Abstract

This research was conducted to outline the opportunities and challenges of resolving fintech business disputes through the Alternative Dispute Resolution Institute (LAPS) in Indonesia. The research method used in this research is a legal reasearch approach and qualitative approach that is to review primary and secondary data sources related to regulations on business dispute resolution in Indonesia. The results show that fintech plays a role in encouraging the economic development of the community, especially as an alternative to financing. LAPS serves as a solution to dispute resolution of business people in Indonesia this institution was chosen because it is more effective and efficient, the verdict is final and binding that is contrary to litigation lines that seem time-consuming and expensive costs. LAPS opportunities are very large for the rise of digital-based businesses and payments that still leave many legal problems while LAPS khsusus fintech is not yet available where LAPS provides services that are in line with digital business; the settlement is a win-win solution, which is in accordance with the character of the business world, which is obliged to manage risks, including reputational risk, operational risk and legal risk. While the challenges faced by LAPS in fintech include: Dualism alternative fintech dispute resolution can be through LAPS and can also through the Consumer Dispute Resolution Agency (BPSK); Limited Legal Infrastructure The number of fintech transactions that continue to increase in line with the potential for disputes that will occur; Availability of Mediators and Arbitrators of LAPS Financial Services Sector.

Abstract

Penelitian ini dilakukan untuk mengelaborasi ajaran Islam kulutral dan pengaruhnya dalam membentuk corak politik hukum Islam di Indonesia serta menentukan arah kebijakan politik hukum Islam di Indonesia dihubungkan dengan diberlakukannya Peraturan Perundang-undangan tentang Koperasi Syariah. Penelitian yang dilakukan merupakan penelitian deskriptif analitis dengan pendekatan yuridis normatif. Data diperoleh dari penelitian kepustakaan (library research) selanjutnya dianalisis secara kualitatif dan disimpulkan bahwa ajaran Islam kulutral mempunyai pengaruh yang sangat besar dalam memberi bentuk corak politik hukum Islam di Indonesia yang bersifat heterogen akan tetapi ajaran Islam kultural tidak terlihat begitu kental dalam Undang-Undang Koperasi, justru nilai-nilai Islam diterapkan dalam peraturan-peraturan yang sifatnya lebih rendah dan teknis, yakni peraturan menteri dan fatwa Dewan Syariah Nasional-MUI.

Abstract

Wadiah is a type of savings that is purely a depositor/customer, which must be maintained and returned at any time in accordance with mutual agreement or in accordance with the depositor/customer wishes. This wadiah contract savings is adjusted to the Presfective of DSN MUI Fatwa No.02 / DSN-MUI / IV / 2000 concerning wadiah savings. Therefore, this study aims to determine the application of the wadiah contract, the conformity of the DSN MUI Fatwa Presfective No.02 / DSN-MUI / IV / 2000, and find out the efforts made by the Sharia Pojok Cooperative to comply with the Fatwa Prefectives of the National Sharia Council of the Indonesian Ulema Council. The research method used is to use a qualitative descriptive approach. Data collection obtained through observations to the Sharia Pojok Cooperative an also interviews with informants and literature studies to be able to describe the implementation of the wadiah contract. The results of this study are known that the implementation of the wadiah agreement in the Sharia Pojok Cooperative has one discrepancy with the Prefectives of the Fatwa of the National Sharia Council of the Indonesian Ulema Council No.02 / DSN-MUI / IV / 2000 concerning Savings, namely the Sharia Pojok Cooperative hinting at the bonus at the beginning of the contract of 4%.

Abstract

Design/methodology/approach-This research is an analytical descriptive research with normative juridical approach. The data were obtained from library research and field research through in-depth interviews with related parties including the management of the Micro Waqf Bank Islamic Microfinance Institution Ranah Indah Darussalam Ciamis West Java Indonesia and Commissioner of the Financial Services Authority of Indonesia then analyzed qualitatively. This research was conducted in Ciamis and Bandung West Java Indonesia. Finding- The finding of this study has confirmed that Sharia economic disputes are the absolute competencies of the Religious Courts based on Article 49 of Law Number 3 of 2006 concerning Amendments to Law Number 7 of 1989 concerning Religious Courts including disputes on BWM financing. In disputes that occur in troubled financing BWM the stages of completion are by intensive collection (cash collateral), rescheduling, reconditioning, or restructuring or also known as the stages of fulfillment of performance and deliberation and mediation between BWM management and customers involving other customers both in the scope “umpi” and cluster to be dealt joint responsibility among customers so that the settlement of disputes through litigation in religious courts does not need to be taken by the parties. Abstract

Tujuan pengabdian kepada masyarakat ini dilakukan untuk menguatkan literasi masyarakat mengenai fikih kurban dalam mendukung sosialisasi halal food sebagai bagian dari ekosistem halal di Jawa Barat. Metode yang digunakan adalah seminar nasional yang dilakukan secara hybrid, yakni onsite di Gedung Dewan masjid Indonesia Jawa Barat dan secara online melalui streaming youtube, zoom meeting maupun facebook. Hasil dari kegiatan ini adalah bahwa masyarakat sangat membutuhkan sosialisasi lebih mendalam serta peningkatan literasi yang lebih serius dikarenakan tingat pemahaman masyarakat tentang  ekonomi halal khususnya mengenai kurban dari mulai sejarah, filososfi, manajeman hingga fikihnya masih belum teredukasi dengan baik.

