Abstract

Revitalisasi ideologi dalam perspektif Islam, baik pada tingkat nasional maupun global selalu bermuara pada aspirasi dan tuntutan untuk mengimplementasikan syari’at atau hukum Islam secara total (kaffah). Dalam Negara hukum Indonesia, aspirasi dan tuntutan semacam itu tidak selalu bisa dipenuhi. Hal ini karena Negara hukum Indonesia, sejak awal dibangun atas dasar semangat kebangsaan yang didasarkan atas prinsip ketuhanan, kemanusiaan, keadilan, dan kesetaraan atau persamaan bagi setiap warga Negara didepan hukum. Oleh karena itu aspirasi dan tuntutan penerapan syariat Islam selalu mengalami kendala bila didalamnya terdapat unsur diskriminatif atau unsur lain yang dapat menghilangkan jaminan dan perlindungan terhadap hak asasi warga negara yang sudah dijamin oleh konstitusi. Paper ini akan menjelaskan tentang pengertian dan karakter syariat, tujuan syariat, model-model penerapan syariat di sejumlah Negara Muslim, model atau teori penerapan syariat Islam di Indonesia menurut sejumlah pakar, pilihahan atau alternative yang bisa digunakan untuk memperjuangkan aspirasi dan tuntutan implementasi syariat Islam di Indonesia dan ditutup dengan simpulan. Revitalization of ideology in Islamic perspective, both at national and global level always leads to aspirations and demands to implement sharia or Islamic law in total (kaffah). Within the legal State of Indonesia, such aspirations and demands can not always be met. This is because the Indonesian state of law, from the beginning built on the spirit of nationality based on the principle of divinity, humanity, justice, and equality or equality for every citizen in front of the law. Therefore, the aspirations and demands of the application of Islamic Shari’a always experience constraints if in it there are discriminative elements or other elements that can eliminate the guarantee and protection of citizens’ rights that have been guaranteed by the constitution. This paper will explain the understanding and character of the Shari’a, the purpose of Shari’a, models of Shari’a application in some Muslim countries, the model or theory of application of Islamic Shariah in Indonesia according to some experts, alternatives or alternatives that can be used to fight for aspirations and demands of the implementation of Islamic Shariah Indonesia and concluded.

Abstract

Abstract In the hands of some Muslims who make religion an ideology, sharia must be realized in real life in society through political instruments that can provide force. However, in their struggle, some of them use only one interpretation and one model, so it is difficult to be compromised. Base on assumption that there is more than one model, this research aims to formulate :1) some models of transformation of Islamic law into national law, 2) the problems 3) alternative concepts of solutions, and 4) the impact of any policy taken by the state. This research is a kind of non-doctrinal qualitative legal research. Data was obtained from the books or literature and it is analyzed to see the correlation between legal substance, legal structure and legal culture. This study concluded that without being Islamic state, there many models that can be used by Indonesian Muslims in transforming or practicing sharia.   Keywords: Islamic state, politics, religion, secular state

Abstract

The goal of this research is to describe and analyze the Western world's response to the development of the Islamic economy, which is examined from the standpoints of idiologic, academic and pragmatic between opportunities and challenges in era 4.0.. The method used in this study is a qualitative approach in which researchers try to find and find qualitative secondary data sourced from books, scientific journals, research results, and articles published both online and in print to then be analyzed normatively (descriptive qualitative). The findings of this study show that, in the eyes of fundamentalist political or ideological, the western response to the development of the Islamic economy is viewed as a political opponent to the continuation of wars and hostilities with Islamophobic weapons bearing the stamps of terrorism, radicalism, backwardness, and other negative attributes. According to moderate thinkers in academic perspective, Islamic economics is a test to see who can solve problems related to welfare, civilization, and other global issues. From a business standpoint or the pragmatic side, the Islamic economy is regarded as a great opportunity because the development of the Muslim population and world sympathy, which is increasingly oriented to the Islamic economy, which is regarded as more fair, profitable, carries minimal risk, and contains benefits, is a necessity, so they are forced to follow the mainstream of the world community to play in the system to take advantage, which, of course, must be suspected that religious interests remain the primary concern.

