Abstract

As the world’s third largest democracy, Indonesia’s governmental system should ideally function as a government of the people, by the people, for the people, to borrow the famous words of Abraham Lincoln. In reality, the House of Representatives of the Republic of Indonesia, an institution which should best represent the nation’s people in carrying out its duty of drafting legislative products, still fails to do so, as it is dominated by men. Deep-rooted patriarchal beliefs cloud the nation, while inadequate and inefficient laws have also contributed to the present situation of low female representation in politics. This article therefore looks into the effectiveness various laws and regulations intended to protect women’s political rights. It assesses the effect of the low participation of women on the quality and gender-sensitivity of laws passed by the House of Representatives. It also evaluates the urgency to introduce affirmative action policies through the 1945 Constitution to increase women’s participation rates. The authors have used the normative-empirical method, consisting of a statutory, conceptual and comparative approach. Materials used for this research include interviews with prominent figures, analysis of the law and a comparative study. Through this approach, the article concludes that prevailing regulations in Indonesia require improvement, as there needs to be a shift from the present quota system to a system of reserved legislative seats in order to reap the benefits of equal participation.

Abstract

Pemilihan Umum Serentak lanjutan pada tahun 2024 merupakan pesta demokrasi terbesar yang akan dinikmati oleh masyarakat Indonesia. Salah satu pemilih adalah masyarakat hukum adat, dan diharapkan partisipasi memilihnya meningkat serta berintegritas. Selama ini partisipasi masyarakat adat tidak terlalu besar, hal ini menurut peneliti disebabkan karena ketidak tahuan masyarakat desa akan pentingnya pemilu bagi peningkatan kehidupan mereka. Bagaimana peran Ketua Masyarakat Hukum Adat mewujudkan pemilihan umum serentak yang bermartabat pada tahun 2024?; Kedua, Bagaimana korelasi Ketua Masyarakat Hukum Adat dengan masyarakat hukum adat untuk menghindari penurunan partisipasi masyarakat dalam pemilu? Data penelitian adalah data sekunder (penelitiankepustakaan), dan dianalisis secara kualitatif. Hasi penelitian pertama, Ketua Masyarakat Hukum Adat (MHA) memiliki peranan penting, Ketua MHA menjadi panutan Masyarakat Hukum Adat (MHA). Ketua MHA wajib untuk memberitahukan untuk memilih sesuai integritas, memperingatkan MHA bahwa MHA dapat dikenakan pemidanaan apabila menyebarkan berita bohong ataupun ujaran kebencian. Kedua, Ketua MHA dapat berpartisipasi untuk mengingatkan agar MHA menjadi pemilih dalam Pemilu Serentak pada tahun 2024. Kesimpulannya adalah masyarakat hukum adat seyogyanya memilih calon yang berintegritas pada pemilihan umum.

Abstract

Otonomi Daerah, as stated in UU No. 32/2004, is the right, authority, and obligation of autonomous regions to regulate and manage their own government affairs and the interests of local communities in accordance with statutory regulations. With regional autonomy, it is hoped that decentralisation that supports equity in terms of development and welfare can be realized. The ideal conditions that are expected with the implementation of regional autonomy are very far from the current reality One in particular is Banten Province, which departed from West Java Province since 2000 and whose poverty level has actually increased. This research was done to show that the ideal conditions that are expected with the implementation of regional autonomy are very far from the current reality. Report cards for new autonomous regions, including Banten Province, are still dominated by red numbers. Keyword: Regional autonomy, decentralization, participation and local elit Abstrak  Otonomi daerah sebagaimana tertuang dalam UU No. 32/2004 adalah hak, wewenang, dan kewajiban daerah otonom untuk mengatur dan mengurus sendiri urusan pemerintahan dan kepentingan masyarakat setempat sesuai dengan peraturan perundang-undangan. Dengan otonomi daerah, diharapkan desentralisasi yang mendukung pemerataan pembangunan dan kesejahteraan dapat terwujud. Kondisi ideal yang diharapkan dengan pelaksanaan otonomi daerah sangat jauh dari kenyataan saat ini Salah satunya adalah Provinsi Banten yang berangkat dari Provinsi Jawa Barat sejak tahun 2000 yang tingkat kemiskinannya justru meningkat. Studi ini dilakukan untuk menunjukkan kondisi ideal yang diharapkan dengan dilaksanakannya otonomi daerah nyatanya sangat jauh dari kenyataan saat ini. Raport untuk daerah otonom baru, khususnya Provinsi Banten, masih didominasi angka merah.

Abstract

Industri kosmetik mengalami perkembangan yang pesat karena kesadaran konsumen terhadap estetika dan kesehatan kulit. Akan tetapi, dibalik peningkatan ini terdapat juga tantangan terkait keamanan produk, terutama akibat penggunaan bahan kimia berbahaya yang tidak memenuhi standar. Dalam hal ini Uni Eropa menerapkan beberapa regulasi ketat yang terdiri dari Regulation (EC) No. 1223/2009, REACH, dan Scientific Committee on Consumer Safety (SCCS) untuk menjaminkan keamanan produk sebelum diedarkan dalam pasar. Disisi lain, Indonesia menerapkan sistem notifikasi dengan pengawasan administratif yang masih terbatas dari segi kapasitas laboratorium dan tenaga ahli. Penelitian ini membandingkan regulasi dari kedua negara tersebut dengan mengidentifikasi gap dan peluang harmonisasi. Adopsi model penilaian keamanan berbasis risiko (Cosmetic Product Safety Report) dari Uni Eropa dianggap penting dalam memperkuat perlindungan konsumen Indonesia di era globalisasi.

Abstract

This research aims to analyze the implementation of Smart Mobility as one of the key indicators of the Jakarta Smart City program to support sustainable development in the Province of DKI Jakarta. The study focuses on the application of Transit Oriented Development (TOD) and the operation of TransJakarta Electric Buses as concrete efforts to address traffic congestion and air pollution, which are major urban challenges. The research method employed is an empirical qualitative approach, relying on primary data obtained through interviews with relevant parties, as well as secondary data derived from legislation, official government documents, and academic literature. The research findings indicate that the development of TOD areas significantly contributes to improving public access to mass transportation and reducing dependence on private vehicles. Meanwhile, the use of TransJakarta Electric Buses represents an environmentally friendly transportation innovation that supports carbon emission reduction in DKI Jakarta, although it still faces obstacles in terms of fleet availability and investment. The implementation of this policy has shown positive impacts on shifting public behavior, as reflected in the increase of public transportation users from 18.86% in 2023 to 22.19% in 2024. However, there is still no definitive measurement of how much the policy has contributed to reducing air pollution levels. Therefore, periodic and comprehensive evaluations supported by accurate data are essential to ensure that this policy runs effectively and aligns with sustainable development goals. To realize a more environmentally friendly, sustainable and livable DKI Jakarta, collaboration between the government, private sector and the community is needed.
