Abstract

The perpetrators of criminal acts today are not only dominated by adults, but children also have a great potential to commit criminal acts, even children who are abnormal or mentally retarded can commit crimes as known in the Rantauprapat District Court Decision Number: 18/Pid.Sus-Child. /2016/PN-Rap. This research was conducted normatively by discussing doctrines or principles as well as legal synchronization using the approach to legislation. This means that the principles and synchronization of law are used as benchmarks to provide an assessment of the judge's considerations on the sentencing of children with mental retardation in the Rantauprapat District Court Decision Number: 18/Pid.Sus-Anak/2016/PN-Rap. In Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, it is very possible to apply non-penal policies through diversionary restorative justice instruments but this is not done, the judge's policy in providing legal protection to children with mental retardation is carried out through penal policies in the form of criminal imprisonment for 2 (two) years and 7 (seven) months and a fine of Rp. 100,000,000, - (one hundred million rupiah), provided that if the fine is not paid, it will be replaced with work training for 3 (three) months.

Abstract

The use of Narcotics, Psychotropics and Addictive Substances (NAPZA), including marijuana, presents a dilemma in the medical and legal context, especially in Indonesia. While several countries have recognized the medical benefits of marijuana, Indonesia still classifies it as a Class I narcotic, the abuse of which is subject to heavy sanctions. This research examines the duality of marijuana use, which on the one hand has significant therapeutic potential, and on the other hand, presents risks of abuse and serious legal implications in accordance with Law no. 35 of 2009 concerning Narcotics. This research also considers the views of Islamic law regarding the use of substances that can affect psychological and physiological conditions. This research uses a normative juridical approach, analyzing existing regulations, Islamic legal texts, and academic literature to explore the medical and legal implications of using marijuana as medicine. Research results show that marijuana has therapeutic benefits that cannot be ignored, especially in treating chronic and serious diseases such as epilepsy, glaucoma and cancer. However, strict regulations and existing stigma hinder this potential utilization. Revision of Law no. 35 of 2009 to consider the medical potential of marijuana, with more flexible regulations that allow research and controlled use of marijuana for medical purposes. Further studies are needed to support these policy changes, ensuring that cannabis use can occur within a safe and responsible framework. Abstract

This study discusses the legal certainty of informed consent in high-risk tooth extraction from the perspective of health law in Indonesia. Informed consent is a key element in medical practice that guarantees the patient's right to obtain clear and adequate information before undergoing medical treatment and protects doctors from allegations of malpractice. In the context of tooth extraction performed in an emergency, the legal certainty of informed consent is very important to protect patient rights and provide legal protection for dentists. This study was conducted at the independent practice of drg. Evi Imelda Pelawi - Dental Care located in Simalungun, North Sumatra, where it was found that many patients still do not prioritize the importance of informed consent. The results of the study indicate that dentists can be free from malpractice claims as long as they have provided adequate explanations in accordance with Article 7 of the Regulation of the Minister of Health Number 290/Menkes/Per/III/2008 and the patient or family has signed an informed consent as proof of agreement. However, this study also found weaknesses in the regulation related to the provisions on time recording which are not regulated in detail, thus potentially weakening legal evidence in the event of a dispute. Therefore, this study recommends that the regulation be updated to strengthen legal certainty in medical practice, especially in high-risk tooth extraction procedures in independent practices.

Abstract

The provision of medical procedures without patient consent or without informed consent is a crucial issue in medical practice that directly touches aspects of professional ethics and the protection of patients' human rights. In Indonesia, although regulations have explicitly regulated the importance of patient consent before medical action is taken, there are still many cases of violations that have the potential to have legal repercussions for medical personnel. Violations of the principle of informed consent not only injure the patient's right to know and decide, but can also be a form of malpractice that is physically and psychologically detrimental. This research aims to answer the question of how legal liability can be imposed on medical personnel who perform medical acts without informed consent, what is the legal basis that regulates it, and the extent to which patients' legal protection is recognized and enforced. The focus of the study is directed to juridical analysis of laws and regulations as well as studies of several concrete cases that have occurred in Indonesia. The legal liability studied includes civil, criminal, and professional aspects of medical personnel. The research methodology used is a juridical normative approach with qualitative analysis techniques. Data was obtained from literature studies on laws, court decisions, professional codes of ethics, and other relevant documents. Conceptual approaches and case approaches are used to explore how legal principles are applied in practice as well as assess the effectiveness of legal protection for patients. The results of the study show that medical personnel who perform medical actions without informed consent can be held legally accountable based on the Civil Code, the Criminal Code, and Law Number 29 of 2004 concerning Medical Practice. These actions can qualify as defaults, unlawful acts, or even criminal acts. Therefore, it is important for governments and health institutions to strengthen the implementation of regulations through socialization and strict supervision of informed consent procedures. Technical revisions are also needed in the form of derivative regulations that clarify operational standards and responsive law enforcement mechanisms.

