Abstract

This study aims to identify and analyze the ratio legis of the principle that the Complete Systematic Land Registration (PTSL) program needs to be regulated and adhered to. Furthermore, this research also seeks to examine the legal consequences of the Complete Systematic Land Registration (PTSL) program. The awareness of the special position of land in the Indonesian national consciousness is also revealed in the Basic Agrarian Law (UUPA), which states the eternal relationship between the Indonesian people and the land. However, the term “controlled” in Article 33 of the 1945 Constitution does not imply that the state is the owner. The general explanation of the 1960 UUPA clarifies that the state (government) only controls the land. The meaning of land being “controlled” does not equate to “owned” but rather refers to certain authorities granted to the state as a power organization. Ownership of land rights must be proven by authentic or valid evidence in the form of a land rights certificate, where such certified ownership is an absolute requirement. Therefore, the Indonesian Government, through the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 6 of 2018 concerning Complete Systematic Land Registration, aims to facilitate the implementation of systematic and complete land registration as a government program. From this explanation, it can be concluded that the ratio legis of the Complete Systematic Land Registration (PTSL) program principle requires regulation and adherence to provide guarantees of legal certainty, transparency of information related to land parcels that can be utilized by legitimate parties, and ensure orderly administration in the field of land affairs, thereby delivering benefits and justice.

Abstract

The Village Funds are utilized to finance the administration of government, development, community empowerment, and societal activities, with the primary focus during this pandemic being on financing community development, empowerment, and Covid-19 response for rural areas. This practice is regulated by the Indonesian Minister of Finance Regulation Number 222/PMK.07/2020 and implemented with the principles of Good Governance. The research employs a juridical-normative research method to examine two legal issues: whether the reallocation of Village Funds (DD) for Covid-19 response complies with Good Governance principles, and the legal implications of relocating Village Funds (DD) for Covid-19 response if not in line with Good Governance principles. The research aims to analyze the compliance of the Village Funds' reallocation for Covid-19 response with Good Governance principles and evaluate the legal consequences if not adhered to. The findings indicate that the reallocation of Village Funds (DD) for Covid-19 response aligns with Good Governance principles. The usage of these funds for Covid-19 handling is regulated by Permendes No. 11/2019 concerning the Utilization of Village Funds 2020, along with various other regulations, including Perppu No. 1 of 2020, Perpres No. 54 of 2020, and PMK No. 40/PMK.07/2020. However, if the reallocation of Village Funds (DD) does not adhere to Good Governance principles, it may lead to serious legal consequences. In accordance with Permendagri No. 113 of 2014 concerning village financial management, misuse of Village Funds during the Covid-19 pandemic is prohibited and may result in administrative sanctions, such as verbal or written warnings, or even dismissal, in accordance with Law No. 31 of 1999.

Abstract

The ownership of Percaton Asta Tinggi land is governed similarly to other types of land ownership. If individual ownership is not recognized, the land is considered state property under the state's full control. This situation reflects a legal vacuum, creating ongoing issues due to the lack of a clear legal framework for ownership and authority over the land. This study examines the management, ownership, status, and authority concerning Percaton Asta Tinggi land. Findings reveal that the land is managed by the Somala Addition Foundation, with control entrusted to the guardians of Asta Tinggi as managers and custodians, as specified by a specific decree. The land is registered under a use-rights certificate, granting the foundation authority to manage the land based on the Regent's Decree. The decree restricts the land's purpose solely for management and benefit utilization, prohibiting personal ownership or sale. While land transfer registrations follow standard procedures, the registration of Percaton Asta Tinggi land is deemed invalid and nullified when intended for sale. This study underscores the need for a legal framework to address the specificities of managing and transferring rights over Percaton Asta Tinggi land.

