Abstract

Pharmacy as a profession has been undergoing many relevant changes in facing many challenges and social demands. The consumers generally are not well-acknowledged of many drugs to consume, to increase, or to maintain their health level. This research aims at understanding the role of a pharmacist in protecting the drug consumers in Indonesia. The reserach is a normative one relying on secondary data source. The data is collected by document study through reading, studying, and identifying the data to be analyzed qualitatively. The research result concludes that the pharmacists play an important role in protecting drug consumers in Indonesia by (1) being responsible in providing (a) quality assurance, production, quality control of pharmacy industry (b) pharmaceutical services in the public pharmacy. (2) Cutting off the edge business directly facing the drug/consumers in the long chain mechanism of drug consumption.

Abstract

Nurses are at the forefront of handling COVID-19. Technological advances plus the Covid-19 emergency resulted in the implementation of the marriage contract being carried out virtually by nurses while undergoing isolation. This study aims to analyze the practice of virtual nurses' marriage contracts during the covid-19 pandemic according to marriage law and health law. This is a normative legal research conducted by means of literature research to explore primary and secondary legal materials using a conceptual approach. The results of this study concluded that the practice of virtual marriage contracts carried out by nurses during the COVID-19 pandemic had two important aspects to consider, namely aspects of religion and health. The Marriage Law does not explicitly regulate virtual marriage contracts, but the arrangements are returned to the laws of each religion. There are differences of opinion regarding virtual marriage contracts in the treasures of Islamic marriage law. The group that refuses to think that the marriage contract must be carried out directly in one assembly, while those who accept mean one assembly in the sense of one continuous time. Nurses who are in isolation due to Covid and decide to hold a virtual marriage contract as an effort to maintain the health of themselves and the community as well as to realize the maqashid sharia marriage, which is to protect religion, soul, mind, lineage, and property. Key Words: Virtual marriage contract, covid-19, health, nurse AbstrakPerawat menjadi garda depan dalam penanganan covid-19. Kemajuan teknologi ditambah darurat covid-19 mengakibatkan penyelanggaraan akad nikah dilakukan secara virtual oleh perawat saat menjalani isolasi. Penelitian ini bertujuan untuk menganalisis praktik akad nikah virtual perawat saat pandemi covid-19 menurut hukum perkawinan dan hukum kesehatan. Penelitian ini merupakan penelitian hukum normatif yang dilakukan dengan cara studi pustaka (literature reseacrch) untuk menelusuri bahan hukum primer dan sekunder dengan pendakatan konsep (conceptual apparoach). Hasil penelitian ini menyimpulkan bahwa praktik akad nikah virtual yang dilakukan perawat saat pandemi covid-19 terdapat dua aspek penting yang menjadi pertimbangan, yaitu aspek agama dan kesehatan. Undang-Undang Perkawinan tidak secara tegas mengatur akad nikah virtual, tetapi pengaturannya dikembalikan kepada hukum agama masing-masing. Terdapat perbedaan pendapat mengenai akad nikah virtual dalam khazanah hukum perkawinan Islam. Kelompok yang menolak menganggap akad nikah harus dilakukan langsung dalam satu majelis (tempat), sementara yang menerima memaknai satu majelis dalam arti satu waktu yang berkesinambungan. Perawat yang menjalani isolasi karena covid dan memutuskan melangsungkan akad nikah virtual sebagai upaya menjaga kesehatan diri dan masyarakat serta mewujudkan maqashid syariah nikah, yaitu menjaga agama, jiwa, akal, keturunan, dan harta.
