Abstract

In the 2024 Presidential PHPU trial, the Constitutional Court summoned four Ministers to give testimony in the trial. This raises a problem, because in the PMK PHPU President there is not a single provision that explicitly authorizes the Constitutional Court judge to be able to summon the informant. This study aims to firstly, determine the legal basis for the authority of Constitutional Court judges to summon the informant in the PHPU Presidential Election Case. Second, to find out the consequences caused by the summoning of the informant by the Constitutional Court judges in the PHPU Presidential Election Case. Third, to find out the clarity of the regulation regarding the informant in PMK No. 4/2023 and to provide a concept of the necessary arrangements in order to avoid abuse of authority by the Constitutional Court judges in the PHPU President. This paper uses normative legal research, using a statutory approach and a case approach. Based on the results of the research, it turns out that there is no authority for Constitutional Court judges to summon the informant because this is not explicitly regulated in the PMK PHPU President. The unclear legal basis governing the summoning of the informant in the Presidential PHPU trial and the actions of Constitutional Court judges who summon the informant on their own initiative can cause problems. The problems that arise relate to potential violations of the principle of independence and the emergence of legal uncertainty. There is ambiguity in the authority to summon the informant in the Presidential PHPU trial. Therefore, further regulation is needed regarding the authority to summon the informant in the PHPU Presidential Election case so that there is a clear division of authority in order to present the informant at the trial.

Abstract

This research develops Agile Development, particularly Extreme Programming (XP), to create a web-based Human Resource Management Information System for the DIY Regional Police's Operational Bureau. Addressing challenges in personnel data management, the objective is to enhance efficiency and effectiveness. The study involves system needs analysis, design, implementation, and testing. Initial development includes interfaces for employees, administrators, and leaders, featuring personnel data management, leave requests, and announcements. Testing involves White Box, Black Box, and alpha testing by 25 Operational Bureau respondents. Alpha test results reveal high satisfaction with efficiency, data accuracy, and administrative process acceleration. The system effectively reduces human errors in personnel data management. The research concludes that the web-based system is a successful, computerized, organized solution for personnel data management in the Operational Bureau of DIY Regional PoliceĀ

Abstract

This article aims to examine the settlement of state losses caused by criminal acts of corruption in the management of state finances at the State-Owned Enterprise PT. Asabri (Persero). The research results show that the financial status of BUMN PT. Asabri is state finance, so when a criminal act of corruption occurs, a mechanism is needed to resolve state losses. Criminal law enforcement has been carried out as well as a mechanism for paying compensation to the state to resolve state losses. However, it seems that the settlement of state losses by convicts through the payment of compensation money to the state is not enough to replace the entire value of state losses caused by criminal acts of corruption. Obstacles to resolving state losses are contained in the provisions of Article 18 paragraph (1) letter b of the Corruption Eradication Law. This article stipulates that the payment of replacement money is limited to the value of the property obtained by the perpetrator of the criminal act of corruption. This limitation means that convicts are only responsible for returning the value of losses to the state they obtained unlawfully. In addition, state losses at PT. Asabri is not part of the convict's responsibility. As we know, criminal acts of corruption are very likely to cause other losses that arise outside of the property obtained by the perpetrator by violating the law.

Abstract

The revision of Law 39/2008 on State Ministries, which removes the maximum limit of 34 ministries, has become a polemic issue in society. Analysis shows that increasing the number of ministries is not urgent and runs counter to the spirit of bureaucratic reform. This policy also does not improve the effectiveness of government administration, because the main issue affecting the effectiveness of ministries lies in the quality of ministers, not the number of ministries. The addition of ministries has the potential to cause overlapping authorities, regulatory disharmony, and sectoral egos. From an efficiency perspective, this policy places a heavy burden on the state budget, which is already burdened by Rp. 9000 trillion in national debt, with 45% of state revenue used to pay off debt. In addition, there has been a drastic increase in ministry spending in the Prabowo era compared to the Jokowi era. Abstract

Comfort is a crucial factor in supporting the intended use of a space, including library spaces. Some previous studies have successfully examined the comfort of library spaces. However, there is still a lack of research that simultaneously examines the aspects of visual comfort, thermal comfort, and energy conservation. This study aims to evaluate the comfort of library space, including lighting, air conditioning, and energy conservation aspects, with a case study conducted in the library of Politeknik ATMI Surakarta. The research stages include data collection and calculations, followed by result analysis. Lighting calculations use the Lumen method, while cooling load calculations utilize the Cooling Load Temperature Difference method. Result analysis is carried out through a comparison between observation results and calculations, referring to several applicable standards. The research findings indicate that the lighting level in the library space needs improvement through the addition of lights and the even distribution of lighting installations. Another alternative solution is the replacement of lights with LED types that are more energy-efficient. The installed air conditioning unit in the room is in line with the cooling load requirements. However, it is recommended to replace the Window-type air conditioning unit with a Split Wall type and to exchange their locations.
