Abstract

answer the needs and interests of the community of legal certainty, as stated in the agreements, agreements and agreements made by the parties in the form of authentic deeds. The making of an authentic deed as a perfect proof and no further evidence is needed to strengthen the arguments in a legal case. Authentic deed consists of minuta deed and a copy of the deed. Minutes of deed are kept by a Notary who is part of the Notary protocol which must be kept and maintained by the notary because it is a state archive. Article 1 number 8 of the UUJN states that "Authentic Deed that is kept as a notary protocol is minuta deed, that is, the original deed which includes the signatures of the registrants, witnesses, and Notary that are kept as part of the notary protocol. Notary recipient of other notary protocols obliged to save this deed is not responsible for the contents of the deed of the notary protocol that it receives. The notary is obliged directly to the Notary protocol. The death of a Notary Public, in addition to leaving problems regarding work pending, of course, will also leave other problems related to the Notary protocol. Notary recipient of the Notary protocol is not the deed maker of the Notary protocol submitted to him. The notary recipient of the protocol can provide services to the client or the public by issuing a grosse deed, a copy of the deed and a citation of the deed of minuta deed which is part of the Notary protocol that has been submitted to him.

Abstract

Pembentukan Perda dalam rangka menjalankan semangat otonomi daerah saat ini telah mengalami peningkatan baik secara kualitas maupun kuantitas. Meningkatnya kualitas maupun kuantitas dianggap sebagai sesuatu yang positif dalam perkembangan pemerintahan di daerah. Namun pembentukan peraturan daerah oleh daerah otonom tetap saja harus dalam kerangka sistem perundang-undangan nasional, karena pada prinsipnya secara materil maupun formil Perda berada dalam satu kesatuan hukum nasional. Adanya otonomi daerah membuat pemerintah daerah Provinsi, Kabupaten/Kota berlomba-lomba membuat Perda, namun Perda yang dibentuk tersebut seringkali masih menimbulkan banyak permasalahan hingga terjadinya pembatalan. Melihat hal ini sebelum penetapan Perda, maka Rancangan Perda perlu dilakukan pengharmonisasian, pembulatan, dan pemantapan konsepsi Ranperda dan Rankaperda oleh Kanwil Kemenkumham. Permasalahan yang dibahas adalah (1) Wewenang Kanwil Kemenkumham dalam pengharmonisasian, pembulatan dan pemantapan konsepsi Ranperda dan Ranperkada selaras dengan prinsip-prinsip otonomi dalam hukum Pemerintahan Daerah yang berlaku saat ini (2) Pengharmonisasian, pembulatan dan pemantapan konsepsi Ranperda dan Ranperkada ditinjau dari perspektif Undang-Undang Dasar 1945. Metode penelitian yang digunakan adalah yuridis normatif, maka teknik pengumpulan data yang digunakan dalam penelitian ini bersifat studi kepustakaan namun juga didukung dengan data yang bersumber dari wawancara. Hasil yang diperoleh dari penelitian didapatkan kesimpulan (1) Keberadaan Undang-Undang Nomor 13 Tahun 2022 tentang tentang Pembentukan Peraturan Perundang-Undangan terkait perubahan mekanisme Harmonisasi Rancangan Perda yang sebelumnya dilakukan oleh Biro Hukum Pemerintahan Daerah dan kini diserahkan kepada Menteri Hukum dan Hak Asasi Manusia selaku perpanjangan tangan Pemerintah Pusat merupakan suatu bentuk kontrol atas norma. Penyelenggaraan Rancangan Perda melalui Harmonisasi oleh Pemerintah Pusat yang diamanatkan kepada Menteri Hukum dan Hak Asasi Manusia pada prinsipnya memang menggeser asas desentralisasi dan dekonsentrasi otonomi daerah, namun tidak menghilangkan prinsip-prinsip otonomi daerah itu sendiri dan justru menjamin kepastian hukum bagi masyarakat. Pengharmonisasian rancangan Perda pada hakekatnya melakukan penyelarasan materi muatan peraturan perundang-undangan dengan nilai-nilai yang terkandung dalam Pancasila dan UUDN RI Tahun 1945 dan berbagai peraturan perundang-undangan, baik secara vertikal maupun horizontal, konvensi/perjanjian internasional, serta kebijakan yang terkait dengan rancangan peraturan perundang-undangan tersebut sehingga menghasilkan peraturan perundang-undangan yang tidak saling bertentangan atau tumpang tindih.