Abstract

Dalam penelitian ini peneliti membahas mengenai perlindungan konsumen dalam transaksi jual beli melalui transaksi elektronik yang dimana dalam transaksi konvesional sangatlah berbeda dengan transaksi elektronik, sehigga dalam transaksi secara konvesional dalam pengaturannya kurang efekttif untuk diterapkan, belum adanya pengaturan mengenai subtansi perlindungan konsumen, dalam Undang Undang Perlindungan Konsumen belum menyesuaikan dengan perkembangan bentuk kontrak saat ini, yaitu negosiasi dalam berkontrak,standarliasasi berkontrak dan juga digital kontrak. Metode yang digunakan yaitu normatif dengan pendekatan perundang-undangan konsep dan juga pedekatan kasus. Hasil peneleitian tersebut yaitu mengenai upaya hukum terhadap pelaku usaha yang berwanprestasi dianalisis dari perundang-undangan yang berlaku mengenai macam macam upaya hukum yang diatur dan juga hasil penelitian tersebut juga menganalisis mengenai bentuk  tanggung gugat dari KUHPerdata dan juga Undang Undang Perlindungan Konsumen ..

Abstract

Berdasarkan Peraturan Pemerintah Nomor 65 Tahun 2015 Tentang Pedoman Pelaksanaan Diversi Dan Penanganan Anak yang Belum Berumur 12 (Dua Belas) Tahun menyatakan bahwa “Setiap Penyidik, Penuntut Umum, dan Hakim dalam memeriksa Anak wajib mengupayakan Diversi”. Namun berdasarkan pada konsep retoratif justice dalam hal anak yang berkonflik dengan hukum maka hukuan penjara bukanlah jalan yang terbaik bagi anak dan bagi anak yang pernah melakukan pengulangan tindak pidana baik yang sejenis maupun yang tidak. Dan mengacu pada rumusan kewenangan diskresi kepolisian merupakan kewenangan yang bersumber dari asas kewajiban umum kepolisian (plichtmatigheids beginsel), Kepolisian Negara Republik Indonesia berwenang untuk mengadakan tindakan lain menurut hukum yang bertanggung jawab” yakni melakukan diskresi kepolisian. Penelitian ini bersifat yuridis nomatif (legal research) menggunakan dua pendekatan yaitu Statute Approach dan Konseptual Approach yang menghasilkan bahwa Ratio legis dari diversi pada sistem peradilan anak yang melakukan pengulangan tindak pidana setidaknya mengacu pada Undang-Undang Nomor 11 Tahun 2012 bahwa Diversi diimplementasikan berdasarkan landasan restorative justice yang sangat memperhatikan hak-hak anak, untuk meminalisasi stigma, kekerasan, penghinaan, dan memisahkan ikatan social juga akan dapat mengurangi risiko pengulangan (residivis), dan membantu mengintegrasikan pelaku.

Abstract

Mata uang Rupiah merupakan alat pembayaran yang sah di wilayah kesatuan negara Indonesia. Setiap masyarakat atau orang yang berada di wilayah Indonesia wajib menggunakan rupiah sebagai alat pembayaran dan memenuhi kewajiban transaksi. Penelitian ini bertujuan untuk mengkaji dan menganalisis penggunaan alat pembayaran selain rupiah dalam transaksi keuangan di masyarakat serta menganalisis akibat hukum dari perjanjian penggunaan alat pembayaran selain rupiah. dalam transaksi keuangan. Kenyataannya, sebagian masyarakat tidak menggunakan mata uang rupiah sebagai alat pembayaran, seperti di pasar Muamalah Depok yang viral karena metode pembayaran atau transaksi keuangannya menggunakan dinar dan dirham. Suatu perjanjian jual beli yang tidak menggunakan mata uang rupiah sebagai alat pembayaran atau pemenuhan kewajiban-kewajiban lainnya, batal demi hukum karena tidak memenuhi salah satu syarat sahnya suatu perjanjian mengenai sebab halal, karena menggunakan mata uang asing. mata uang di wilayah Indonesia bertentangan dengan undang-undang nomor 7 tahun 2011 tentang mata uang. Akan tetapi, transaksi yang dilakukan oleh masyarakat dengan menggunakan alat pembayaran selain rupiah merupakan suatu kebiasaan yang tidak merugikan satu sama lain apabila memenuhi syarat sahnya suatu perjanjian sebagaimana tercantum dalam pasal 1320 KUHPerdata.