Abstract

Pada dasarnya pembiayaan Mudharabah dirancang sebagai suatu sistem bagi hasil dan prinsip operasional Lembaga Keuangan Syari’ah, namun pada praktiknya penyaluran pembiayaan Mudharabah masih rendah. Hal ini terjadi pada BMT yang menyalurkan pembiayaan Mudharabah hanya 2% sehingga pembiayaan Mudharabah menjadi pembiayaan yang paling rendah penyalurannya dibandingkan dengan pembiayaan yang lain. Penelitian ini dilakukan untuk mendeskripsikan faktor-faktor rendahnya penyaluran pembiayaan Mudharabah pada BMT. Hasil penelitian ini menunjukan terdapat dua faktor yang memengaruhi rendahnya penyaluran pembiayaan Mudharabah pada BMT yaitu faktor internal dan faktor eksternal. Dari ke dua faktor tersebut peneliti menyimpulkan bahwa satu faktor utama yang memengaruhi rendahnya penyaluran pembiayaan Mudharabah ialah faktor internal yaitu karena kualitas sumber daya manusia sebagai pelaku pembiayaan Mudharabah.

Abstract

Tujuan penelitian ini dilakukan adalah untuk mengeksplorasi hukum pembiayaan asset tanah wakaf produktif melalui platform financial technology dilihat dari perpspektif tafsir hukum ekonomi syariah. Penelitian ini merupakan penelitian kepustakaan (library research) dengan menggunakan pendekatan deskriptif-analitis dimana peneliti mengumpulkan data-data sekunder yang bersumber dari beberapa kitab tafsir, norma hukum positif khususnya Undang-Undang Wakaf, Peraturan Pemerintah tentang Wakaf, Buku ke III Kompilasi Hukum Islam, buku referensi terkait wakaf, dan beberapa jurnal serta hasil penelitian lain yang dipublikasikan yang kemudian dianalisis secara deskriptif untuk menjawab pertanyaan penelitian. Secara umum ayat al-Quran dan Hadits yang berkaitan dengan wakaf hanya memberikan gambaran tentang motivasi atau keutamaan berwakaf dan anjuran mengenai tentang produktifitas wakaf. Jumhur ulama sepakat bahwa wakaf hukumnya adalah sunnah muakkadah. Terkait pemanfaatan technology financial dalam pembiayaan asset wakaf produktif hukumnya diperbolehkan sebagaimana keumuman kaidah tentang asal muamalah adalah boleh yaitu “Al-Ashlu Fii al-Mu’amalati Al-Ibahatu Illa An Yadhulla Addalilu ‘Alaa Tahriimihaa” artinya asal mula setiap muamalah adalah boleh hingga ada dalil yang mengharamkannya.

Abstract

This study was conducted to elaborate further on the restructuring policy carried out by the management of Baitul Maal Wattamwil (BMT) for financing customers who experience Non Performing Financing (NPF) problems due to the impact of Covid 19 Viewed from the Perspective of Maqashidussyariah. This study is a library research using a qualitative descriptive method, where researchers describe data on the impact of Covid 19 on the financing problems of BMT customers which are responded to with a restructuring policy linked to maqashidussyariah. The results of this study state that the restructuring policy is a primary need (dharuriyyah) which can be categorized as an effort to maintain the assets (Hifdzh Al-Maal) of depositors and maintain the honor (Hifdzh Al-‘Irdh) of financing customers. It can be concluded that this is very closely related to the professionalism of the manager and by maintaining the principle of caution and entering the category of maintaining the honor (Hifdzh 'Irdh) of financing customers because the honor of a believer is an obligation for other Muslims.

Abstract

The goal of this research is to describe and analyze the Western world's response to the development of the Islamic economy, which is examined from the standpoints of idiologic, academic and pragmatic between opportunities and challenges in era 4.0.. The method used in this study is a qualitative approach in which researchers try to find and find qualitative secondary data sourced from books, scientific journals, research results, and articles published both online and in print to then be analyzed normatively (descriptive qualitative). The findings of this study show that, in the eyes of fundamentalist political or ideological, the western response to the development of the Islamic economy is viewed as a political opponent to the continuation of wars and hostilities with Islamophobic weapons bearing the stamps of terrorism, radicalism, backwardness, and other negative attributes. According to moderate thinkers in academic perspective, Islamic economics is a test to see who can solve problems related to welfare, civilization, and other global issues. From a business standpoint or the pragmatic side, the Islamic economy is regarded as a great opportunity because the development of the Muslim population and world sympathy, which is increasingly oriented to the Islamic economy, which is regarded as more fair, profitable, carries minimal risk, and contains benefits, is a necessity, so they are forced to follow the mainstream of the world community to play in the system to take advantage, which, of course, must be suspected that religious interests remain the primary concern.

Abstract

The goal of this study is to describe the application of the Al-Kharaj Bidhdhaman rule, which specifies who bears the risk and who is entitled to a well-known benefit in sharia business contracts, particularly when applied in syndicated financing carried out by financial institutions as viewed through the lens of sharia economic law. This is a library study that employs qualitative descriptive research methods. Secondary data from books, journals, and other research results are used by researchers to describe the rules in sharia business contracts, also known as legal maxims, and theories about syndicated financing in financial institutions such as banks, which are then normatively analyzed in accordance with laws and regulations. According to the study's findings, the al-Kharaj Bidhdhaman Rule is also a very important rule in syndicated financing-based business activities at Islamic Banks, which is implemented in the agreed clauses in the contract used by customers, bank leaders, and participants of sharia syndicated financing, where the profits obtained by the parties are adjusted to the value of the syndicated participants' capital and the value of the syndicated participants' capital In mudharabah and musharakah-based contracts, the same value is applied for responsibility for the emergence of risks, including losses, which are, of course, excluded if they occur due to force majeure.