Abstract

A grant of land rights is a gift from one person to another person without any compensation and is done voluntarily, without any contravention from the recipient of the gift and the gift takes place while the grantor is still alive. The act of granting land rights must be done before the PPAT with a Grant Deed is made which is the basis for registering land rights at the Regency/City Land Office. The problems that will be discussed in this research are first, what is the position of the grant deed in relation to the Supreme Court Decision Number 175/K/PDT/2021 in Papua, Second, what are the challenges in the Supreme Court Decision Number 175/K/PDT/2021. The aim of the research is to examine and analyze the position of grant deeds in the case of Supreme Court Decision Number 175/K/PDT/2021 in Papua and to study and analyze the challenges in Supreme Court Decision Number 175/K/PDT/2021 in Papua. This legal research is normative juridical research, namely normative juridical research referring to legal norms contained in laws and regulations and court decisions as well as legal norms that exist in society. The results of the research, the Land Deed Making Officer must put the grant agreement in the form of a PPAT deed, namely a grant deed as explained that every grant of land must be made with a PPAT deed as mentioned in Article 37 and Article 39 Paragraph 1 of Government Regulation Number 24 of 1997, making In the grant deed, it was seen that in the process of making the grant deed there were things that did not comply with the applicable regulations. Ms. Analyst Demotekay, who is the grant giver, said that she had never given the grant to Susilawati and there was no agreement between Ms. Analyst Demotekay and Martius Semuel Darinya, so this means that it can be suspected that there was engineering in this legal action on the part of the recipient of the grant. A series of legal cases involving fake grants, Mrs. Analis Demotekay and Martius Semuel, found that there was negligence and inaccuracy of PPAT Puspo Adi Cahayo S.H., M.Kn in making the Deed of Grant which resulted in the transfer of land rights to Susilawati's property.

Abstract

The President has the authority to determine the structure of the government under him as part of the President’s prerogative rights as regulated by Article 17 of the 1945 Constitution. Ironically, the Government and the House of Representatives insisted on changing the substance of Law No. 39 of 2008 concerning State Ministries through a swift amendment resulting in the enactment of Law No. 61 of 2024. One significant change in the new regulation is the removal of the limitation on the number of state ministries. It is necessary to examine how the constitutional mandate and the Law on State Ministries limit the president’s power in designing the cabinet posture in Indonesia. Second, what are the implications of unlimited presidential power in forming the cabinet posture from the administrative law and state finances perspective? This research uses normative juridical legal research with a descriptive nature and a prescription form. Based on the research, there are 4 (four) priority issues, first, the rise in the number of ministries will have an impact on the state budget’s ability to finance it, implications for the apparatus and infrastructure that will run government administration, further complicates the coordination function and authority between ministries, and the increasement is not in line with the government’s spirit to simplify the state institutions and regulations.

Abstract

This study examines the possibility of dissolving representative institutions within a presidential system, using parliamentary and semi-presidential practices as comparative references. It is motivated by the crisis of representation, marked by declining legislative quality, elite dominance, and eroding public trust. Two questions are addressed: (1) the grounds and mechanisms for dissolving representative institutions in parliamentary and semi-presidential systems, and (2) the prospects for such dissolution within a presidential system. Employing a normative juridical method with statutory, comparative, and conceptual approaches, this research not only describes existing legal norms but also critically evaluates the adequacy of constitutional design in responding to democratic crises, focusing on the relationship between political legitimacy, institutional design, and constitutional flexibility. The findings show that in parliamentary and semi-presidential systems, dissolution functions as an inherent corrective mechanism for resolving political deadlock and governmental crises, exercised through the authority of the head of state or government to dissolve parliament and return the mandate to the people through elections. By contrast, the presidential system's rigid separation of powers tends to preclude such mechanisms, potentially preserving dysfunctional institutions without effective correction an absence that may reflect constitutional stagnation rather than democratic stability. Accordingly, a limited and carefully regulated dissolution mechanism, introduced through referendum-based constitutional amendment or a democratic evaluation model grounded in popular sovereignty, warrants consideration to prevent representational distortion.

Abstract

The principle of meaningful participation constitutes an essential requirement in the formation of democratic legislation. The enactment of Law Number 3 of 2025 amending Law Number 34 of 2004 on the Indonesian National Armed Forces (TNI) has generated significant debate regarding the quality of public participation and the use of defense secrecy as a justification during the legislative process. This research focuses on the implementation of the principle of meaningful participation in the amendment of the TNI Law and its intersection with defense secrecy in the law-making process. This study employs a normative legal research method using statutory, conceptual, and case approaches. Primary and secondary legal materials are analyzed qualitatively to develop a comprehensive legal understanding of the issues examined. The findings reveal that public participation in the amendment process of the TNI Law did not fully satisfy the standards of meaningful participation established by the Constitutional Court, particularly concerning the rights to be heard (right to be heard), to be considered (right to be considered), and to receive explanations (right to be explained). Limited access to legislative documents and deliberative proceedings resulted in public involvement that was largely procedural rather than substantive. Furthermore, the invocation of defense secrecy during the legislative process extended beyond tactical and strategic military information to encompass matters of public policy that should remain open to public scrutiny. Such circumstances have the potential to restrict public participation, weaken the principle of civilian supremacy, and diminish the democratic legitimacy of the legislative process.
