Abstract

Notaries in carrying out their positions, notaries must comply with the Notary Code of Ethics. However, the rapid development of digital technology has led to legal changes, which have an impact on problems in the implementation of notary professional ethics. It is possible that Notaries will be trapped in new phenomena that can ensnare them into legal problems in the future. This research raises the issue of the form of implementing notary professional ethics and its challenges in the digital era. This research is a normative juridical research using a statutory, conceptual, and case approach. Legal materials were collected through literature study and analyzed using qualitative analysis. The results of the study conclude that the challenge for notary professions in the digital era, in implementing Notary ethics, is that a Notary must have skills (skills), knowledge (insight or knowledge), and attitude (attitude or behavior) to understand digital technology. Because, if the Notary does not understand the characteristics and intricacies of digital technology, it will slip into a deviation from Notary ethics. Notaries will find it difficult to sort out which ones are prohibited and allowed to promote on social media or on digital media. Notaries must master digital technology as a provision for the implementation of notary professional ethics in the digital era.

Abstract

Tanah seringkali dipergunakan sebagai modal saham dalam pendirian Perseroan terbatas karena pertimbangan dari nilai ekonomisnya karena tanah mempunyai nilai yang terus meningkat dalam kurun waktu tertentu dan cenderung tidak akan mengalami kemerosotan. Penggunaan tanah sebagai modal dalam Perseroan Terbatas tidak lepas dari masalah dikarenakan adanya berbagai macam hak atas tanah khususnya berkaitan dengan Hak Milik atas tanah. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang ratio legis tidak diberikannya hak milik atas tanah bagi Perseroan Terbatas dan akibat hukum status hak milik atas tanah yang dijadikan penyertaan modal dalam Perseroan Terbatas. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Ratio Legis tidak diperbolehkannya Perseroan Terbatas mempunyai tanah dengan hak milik untuk menghindari penyelundupan-penyelundupan terhadap batas maksimum pemilikan tanah. Hak Milik atas tanah yang dialihkan melalui penyertaan kedalam perusahaan harus terlebih dahulu diturunkan haknya menjadi hak guna bangunan agar Perseroan Terbatas sebagai menjadi subyek hukum yang menerima peralihan hak tersebut memenuhi syarat yang telah ditentukan oleh Undang-Undang sebagai pemegang hak atas tanah. Tidak dipenuhinya persyaratan tersebut menyebabkan terjadinya cacat administrasi yang dapat mengakibatkan dibatalkannya hak atas tanah yang bersangkutan dan status tanah menjadi tanah negara.

Abstract

In maintaining the security of personal data in the digital era, it is very important to remember that personal data can be used by unauthorized parties for various purposes. This is like the notary profession which is now required to be able to maintain the security of each client's data. Notaries can participate in recording important digital documents, such as deeds and contracts, which can help prevent manipulation. Due to the problems that occur, of course the role of the notary in maintaining data security must be considered, especially in transactions and legal documents. Even though the digital world has changed the way many transactions are carried out, the role of notaries still plays an important role in ensuring the validity, integrity and security of digital documents. Notaries can witness and certify contracts and digital legal documents, making them legally valid. The aim of this research is to explain and analyze the role of notaries in maintaining the security of personal data in the digital era. The approach used in this research is a juridical-empirical approach. The results of this research are that the role of notaries in maintaining data security in the digital era has an important role in validating digital signatures. By verifying identity and ensuring that digital signatures are valid, notaries help ensure security in digital transactions. In addition, notaries can also provide digital certificates that confirm the validity of digital signatures and electronic documents. This certificate is a strong proof of authentication. This is proof that the Notary ensures that digital transactions comply with applicable laws, including data privacy regulations and cyber security regulations. This helps keep data secure.

Abstract

The aim of this study is to analyze the legal consequences of company bankruptcy for individuals and the legal certainty of company bankruptcy for individuals. The method used in this study is normative juridical with a statutory approach and a conceptual approach. This study uses primary, secondary and tertiary legal materials. Data collection uses document study or literature study techniques. The data that has been obtained is analyzed qualitatively using deductive and inductive methods or interpretation is carried out. The results of the study show that individual companies that have been declared bankrupt through a court decision can immediately give rise to legal consequences, namely that the debtor loses the right to carry out management and control over the assets owned and everything produced during bankruptcy, and the rights and obligations of the bankrupt debtor are transferred to the curator. to manage and control the debt as regulated in Article 19 to Article 62 of Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. The concept of bankruptcy law certainty in bankruptcy law can be demonstrated in the principle of quick case resolution and simple proof.

Abstract

Penelitian ini bertujuan untuk mengetahui modernisasi masyarakat dan keamanan siber ditinjau dari perspektif hukum perlindungan data pribadi. Jenis data dalam penelitian ini yaitu primer dan sekunder. Tekhnik pengumpulan data primer diperoleh dari studi literatur melalui buku dan artikel jurnal dimana memiliki keterkaitan terhadap keamanan siber dan kedaulatan data. Berdasarkan hasil penelitian Modernisasi masyarakat yang ditandai dengan pesatnya perkembangan teknologi digital telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk cara individu, perusahaan, dan pemerintah mengelola serta memanfaatkan data pribadi. Namun, di balik kemajuan ini, muncul tantangan besar dalam hal keamanan siber, yang menjadi semakin kompleks seiring dengan meningkatnya ancaman seperti serangan peretasan, pencurian data, dan penyalahgunaan informasi pribadi. Dari perspektif hukum perlindungan data pribadi, modernisasi menuntut adanya regulasi yang kuat dan implementasi yang efektif untuk melindungi hak individu atas data mereka. Dengan pendekatan yang komprehensif dan sinergi antara berbagai pemangku kepentingan, modernisasi dapat berjalan selaras dengan keamanan siber yang optimal, sehingga hak atas perlindungan data pribadi dapat terjamin di era digital ini.

