menganalisis bentuk dan isi perjajian jual beli online, faktor-faktor penyebab terjadinya kesalahan penyerahan barang, serta tanggung jawab penjual dalam kesalahan penyerahan barang. Hasil penelitian diketahui bahwa dalam perjanjian jual beli online Mr.Q Clothing dan Banda Fashion bentuk perjanjian yang digunakan yaitu lisan dengan isi perjanjian berupa penjual harus mengirim barang sesuai permintaan dan alamat yang tertera yang pada kenyataannya penjual melakukan kesalahan dalam penyerahan barang terhadap konsumen, faktor penyebab terjadinya kesalahan tersebut yaitu kesalahan manusia (Human Error) yang mana pihak penjual tidak memperhatikan secara seksama sehingga penjual dinyatakan lalai dalam melaksanakan kewajibannya, dan tanggung jawab yang dilakukan oleh pihak penjual yaitu memberikan ganti kerugian sebagaimana tertera dalam Pasal 4 ayat (8) Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen yaitu konsumen berhak mendapat penggantian barang sesuai dengan yang di pesan, serta menanggung biaya pengiriman. Disarankan kepada para pihak di masa yang akan datang apabila melaksanakan perjanjian jual beli online penjual melakukan perjanjian secara tertulis, memaksimalkan dalam kesiapan perangkat, konsumen menggunakan haknya dalam melakukan pengaduan kepada pihak berwenang apabila terjadi kesalahan, dan diharapkan kepada instansi terkait untuk dapat memberikan edukasi mengenai fungsi dari instansi tersebut. Kata Kunci: Tanggung Jawab, Penjual, Konsumen, Kesalahan Penyerahan Barang, Jual Beli.

Abstract

This research aims to explore the concept of protection on micro, small and medium based on economic justice approach of John Rawls and constitutional protection of such enterprises. It is explored through John Rawls justice and the wealth management. This is descriptive qualitative research. The research applies juridical normative. The data are then analysed through qualitatively. The protection on the businesses is not implemented well. The Act on the Small and Medium Enterprise and the Qanun No. 10, 2004 is not effective in its efforts to realize the opportunity of the enterprises. Abstract

Indonesia’s anti-corruption enforcement remains predominantly conviction-oriented, and the recovery of state financial losses has not been maximized. Article 4 of the Anti-Corruption Law requires prosecution to continue even after full restitution has been made, which limits prosecutorial flexibility and often results in enforcement costs that exceed the value of the losses in low-value corruption cases. This study examines the feasibility of applying Deferred Prosecution Agreements (DPA) to individual corruption offenders in Indonesia. Using normative juridical research with statutory and comparative approaches, the study analyzes Indonesian legal provisions alongside DPA practices in the United Kingdom and the United States. The findings reveal that Indonesia’s current legal framework lacks a mechanism for the conditional termination of prosecution following restitution, although the prosecutorial role as dominus litis offers an institutional basis for such reform. Comparative analysis shows that a DPA combines restitution, cooperation, judicial oversight, and prosecutorial discretion within a structured legal mechanism. Consequently, this study proposes a normative-operational DPA model for individual offenders involving state financial losses below IDR 200,000,000, subject to full restitution, administrative sanctions, judicial approval, and compliance monitoring. Ultimately, this study contributes a legally feasible framework for reorienting anti-corruption prosecution away from incarceration-centered punishment toward more efficient and accountable state asset recovery.

Abstract

Article 18 paragraph (1) of Law No. 4/1996 states that Mortgage Rights are extinguished due to debt repayment, relinquishment by the holder, court order, or extinguishment of land rights. In Batam City, there is a case of a Building Rights Title (SHGB) being used as collateral, but its validity period has expired, and the debtor has not fulfilled their obligations. This research aims to analyze the status and position of Mortgage Rights on an object with an expired Building Rights Title under Indonesian Positive Law, the legal consequences for the holder of the Mortgage Rights on an expired Building Rights Title, and the legal protection for the creditor when the Building Rights Title, as the object of the mortgage, is not extended or renewed. This is normative legal research using the statutory and case approach methods. Data is obtained through literature studies, interviews, and documentation, analyzed using qualitative methods. Mortgage rights are considered extinguished unless the creditor or debtor extends them through a Deed of Mortgage (APHT). The expiration of Mortgage Rights results in the land becoming state property unless it is extended by the debtor or creditor. The expiration of Mortgage Rights does not erase the debtor’s debt, but the creditor's position changes from preferred to concurrent, meaning the creditor no longer has priority in repayment. Creditor protection can be achieved through negotiation for an extension or renewal of the SHGB. If this fails, the bank can sell the mortgage underhand, auction the mortgage, file for bankruptcy, or file a lawsuit. It is recommended that further regulation in the Mortgage Rights Law (UUHT) be established regarding the expiration of Building Rights Titles encumbered with Mortgage Rights.
