Abstract

Electronic trials, also known as e-trials, represent a significant innovation in the judicial process by integrating technology into court proceedings. These trials utilize digital platforms to manage and conduct various aspects of the trial process, including the submission of evidence, witness testimonies, and legal arguments. However, the adoption of electronic trials also presents challenges that must be carefully considered. This study aims to determine the effectiveness of electronic trial in the jurisdiction of the Semarapura District Court Class II based on Perma Number 7 of 2022, and the obstacles experienced in its implementation. The research contributes to a deeper understanding of the challenges that courts may face in adopting such systems, thereby offering critical information that could inform future improvements and policy adjustments.

Abstract

In relation to trade, the government sees trade as a very important sector and the spearhead of industry. Without trade, the industrial sector would not run well. On the other hand, without industry, trade would also not be profitable enough to pursue. This research concludes as follows: The implementation of Regional Regulation Number 1 of 2016 concerning the Protection and Arrangement of Traditional Markets, Shopping Centers, and Modern Stores in Bangli Regency has not run optimally, this is due to legal factors, namely the Regional Regulation has not regulated concretely, the implementing apparatus, in this case, the Satpol PP has not dared to act decisively and last but not least the culture of the community has not been supportive, where people are still afraid to act if there are people's markets, shopping centers and supermarkets that violate the provisions and the apparatus is still waiting for superior orders, in this case, the Regent. Obstacles in the implementation of Regional Regulation Number 1 of 2016 concerning the Protection and Arrangement of Traditional Markets, Shopping Centers, and Modern Stores in Bangli Regency include: The legal factors themselves such as laws and regulations governing the arrangement of people's markets, shopping centers and supermarkets have not been implemented properly. Law enforcement factors such as the lack of alertness of officers in terms of taking action against traders who do not have a Trade License.

Abstract

Abstract : The purpose of this research is to provide knowledge and to study and analyze problems regarding notary leave arrangements in urgent situations which can only be carried out by the Notary's blood line family. This research uses normative legal research. Notary leave arrangements in urgent situations are determined in Article 28 UUJN, however there are multiple interpretations or unclear norms in the phrase "urgent circumstances: in the formulation of Article 28." So, based on these regulations, an urgent situation in Article 28 UUJN, if using a systematic interpretation, can be interpreted as an urgent situation if the Notary does not have the opportunity to apply for leave due to carrying out education and training, courses, work visits outside the region/country, illness, leave, fulfilling Hajj / Umrah or other similar reasons. The notary's responsibility if the notary's leave in an urgent situation cannot be fulfilled because he or she does not have a spouse or family member who is of the same blood line is administrative responsibility. If a Notary is in an urgent situation and does not have a husband/wife or blood family in a direct line to the Notary himself or even has blood relatives but is not legally competent to take legal action, then the Notary will not be able to submit a leave request to the Regional Supervisory Council. Notaries who do not apply for leave will be deemed not to have carried out their obligations in accordance with UUJN orders as stipulated in Article 27 jo. Article 28 UUJN, Notaries who wish to take leave must apply for leave. If the Notary violates the obligations and prohibitions of the position as well as the Notary's code of ethics, this can cause the Notary to be temporarily suspended as stipulated in Article 9 UUJN. Abstrak : Tujuan penelitian ini adalah guna memberikan pengetahuan dan guna mengkaji serta menganalisa permasalahan mengenai pengajuan permohonan cuti kepada Majelis Pengawas Daerah oleh Notaris dalam keadaan mendesak. Metode yang digunakan adalah metode penelitian normatif. Pengaturan cuti bagi Notaris di Indonesia di atur pada UUJN. Setiap Notaris memiliki hak untuk cuti, hak Cuti sebagaimana yang telah disebutkan dalam Pasal 25 UUJN. dapat diambil setelah Notaris menjalankan jabatanya selama 2 (dua) tahun. selama menjalankan cuti Notaris wajib mengusulkan Notaris pengganti. Kemudian, Pasal 26 menentukan selama menjalankan jabatanya, Notaris berhak mengambil cuti, yang dapat diambil setelah menjalankan tugas jabatanya selama 2 (dua) tahun. Jumlah keseluruhan cuti diambil Notaris tidak lebih dari 12 (dua belas) tahun. Sesuai dengan karakter jabatan Notaris yaitu harus berkesinambungan selama Notaris masih dalam masa jabatanya, maka Notaris yang bersangkutan wajib menunjuk Notaris pengganti. Kriteria keadaan mendesak dalam pengaturan hak cuti bagi seorang Notaris yakni terdapat pada pasal 28 UUJN menyebutkan bahwa dalam keadaan mendesak, suami/istri atau garis lurus dari Notaris dapat mengajukan permohonan Cuti kepada Majelis Pengawas. Penjelasan keadaan mendesak disini bahwa apabila seorang Notaris tidak mempunyai kesempatan untuk mengajukan permohonan cuti karena berhalangan sementara, berhalangan sementara apabila dilihat dalam UUJN tidak dijelaskan secara rinci bahkan dalam aturan pelaksanaanya juga tidak menjelaskan terkait dengan keadaan mendesak ini.