Abstract

This research aims to determine the validity of issuing conformity in space utilization activities (KKPR) that are not in accordance with the spatial plan. The research method used is normative legal research.  The approach used to examine various laws and regulations related to the regulation of obligations for the issuance of KKPR in accordance with the Regional Spatial Plan. The results of the analysis show that the policy regarding the obligation to issue KKPR in accordance with the Regional Spatial Plan has been regulated and stipulated in the Legislative Regulations. This is a basic requirement for submitting a KKPR. Apart from that, this validity is based on several aspects including authority, suitability of procedures and substance. In the event that the KKPR has been issued in accordance with its authority and has gone through appropriate procedures, but there are deficiencies in substance, then it can be concluded that the published KKPR is invalid.

Abstract

Taxes are a source of state income which is very important for the continuity of government programs and activities. One type of tax that is the object of regional tax is Advertisement Tax, which is imposed on the basis of carrying out advertisements in an area. Advertisement Tax Debt arises as the advertisement is carried out, although tax payments can only be made after the Regional Tax Assessment Letter is issued based on a request from the advertisement operator. If the advertisement organizer does not register the advertisement, the Regional Government can issue a Regional Tax Assessment Letter ex officio to encourage optimization of advertisement tax revenues. Apart from that, advertising must also pay attention to the city planning and existing space to maintain the aesthetics of the city. Regional Regulation Number 5 of 2019 is expected to provide legal certainty and ensure that the implementation of advertising does not conflict with spatial planning. Even though the Advertisement Tax has been paid, the issuance of a permit to operate advertisements cannot be done simply without paying attention to the provisions in regional regulations. As part of efforts to control advertisements and to ensure tax optimization in line with spatial planning provisions, taxes must carry out a regular function through the application of tax disincentives to advertisements that do not comply with existing planning regulations

Abstract

This research investigates the implications of not reading out the legal consequences of a sale and purchase deed prepared by a Notary/PPAT in front of the concerned parties. It employs a descriptive approach, drawing from various literature sources such as books, research findings, journals, and articles. The study underscores the Notary/PPAT's responsibility to orally communicate the deed's content to the involved parties. Failure to do so diminishes the deed's authenticity. Although the deed remains legally valid regarding the transaction, its authenticity suffers, likening it to an underhand deed. Consequently, Notaries/PPATs who overlook this obligation may face sanctions as per the relevant ethical codes for their negligence.

Abstract

Penelitian ini untuk melakukan analisa tanggung jawab terhadap notaris dengan metode penelitian normatif melalui pendekatan perundang-undangan dan prinsip hukum. Hasil dari penelitian ini menunjukkan bahwa meskipun notaris telah melaksanakan PMPJ, namun tidak menghilangkan tanggung jawab jika ditemukan indikasi TPPU pasca penerbitan akta. Notaris dapat dimintai pertanggungjawaban atas perbuatan yang sudah dilakukan. Namun, perlindungan hukum tetap diberikan sepanjang notaris dapat memberi bukti telah melakukan due diligence dalam proses pembuatan akta. Sehingga diharapkan dengan adanya penulisan ini bisa menjadi penguatan atas regulasi yang sudah berlaku saat ini.

Abstract

Waqf is the legal act of a wakif to separate and/or hand over part of his property to be used forever or for a certain period of time in accordance with his interests for the purposes of worship and/or general welfare according to sharia. In reality, not all waqf givers understand the concept of waqf in general, this can be seen in a legal case that was decided in Civil Case Lawsuit No. 230/Pdt.G/2018/PTA.Smg. That this research aims to analyze more deeply about waqf and analyze waqf legal cases as in Civil Case Lawsuit No. 230/Pdt.G/2018/PTA.Smg. The research method in this legal research uses normative juridical methods using several approaches to make analysis easier. The formulation of the problem used in this research is the principles of civil law and civil sharia in the implementation of waqf and the application of the principles of civil law and civil sharia in the civil case lawsuit No. 230/Pdt.G/2018/Pta.Smg. The conclusion from this research is that Waqf is the legal act of a wakif to separate and/or hand over part of his property to be used forever or for a certain period of time in accordance with his interests for the purposes of worship and/or general welfare according to sharia. Inimplementation waqf, it is obligatory to follow Islamic sharia and laws and regulations regarding waqf, so that the waqf is valid in accordance with the sharia and applicable laws. That property that has been donated cannot be canceled unilaterally by the wakif, therefore it is obligatory in implementing the waqf to carry out the terms and conditions as stated in the waqf terms and laws. It is best that before implementing the waqf pledge, Nadzir should assess the economic capabilities of the wakif so that there will be no incidents like in the civil case and avoid lawsuits for canceling the waqf pledge deed.
