Abstract

There were different orientation in the background and methods of ijthad between Bahtsul Masail Nahdlatul Ulama (NU) and Majelis Tarjih Muhammadiyah (The Muhammadiyah Legal Affairs Committee). The ijtihad orientation of Bahtsul Masail emphasizes on cultural approach to maintain the previous values that have been good, and take the new values better. This approach accepts local culture and wisdom as part of the past products that has no conflict with al-Qur’an and al-Hadith, or by changing the content of culture and local wisdom with Quranic and Sunnah content. This approach is different from the ijtihad orientation model developed by Majelis Tarjih Muhammadiyah called "tajdid". With this approach, Majelis Tarjih Muhammadiyah attempts to recover and purify Islam according to its original teachings. With its popular jargon "Back to the Qur'an and al-Sunnah" seeks to purify Islam from contamination of Takhayyul, Bid’ad (Heresy) and Churafat (TBC). The differences on ijtihad orientation between Bahtsul Masail NU and Majelis Tarjih Muhammadiyah had an impact on the difference of ijtihad methods used. The ijtihad method of Bahtsul Masail more conservative and walk to the progressive-moderate atmosphere by trying to adjust the changing of socio-cultural of community, through the use of ijtihad method Qouly, Ilhaqy, Taqriry, and Manhajy. While the ijtihad method used by Majelis Tarjih Muhammadiyah moves towards Progressive-Dynamic atmosphere by using contemporary ijtihad method like Bayani, ta'lili, and istishlahi with an interpretation approach At-tafsir al-ijtima'i al-mu'asir (hermeneutic), at-Tarikhiyah (historical), as-Susiulujiyyah (sociological) and; al-antrubulujiyyah (anthropological) and using ijtihad techniques Ijma', Qiyas, Masalih mursalah, and Urf.

Abstract

Sharia Supervisory Board has an important role to ensure that the business has been runin accordance with Islamic Sharia principles. In fact, there are several issues that led tothe supervision mechanism will not deliver as expected, so it can make sharia businessdeviated from the provisions of Islamic law . There are four problems that need to beaddressed so that the oversight of Sharia Supervisory Board mechanisms run optimally,namely: legislation, organization and management, human resources and performance, aswell as facilities and infrastructure. Therefore, the state, the Sharia Supervisory Board,business managers, and academicians, needs to be involved to create a good oversightmechanism on Sharia Supervisory Board.

Abstract

Hadith has an important position as the source of the second law after the Qur'an. It is often found that some of the hadith texts appear to conflict with each other either with the text of the hadith itself or the Qur'an. A person especially a hadith and / or legal expert needs to have the ability to complete the texts of the hadith or the Qur'an which sometimes seem to conflict with one another. The hadith about the deceased was tortured because of the crying of his family, is one example of a hadith that is contrary to the word of God that one cannot bear the guilt of others. With the approach of matan criticism (ilmnaqdal-matan), it is obtained that if the text of the hadith contradicts the Qur'anic texts, then the texts because of their qath'i values ​​must be prioritized. Meanwhile, if resolved using the science of mukhtalifal-hadīth, the conflict can be resolved through two ways, namely: First, through al-jam'u which is to compromise these two conflicting traditions, as practiced by Imam Bukhari who explained that the weeping that causes torture is a cry which is traditionalized and done with lamentation; Secondly, through superstitious means, namely maintaining textual understanding of hadith as understood by Umar and Ibn Umar and ignoring the history of Aisha's traditions, is that the deceased was tortured because of the crying of her family, or choosing the hadith as understood by Aisha by ignoring the understanding of Umar and Ibn Umar , as did the critics of Matan Hadith.
