Abstract

This research was conducted at the Baun weekly market. The background to this research is markets that should provide quality, clean and halal food, however carrying out trade in animal meat that does not comply with sales standards. The problem studied is animal husbandry procedures in selecting livestock for farming slaughter at the baun market and the role of supervisor and responsibilities of the district livestock service Kupang, the role of breeders in terms of consumer protection regarding the sale of animal meat (Cow and Pork) at the baun market. This research uses empirical methods or methods with data obtained from direct interviews in the field. 1) Procedures for cattle breeders and pigs to be slaughtered according to procedures and supervised directly by the livestock service Kupang Regency and the quality of the meat produced is safe and high quality at the Baun market. 2) Supervision of animals and animal meat (beef and pork) is carried out by veterinarians, breeders, Kupang district livestock service, BPOM, health service, (LPPOM MUI), (BPKN), (LSPK), market foremen, and sub-district/district governments.

Abstract

The objectives of this study are (1) To find out the factors that cause land disputes between residents in Tainsala Village (2) To find out the role of the Tainsala Village government in resolving land disputes between residents in Tainsala Village. The research method uses empirical research, namely data obtained directly from the field. This research uses empirical legal research, using a qualitative approach method, namely an approach based on the type of data and data analysis. The data used includes primary, secondary data, data collected through interviews, and non-participant observation. Also, using qualitative descriptive analysis, where the data is presented by describing the results of research on efforts to resolve land disputes between residents by the village government. The results showed: (1) Factors that cause land disputes between residents in Tainsala Village, due to unclear land ownership status, the influence of customary settlements (belis), the increasing needs of life and the high price of land and conflicts between sellers and buyers of land. (2) The role of the village government in resolving land disputes between residents in Tainsala Village, settlement by mediation, namely the village head as an arbiter in resolving disputes between two parties and settlement in a family manner, namely settlement carried out by peaceful means involving family elements from the parties to the case. The suggestions are: (1) The village government must provide direction to the community to clarify the land certificate. (2) The village government must make a statement letter if the settlement of land disputes is carried out in a family manner.

Abstract

The purpose of this research is to analyse the factors causing and overcoming violations of route permits in Manggarai Regency. This research is an empirical juridical research, which uses primary data sources, namely field research with interview methods to sources with an interest in this paper and secondary. Based on the results of the research, the factors causing violations of route permits by the Department of Transportation of Manggarai Regency are divided into three, namely government factors, namely the lack of honorary staff in the terminal; vehicle business factors (owners and drivers) caused by economic factors, administrative factors, intense competition between transport drivers; community factors that do not obey government regulations. Countermeasures are supervision and inspection by means of routine supervision and inspection, sudden and quarterly inspections; granting permits with special conditions, monitoring and evaluation; permit scoping. Law enforcement is preventive and repressive.

Abstract

Inheritance is wealth which can be a collection of assets and liabilities from the heir which is transferred to the heirs. In inheritance law, a principle applies, namely that if an heir dies then by law his rights and obligations immediately pass to his heirs. The division of inherited assets can have legal impacts in society which occurred in the Sikka Krowe Tribe community, specifically in Klotong Hamlet, Bura Bekor Village, Bola District, Sikka Regency between disputed heirs. The problem formulation of this research is 1. What are the reasons for the struggle between heirs? 2. What is the process for resolving property disputes between heirs? And 3. How is the distribution of assets resulting from struggles between heirs viewed from the customary law of the Sikka Krowe tribe, Bola District, Sikka Regency? This research is empirical legal research. The data sources in this research are primary and secondary data sources. Data management and analysis techniques are editing, classification and description, then the data obtained, both primary and secondary data, will be processed and analyzed by researchers based on the problem formulation. Based on the research results, the reason why there is a struggle between heirs in inherited land disputes is that the family does not know the exact status of ownership of the inherited land and the factor of poor communication between the two parties. Settlement of disputes or disputes Done through utun omok (gathering to find a way out) includes: presenting family parties, deliberation or mediation (kula babong), decision making, settlement and returning decisions to the parties in dispute. Distribution of land inheritance using a patrilineal kinship system, namely distribution that is directly given to sons as the main heirs and gets more inheritance.