Abstract

This library research focuses on books and literature as primary sources. It provides an overview of Indonesia's economic development from the perspective of sharia economic law philosophy and its application in DSN-MUI fatwas. Islamic economic philosophy is rooted in the Qur'an and Sunnah, which also guide DSN-MUI in formulating fatwas addressing economic issues. DSN-MUI plays a strategic role in developing sharia economic law to meet society's need for legal fatwas on economic activities, particularly in response to evolving product innovations.

Abstract

Introduction to The Problem: Islamic cooperatives have an important role in the national economy, especially for business actors in the Micro, Small and Medium Enterprises sector. However, currently the function and role of this financial institution cannot run optimally because it is faced with problems originating from internal and external Islamic cooperatives. This is allegedly contrary to the theory of truth in Islamic philosophy.Purpose/Objective Study: This research aims to examine and analyse the role and function of Islamic cooperatives in terms of the theory of truth in Islamic philosophy.Design/Methodology/Approach: This research is a type of qualitative research in the form of library research which is qualitative in nature.Findings: Islamic cooperatives have a strategic role in supporting the development of MSMEs, with approaches that are aligned with theories of truth, such as correspondence theory that emphasises conformity with reality, coherence theory that prioritises consistency in value systems, pragmatism theory that focuses on practical benefits, and performative theory that assesses the effectiveness of actions in achieving goals. The low level of Islamic financial literacy among MSME players, which often hinders their understanding of the benefits of Islamic financing. In addition, intense business competition in the market is also a significant obstacle that requires a special strategy. By overcoming these obstacles, Islamic cooperatives can further strengthen their function as a key pillar in supporting the sustainable growth of MSMEs.Paper Type: Research Article

Abstract

Indonesia is a pluralistic nation when seen from diverse ethnic, cultural, linguistic, ethnic and religious diversity as a result of it is likely to have a positive impact or negative. Pluralism in Islamic thought caused by the many schools of theology, jurisprudence flow or Islamic law, schools of philosophy, mysticism or the mysticism and political currents. In this paper, the authors focus on explaining some of the factors that hinder the development of pluralism in Indonesia, which is associated with the concept of the protection of religion, the concept of ‘amar ma‘ruf nahyi munkar, the concept nasakh-mansukh, other threats to diversity is the rise of authoritarianism in the interpretation of religion, lack of enforcement law from law enforcement officials in Indonesia, and the weakness of education and understanding among Muslims toward religion.

Abstract

This paper examines the women’s right to divorce under Moroccan Islamic family law. This article relies on a statutory approach, accompanied by interviews. Most of the data were taken from Moroccan regulations on marriage. The data were also collected from books and journals on women and divorce in Moroccan Law. Additionally, interviews are conducted to enrich information. The result of this study shows that Morocco recognizes the right of woman to divorce (her husband) in two terms: tatliq li al-syiqaq and khulu'. Of these two rights, Moroccan women share an equal position with men in the chance to end marital ties. Following the divorce, Moroccan family law stipulates that joint property belongs to the wife, except for immovable assets in the husband's name. Due to this provision, Moroccan women's bargaining position is arguably strong, because they have the legal ‘power’ to negotiate whether the marriage should be continued or ended. This should encourage husbands to behave carefully of their wives during the marriage. Theoretically, Moroccan family law can be said progressive in terms of protecting the rights of women (and their child/s). Tulisan ini mengkaji hak bercerai bagi perempuan dalam undang-undang keluarga yang diterapkan di negara muslim Maroko. Artikel ini ditulis dengan pendekatan perundang-undangan (statue approach) yang dilengkapi dengan wawancara. Data dikumpulkan dari peraturan-peraturan perkawinan di Maroko. Data juga didapatkan dari buku-buku dan jurnal yang membahas hak perempuan untuk bercerai. Di samping itu, data juga diperkaya melalui wawancara. Hasil penelitian ini menunjukkan bahwa Maroko mengakui hak perempuan untuk menceraikan (suaminya) dengan dua jalan, yaitu: tatliq li al-syiqaq dan khulu’. Dari kedua hak menceraikan ini, perempuan Maroko mempunyai kedudukan yang cukup imbang dengan laki-laki dalam kemampuan memutuskan ikatan perkawinan. Pasca perceraian, hukum keluarga Maroko menetapkan harta bersama jatuh kepada istri, kecuali harta tidak bergerak yang atas nama suami. Dengan ketentuan ini, posisi tawar perempuan Maroko dapat dikatakan cukup kuat karena mereka memiliki modal negosiasi apakah pernikahan dilanjutkan atau tidak. Ini menjadi isyarat bagi para suami untuk berprilaku hati-hati kepada istrinya dalam berumah tangga. Secara teoretis, hukum keluarga Maroko dapat disebut progresif dalam memberikan perlindungan kepada hak-hak perempuan, termasuk hak-hak anak-anak.