Abstract

Highlighting significant issues within the Indonesian legal system, particularly concerning the profession of advocates. After the enactment of Law Number 18 of 2003 concerning Advocates (the Advocate Law), the Indonesian Advocates Association (PERADI) was initially mandated as the sole organization authorized to appoint and swear in advocates. This was intended to create legal certainty and establish uniform standards for the legal profession. This situation has been complicated by varying court rulings, with some decisions recognizing the authority of organizations other than PERADI to appoint and swear in advocates, while others adhere to the Advocate Law, which exclusively grants this authority to PERADI. The diversity of court rulings reveals sharp differences in legal interpretation, leading to doubts about legal validity. This research aims to examine and analyze the legal certainty regarding which advocate organizations are authorized to carry out the appointment and swearing-in of advocates. The research employs a normative juridical approach. The findings suggest that any actions taken by advocate organizations other than PERADI, which appear to utilize one of the eight powers granted to PERADI by the Advocate Law, including proposing the Advocate Oath to the High Court, constitute unlawful acts that harm PERADI as the sole entity entitled to such authority. These actions can be subject to legal accountability in both criminal and civil domains. This research is expected to provide comprehensive recommendations for improving the advocate legal system in Indonesia.

Abstract

In Article 5 and Article 6 of the Regulation of the Chief of Police of the Republic of Indonesia Number 8 of 2021 concerning Handling Crimes Based on Restorative Justice, some conditions must be met for a case to be resolved through restorative justice. This regulation emphasizes that not all criminal acts can be resolved through restorative justice. Settlement through restorative justice is not necessarily able to eliminate or stop an investigation and/or investigation in the Police, especially against article 359 of the Criminal Code because legal norms are blurring. for example, in the case of the Ayuterra Resort Owner and the Contractor, can be interpreted as who is most responsible for the breaking of the elevator / Inclinator rope which caused the death of 5 (five) employees because in one criminal event, it is not possible that both can be used as Criminal Offenders. Abstract

Pemberian kredit oleh lembaga keuangan, termasuk Bank Perekonomian Rakyat (BPR), umumnya disertai dengan jaminan guna mengurangi risiko gagal bayar. Salah satu bentuk jaminan yang umum digunakan adalah jaminan fidusia, di mana objek jaminan tetap berada dalam penguasaan debitur. Namun, dalam praktiknya, sering terjadi permasalahan jika objek jaminan fidusia musnah dan tidak diasuransikan, khususnya ketika debitur wanprestasi. Penelitian ini bertujuan untuk menganalisis akibat hukum yang ditimbulkan dari musnahnya objek jaminan fidusia yang tidak diasuransikan terhadap perlindungan hak kreditur. Penelitian ini menggunakan metode deskriptif-analitis dengan pendekatan yuridis normatif yang didukung oleh data primer dan sekunder. Hasil penelitian menunjukkan bahwa musnahnya objek jaminan fidusia tanpa asuransi menyebabkan kreditur kehilangan hak eksekusi dan berubah statusnya menjadi kreditur konkuren. Dalam kondisi tersebut, debitur tetap bertanggung jawab penuh terhadap pelunasan utang, sesuai dengan asas tanggung jawab penuh atas perjanjian kredit yang diatur dalam KUHPerdata. Perlindungan hukum terhadap kreditur harus ditempuh melalui upaya represif, baik secara litigasi maupun non-litigasi, salah satunya dengan restrukturisasi kredit. Oleh karena itu, dibutuhkan peningkatan kehati-hatian kreditur dalam menyusun perjanjian kredit, termasuk keharusan asuransi atas objek jaminan fidusia.