Abstract

The increase in cooking oil as a staple food is certainly detrimental to consumers, especially consumers from the lower middle class, after the problem of scarcity of cooking oil occurred in Indonesia and various policies to adjust the price of cooking oil carried out by the government, provide evidence that the urgency of the price of cooking oil has an impact on society. This research aims to find out and explain the causes of the increase in cooking oil prices carried out by shop entrepreneurs in West Sabu sub-district, Sabu Raijua Regency. The research method used is that this research is included in empirical legal research, namely a legal research method that attempts to see the law in a real sense or can be said to see, examine how law works in society, which then uses a research approach, a qualitative type of approach. The research results show that legal protection for consumers can be carried out by resolving disputes in court and outside of court. Every consumer who is harmed can sue business actors through institutions tasked with resolving disputes between consumers and business actors or through courts within the general court environment and the government also plays an important role in efforts to protect consumers legally. The form of consumer protection provided is by issuing laws and government regulations, where the implementation of statutory regulations is then carried out by supervising the implementation of these regulationsto be able to socialize it to the public and there is also a need for supervision carried out by the government on business actors.

Abstract

The increasing need for land has made land purchase and sale agreements more and more occurring. The sale and purchase agreement made by agreement must be carried out on the principle of clear cash. However, in practice, there are still many buying and selling that are not in accordance with the principle of light cash and the principle of Nemo plus juris as the principle of land registration. Problems regarding the sale and purchase of land that are not in accordance with procedures, not in accordance with existing principles and even not carried out in front of the authorized officials, namely the Sub-district Head and PPAT, still occur in Fatukoa Village, Maulafa District, Kupang City, resulting in legal uncertainty and land rights on the land object being traded. Uncertainty about the law. The type of research used is empirical legal research, and the data sources taken are primary data, secondary data and tertiary data. The population and samples taken are: 2 sellers, 2 buyers, heirs and the community. The sample used is the saturated sample technique where all members of the population get the same opportunity. The results of the study show that: (1). The authority of the sub-district head in making a letter of release of rights is contained in article 131 Paragraph (3) of the Regulation of the Minister of Agrarian Affairs/Head of the National Land Agency No. 3 of 1997 concerning the Provisions for the Implementation of Government Regulation Number 24 of 1997 concerning Land Registration. Regarding land that is sold and sold without using a PPAT deed, it must be done at the sub-district where the land is located, applicants who want to make SPPHT must follow the existing procedures and procedures starting from the agreement of both parties, the readiness of documents, the creation and implementation of SPPHT, registration to the signing and submission of the land rights release letter. (2) Public awareness of the existing regulations The level of public awareness of fatukoa is still very low. The public really does not understand the importance of registering land rights and the implementation of buying and selling with existing procedures with PPAT deeds or with letters under hand, namely the release of land rights. The factors that hinder the legal awareness of the community in Fatukoa Village are education factors and economic factors.

Abstract

This study aims to find out and analyze the study of the default judiciary in the implementation of the lending agreement between creditors and debtors based on case number 71/PDT. G/2023/PN KPG. This research is a normative law research that uses primary legal materials and secondary legal materials. The approach methods used in this study include the Case Approach, the Conceptual Approach, and the Statute Approach. The researcher performs this technique by collecting source materials and then doing so by reading, studying, analyzing, recording and interpreting points related to the problems or legal issues raised by the researcher. The results of this study show (1) The form of default committed by the defendants or debtors as contained in decision number 71/Pdt. G/2023/PN. Kpg The form of default committed by the debtors and/or the defendants as the judgment in question is a form of default "carrying out the achievement but not as it should" (2) The legal consequences that must be borne by the defendants are having to pay compensation that is many times the amount of the previous loan, namely from Rp. 350,000,000,- (three hundred and fifty million) to Rp. 612,847,022,- (six hundred and twelve million eight hundred and forty-seven twenty-two rupiah) and must pay the cost of the case and must give up the bail if seven days after the legally effective judgment remains to be confiscated and the factors that cause the perpetrators of the default can be categorized into internal factors and external factors.