Abstract

Di tengah kemajuan teknologi digital yang pesat, media sosial telah menjadi sarana utama untuk menjalin komunikasi, menyebarkan informasi, dan mengekspresikan pendapat. Meskipun menawarkan kemudahan dan kebebasan berekspresi, media sosial juga memunculkan berbagai persoalan etis yang kompleks. Tulisan ini mengulas nilai-nilai etika dalam penggunaan media sosial, seperti tanggung jawab individu, kejujuran dalam berkomunikasi, penghargaan terhadap privasi orang lain, serta upaya mencegah penyebaran hoaks atau informasi yang menyesatkan. Melalui kajian pustaka dan analisis kasus, artikel ini menekankan pentingnya kesadaran etis di kalangan warganet guna menciptakan ruang digital yang kondusif dan positif. Studi ini juga mengajukan sejumlah saran untuk meningkatkan kebijaksanaan dalam berinteraksi di dunia maya, termasuk penguatan literasi digital dan tanggung jawab sosial. Secara keseluruhan, etika bermedia sosial merupakan aspek krusial yang perlu terus dikembangkan demi menghindari konsekuensi negatif dari penggunaan platform digital. Peran aktif pengguna media sosial dalam menyaring informasi dan menahan diri dari perilaku impulsif sangat menentukan iklim komunikasi digital yang sehat. Oleh karena itu, diperlukan pemahaman yang kuat terhadap nilai-nilai etika dan hukum yang mengatur perilaku daring. Pelanggaran etika tidak hanya menimbulkan kerugian sosial, tetapi juga berpotensi berimplikasi hukum sebagaimana diatur dalam perundang-undangan, seperti UU ITE. Di samping itu, kolaborasi antara institusi pendidikan, pemerintah, dan platform digital sangat diperlukan untuk menyusun pedoman dan program literasi digital yang aplikatif dan mudah diakses oleh masyarakat luas. Dengan pendekatan yang komprehensif, diharapkan media sosial dapat digunakan secara bijak sebagai ruang publik yang produktif, edukatif, dan beretika.

Abstract

Penelitian ini bertujuan untuk menganalisis keabsahan layanan telemedicine dalam konteks hukum positif Indonesia. Di era digital, penggunaan telemedicine telah meningkat, didorong oleh kebutuhan untuk akses kesehatan yang lebih luas serta kepraktisan dalam pengobatan jarak jauh. Namun, pergeseran ini menimbulkan pertanyaan hukum penting terkait keabsahan perjanjian terapeutik yang dilakukan secara online dan perlindungan data pengguna. Menggunakan metode penelitian normatif, penelitian ini mengkaji regulasi terkait serta implementasi layanan telemedicine berdasarkan Permenkes Nomor 20 Tahun 2019. Hasil penelitian menunjukkan bahwa telemedicine di Indonesia, sementara secara teoritis memenuhi syarat perjanjian sah, masih memerlukan peraturan lebih lanjut untuk mengatasi isu-isu seperti informed consent dan keamanan data. Dari analisis tersebut, disarankan bahwa diperlukan pengembangan regulasi yang lebih spesifik dan komprehensif untuk memastikan praktik telemedicine yang aman dan bertanggung jawab. Studi ini memberikan wawasan baru tentang bagaimana hukum Indonesia menanggapi perkembangan layanan kesehatan digital dan menyoroti pentingnya adaptasi hukum yang berkelanjutan untuk mendukung inovasi dalam pelayanan kesehatan.
