Abstract

Artikel ini bermaksud untuk menganalisis penghormatan, perlindungan, dan pemenuhan Hak Asasi Manusia (HAM) dalam pengaturan hukum keimigrasian mengenai tindakan deportasi terhadap Tenaga Kerja Asing (TKA) di Indonesia. Selain itu, artikel ini juga bertujuan untuk menganalisis aspek-aspek yang perlu diperhatikan untuk menjamin bahwa tindakan deportasi yang dilakukan oleh pejabat keimigrasian tidak melanggar HAM yang dimiliki oleh TKA yang bekerja di Bali. Artikel ini didesain sebagai suatu penelitian hukum normatif yang meneliti bahan-bahan hukum yang berkaitan dengan isu deportasi dan TKA yang dipadukan dengan suatu metode penelitian HAM. This article intends to analyze the respect, the protection, and the fulfillment of human rights in the regulation of immigration law on of deportation measures imposed to foreign workers in Indonesia. In addition, it aims to analyze the aspects that need to be considered to ensure that the deportation measures taken by immigration officials would not violate human rights of the foreign workers who work in Bali. This article is designed as a normative legal research that examines the legal materials relating to the issue of deportation and foreign workers, combined with a human rights research method.

Abstract

Penerbitan travel warning oleh suatu negara secara faktual berdampak pada tingkat kunjungan wisata ke negara yang dituju. Penelitian ini bertujuan untuk menganalisis mengenai praktik negara-negara, termasuk Indonesia, dalam menerapkan kebijakan travel warning. Selain itu, juga secara spesifik akan membahas korelasi antara kebijakan travel warning dengan eksistensi hak berwisata (right to tourism) dalam kerangka hak asasi manusia (HAM). Jenis penelitian ini adalah yuridis-normatif yang utamanya menganalisis peraturan perundang-undangan nasional Indonesia dan instrumen internasional yang relevan. Hasil penelitian ini menunjukkan bahwa praktik negara-negara dalam dalam penerbitan kebijakan travel warning menunjukkan variasi yang relatif beragam, terutama berkaitan dengan identifikasi risiko dan lembaga yang berwenang untuk menyampaikan imbauan perjalanan. Berkaitan dengan eksistensi hak berwisata (right to tourism) dalam kerangka HAM, kebijakan travel warning merupakan implementasi dari kewajiban negara untuk melindungi warga negaranya ketika mereka berada di luar negeri sekaligus merefleksikan tindakan negara untuk menjamin terpenuhinya hak-hak mendasar warga negaranya. Adapun pembatasan hak berwisata oleh negara sesungguhnya dilakukan dalam rangka menjamin terpenuhinya jenis HAM lain yang jauh lebih mendasar dibandingkan dengan pemenuhan hak berwisata yang justru masih dikategorikan sebagai HAM generasi ketiga dan eksistensinya masih diperdebatkan.The publication of travel warning by a country factually impacts the level of tourist visit to the destination country. This study aims to analyze the practice of countries, including Indonesia, in applying travel warning policy. In addition, also specifically will discuss the correlation between travel warning policy with the existence of rights of travel (right to tourism) within the framework of human rights (HAM). This type of research is juridical-normative which primarily analyzes Indonesian national legislation and relevant international instruments. The results of this study indicate that the practice of countries in the issuance of travel warning policy shows a relatively diverse variety, mainly related to the identification of risks and institutions authorized to deliver travel appeals. In relation to the existence of the right of tourism within the human rights framework, the travel warning policy is the implementation of the state’s obligation to protect its citizens while abroad while reflecting the state’s actions to ensure the fulfillment of the fundamental rights of its citizens. The limitation of travel rights by the state is actually done in order to guarantee the fulfillment of other types of human rights that are far more fundamental than the fulfillment of travel rights that are still categorized as third-generation human rights and its existence is still disputed.

Abstract

The development of human resources through closer cooperation in education and life-long learning is one of ASEAN purposes as stipulated in the Article 1 Paragraph (10) of the ASEAN Charter. In the Cha-am Hua Hin Declaration on Strengthening Cooperation on Education to Achieve an ASEAN Caring and Sharing Community, the Heads of State and Government of ASEAN agreed to give greater emphasis on the principles of democracy, respect for human rights and peace-oriented values in the school curriculum. Indeed, that is an important action to strengthen the role of education in building the ASEAN Community by 2015. One of the ASEAN’s inspirations which are represented in ASEAN’s 5-year Work Plan on Education (2010-2015) is to prepare the youth for regional leadership. Based on that background, the awareness on human rights through human rights education for the youth as ASEAN future leader is very important. This paper will discuss two main issues, which are (1) how the educational cooperation in ASEAN can promote the human rights awareness for the youth? ; and (2) how the common agreement on human rights education to guide awareness for the youth can be achieved by ASEAN member states? Related with those issues, this paper will also analyze the right to education as enshrined in ASEAN member states’ constitution and analyze the CRC and other human rights instruments. The main recommendation: the steps to achieve the common agreement on human rights education by ASEAN member states that will strengthen the ASEAN’s role in sustainable development to promote human rights in the region.

Abstract

It has been long recognized that public participation plays a vital role in dealing with spatial planning laws. However, mechanisms for the inclusion of public participation have been criticized worldwide for lacking the hallmarks of actual participation, as this trend has also occurred in Indonesia. This paper aimed to analyze the significance of public participation in Indonesia's spatial planning and whether the current Job Creation Law can solve the lack of public participation. There are no legal consequences or sanctions if the government fails to conduct public participation, while the Job Creation Law is regarded to encourage public participation by enabling the public to be actively involved in every stage of spatial planning. By employing normative research, this paper shows that the Job Creation Law reiterates the same flaws by neglecting the importance of legal consequences for not conducting public participation. The implementing regulation rests uncertainty that can reduce and discourage public participation. As the Job Creation Law was highly expected to cope with the issue, it cannot involve the public properly in spatial planning.Keywords: Job Creation Law, Spatial Planning, Public Participation.

Abstract

Indonesia was regarded to be the world's second-largest food loss and waste-producing country. Food waste contributes the most significant amount in Indonesia compared to other types of waste. This paper aims to discuss three legal issues. First, it identifies, in descriptive-normative means, the legal framework regulating food waste, which is the intersection of two legal regimes: 'the food management' and 'the waste and environmental management”. Second, it presents a comparative study by exploring the more advanced food waste legal frameworks, which take examples from Europe. The third objective is to recommend legal, institutional, and policy steps to mainstream food waste management in Indonesia. This paper suggests that statutory regulations have indicated an initial concern about food waste; however, they do not provide a strict mandatory obligation to relevant stakeholders. Indonesia may use Europe’s remarkable achievements as lessons learned in initiating a comprehensive legal framework for food waste in the future. This paper, therefore, proposes a Law on Sustainable Food System as an ius constituendum to figure out a comprehensive solution for combining food management and environmental sustainability needs. In terms of legislative drafting, an omnibus law seemed suitable for drafting such a law, which crosses different legal regimes, and the existing provisions are spread in various regulations.