Abstract

This study aims to determine the inheritance distribution system based on Kletek Taruik customary law, in Alas Village, East Kobalima District, Malaka Regency and the current community attitude towards the inheritance distribution system, based on Kletek Taruik customary law, in Alas Village, East Kobalima District, Malaka Regency. The research method used in this study is empirical legal research. The sources and types of data in this study are primary data obtained from the results of field studies with interviews. Secondary data were obtained from literature studies. The data obtained is then processed by checking and correcting the data. After the data is processed then analyzed qualitatively. Based on the results of research and discussion, it can be concluded that the community in Alas Village, East Kobalima District, Malaka Regency, adheres to the matrilineal principle in the distribution of inheritance property, where more inheritance for daughters or also called heirs are daughters, because girls are members of the tribe who will continue the descendants of the heirs, while the son even though he is the eldest but he only helps manage or process The inheritance, because the daughter is considered more responsible in taking care of the inheritance of her parents than the son who will submit to his wife's family. The community in Alas Village, East Kobalima District, Malaka Regency, is very accepting of the prevailing customary rules where girls have full rights to their outgoing customary inheritance, but it does not rule out the possibility for sons to also receive inheritance from both parents based on mutual agreement.

Abstract

The land sale and purchase agreement with everything above and in it has been implemented and proven by full payment by the buyer so that Article 571 of the Civil Code applies to the buyer. The research method used by the author is Empirical Jurisprudence with a qualitative approach, the data collection for this research is Interview research and Literature Study. the data is then analyzed using qualitative analysis. The results of the study indicate that Legal protection for land buyers in the case of transfer of ownership of teak trees by land sellers to third parties reviewed from the Civil Code guarantees the buyer's rights to the object that has been purchased, namely land and everything attached to the land. based on the Basic Agrarian Law (UUPA) legal protection for land buyers in the case of transfer of ownership of teak trees by land sellers to third parties is very weak. the settlement was carried out through mediation and the seller provided compensation in the form of another teak tree, but this shows that the implementation of the seller's responsibility is not entirely ideal from a formal legal perspective. the seller was proven to have fulfilled the four elements of an unlawful act.

Abstract

Latar belakang: Kebijakan program kesehatan gratis bagi masyarakat di Kabupaten Belu merupakan salah satu transformasi kesehatan oleh Pemerintah Daerah Kabupaten Belu. Implementasi kesehatan gratis perlu dikaji kebermanfaatan dan keberlanjutan programnya. Tujuan: Penelitian ini bertujuan untuk mengkaji kualitas pelayanan kesehatan dan kepuasaan pasien penerima manfaat implementasi program kesehatan gratis di Kabupaten Belu guna memberi masukan bagi perbaikan program. Metode: Penelitian ini menerapkan metode deskritif kualitatif dan yuridis empiris. Teknik pengumpulan data menggunakan studi kepustakaan dan studi lapangan. Studi lapangan menggunakan teknik wawancara, observasi dan focus group discussion yang melibatkan pemangku kebijakan, pelaksana pelayanan kesehatan dan masyarakat penerima manfaat program kesehatan gratis di Kabupaten Belu. Hasil: Ketersediaan sarana prasarana kesehatan di Kabupaten Belu sudah memenuhi syarat, namun pada kondisi geografi dan topografi diwilayah tertentu aksesibilitasnya masih rendah. Sebagian besar tenaga kesehatan sudah memenuhi standar ideal, namun perlu ada kajian dan regulasi lanjutan tentang rasio sumber daya kesehatan dan rasio fasilitas kesehatan agar tercapai standar pelayanan minimum. Keberhasilan program dan layanan kesehatan setelah implementasi program kesehatan gratis meningkat secara signifikan. Sebagian besar masyarakat sangat puas dengan manfaat kesehatan gratis, namun masih terdapat masyarakat yang menyatakan tidak puas karena masih kurangnya empati petugas kesehatan dalam pelayanan. Status peraturan kesehatan gratis juga perlu ditingkatkan menjadi peraturan daerah agar legal standing dan kekuatan hukumnya dapat dipertanggungjawabkan. Kesimpulan: Masyarakat sangat membutuhan keberlanjutan program kesehatan gratis, sehingga perlu dilakukan monitoring dan evaluasi serta sosialiasi program secara kontinue terutama tranformasi etika budaya dan empati tenaga kesehatan, dalam rangka meningkatkan mutu pelayanan kesehatan yang humanis dan profesional.