Abstract

Permasalahannya bagaimana penyelesaian sengketa hak bagi perempuan pasca perceraian melalui jalur peradilan, tentu ada pro dan kontra. Sudut pandang yang dikaji adalah KHI (Kumpulan Hukum Islam) Pasal 105 dan 156 serta UU No 1 Tahun 1974 yang mengalami perubahan menjadi UU no 16 tahun 2019 dan UU No 23 Tahun 2002 tentang hak Perempuan dan Anak dengan mengalisa pada Laporan putusan gugatan perceraian per januari tahun 2023 oleh Pengadilan Agama Garut. Metode analisis yang digunakan adalah Empiris dengan pendekatan Kulitatif. Sumber primer dan sekunder juga Observasi digunakan setiap saat. Kesimpulannya, Implementasi dari putusan Pengadilan tidaklah semua terlaksana secara efektif dan sesuai harapan, hal ini dikarenakan tingkat kemampuan ekonomi suami yang tidak menentu bahkan didominasi dari ketidakhadiran dalam menyelesaikan masalah.,sehingga misalnya hakim memutus dengan sesuai permintaan istri dan suami tidak mampu atau tidak hadir maka konsekuensinya akan sama saja,yakni tidak akan terealisasi. Dari penelitian yang diketahui 78% sudah melaksanakan putusan yang telah ditetapkan oleh Pengadilan dengan hasil Putusan Verstek ,namun ada sebagian yang tidak melaksanakan sesuai dengan ketetapan Pengadilan, dikarenakan faktor ekonomi dan ditambah keadaan sekarang pasca pandemi. Dan salah satu putusan perkara dengan Nomor. 5034/Pdt.G/2022/PA.Grt dengan hasil putusan pertimbangan hakim yaitu dikabulkan sebagian dan Hak Asuh salah satu anak berada pada Penggugat namun untuk Harta bersama masih dalam putusan sementara atau dalam peninjauan.

Abstract

Tujuan penulisan artikel ini adalah untuk mendapatkan titik temu antara filsafat ekonomi syariah dan ekonomi Pancasila. Dari titik temu ini kita dapat simpulkan bahwa ekonomi syariah dan ekonomi Pancasila dapat bersama-sama berkolaborasi memajukan perekonomian Indonesia. Artikel ini menggunakan metode penelitian deskriptif analisis, yaitu dengan menggambarkan pengertian ekonomi Pancasila dan ekonomi syariah, prinsip-prinsip dan dasar-dasar masing-masing cara berekonomi dan tujuan masing-masing ekonomi. Dari hal-hal yang disebutkan penulis menyimpulkan titik temu antara dua sistem ekonomi. Sedangkan jenis penelitian artikel ini adalah penelitian kualitatif dengan merujuk kepada referensi sistem perekonominan syariah dan sistem perekonomian Pancasila. Hasil dari penelitian ini adalah bahwa tujuan masing-masing ekonomi adalah sama, yaitu menggapai maslahah bagi seluruh rakyat Indonesia dengan memperhatikan ahalak dan moral dalam melakukan kegiatan ekonomi.
