Abstract

Marriage in society many occur without registration by the state, or known marriages have not been registered. According to The Domestic Affairs Minister Number 108 Year 2019 regarding the terms and regulations of the registration of the population and the civil record of married couples who have no record of marriage books can also record marriages in the occupational and civil record service by signing a waivement of marriage responsibilities. The purpose of this study is to find out the mechanisms and consequences of the law of issuing family cards for unregistered married couples using a letter of absolute liability based on The Domestic Affairs Minister Number 108 Year 2019. Research using normative juridical method with the nature of descriptive analysis research. The results of this study explain that violations ways to make a new family card for unregistered married couples must complete the requirements of filling the form F1.05 or A letter of absolute liability of marriage/divorce has not been registered and known by two witnesses and attaching a letter marriage has not been registered. Second, The legal result of publishing a family card for a married couple has not been recorded using a a letter of absolute liability based on Domestic affairs minister number 108 year 2019. In general, the increase in marriage practice has not been registered, Increased application for marriage books through the validation path, Increased demand for marriage confirmation, It also affects wife and children.

Abstract

Marriage is an inner birth bond between a woman and a man as contained in Article 1 of Law on Marriage. A marriage must be based on the agreement of both parties who will carry out the marriage without any coercion from any party. This is in line with the legal requirements of a marriage according to Article 1320 of the Civil Code. The form of agreement between the two parties can be referred to as a marriage promise or promise to carry out marriage, where the woman and man both agree to hold the marriage. The Marriage Law only regulates the terms and consequences arising from marriage, but there is no law that regulates the promise to hold a marriage. In case No. 146/PDT/2015/PT MKS, the Plaintiff and the Defendant had both agreed to hold the marriage, but the Defendant unilaterally postponed the agreed marriage. This has clearly caused both material and immaterial losses to the Plaintiff. The aggrieved Plaintiff then decided to file a lawsuit in court. Both the judges at the first instance and at the appellate level agreed that the marriage pledge case was an act of default. This is very different from Jurisprudence No. 3191 K / PDT / 1984 which states that non-fulfillment of marriage promises is an act against the law. In its concept, default and unlawful acts are two different things, but not infrequently when applied to a problem there is doubt in classifying it.

Abstract

Penyelesaian perkara melalui lembaga adat dilakukan dengan asas musyawarah atau kekeluargaan untuk menegakkan hukum, dan menghilangkan akibat lanjut dari suatu perkara. Tujuan tertinggi yang ingin dicapai adalah keseimbangan yang terwujud dalam kerukunan masyarakat. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan historis dan perundang-undangan terkait pembuktian dalam penyelesaian sengketa adat pada peradilan adat. Berdasarkan hasil penelitian diketahui Pembuktian dalam peradilan adat dilakukan oleh para pihak yang bersengketa dan peran aktif dari pemuka adat. Dalam peradilan adat penyelesaian sengketanya dilakukan secara damai, sehingga pembuktiannya ada yang dilakukan para pihak dan ada yang dilakukan oleh pemuka-pemuka adat yang memeriksa perkara. Alat bukti yang digunakan adalah alat bukti tertulis (surat), saksi, keterangan para pihak dan perilaku dari para pihak di tengah-tengah masyarakat.

Abstract

Minangkabau nature which has beauty, diversity of customs, the majority of which are Muslim, has beautiful nature, mountainous destinations and beautiful beaches, which are a halal tourist attraction in Indonesia in general, West Sumatra in particular. As the main destination for world tourists from other Islamic countries such as Malaysia, Dubai and others. Because West Sumatra is one of the halal tourist destinations, and the lowest government in West Sumatra is Nagari, it is interesting to study..This study uses a legal research method with an empirical/sociologicalapproach legal study(socio legal study) and normative (normative legal study ). The results of the study explain that the prospect of halal tourism that can be developed needs to be socialized to the City and Regency Governments and Nagari Nagari which have tourism potential. to be developed and managed by forming policy policies that are sourced from the Nagari Potential which will later give birth to policies that can contribute to Nagari PAD.

Abstract

Beda pendapat atau sengketa dalam konteks bisnis sering terjadi, dan Indonesia memiliki sebuah Lembaga penyelesaian sengketa alternatif yaitu Arbitrase. Menurut pendapat para ahli, Arbitrase merupakan salah satu cara penyelesaian sengketa yang melibatkan pihak-pihak yang bersengketa untuk sepakat dalam memilih hakim atau para hakim yang akan mengambil keputusan, dan para pihak juga harus sepakat untuk menghormati keputusan yang diambil oleh hakim tersebut. Hingga saat ini masih dominannya penyelesaian sengketa para pihak melalui peradilan (litigation) meskipun penyelesaian alternatif sengketa (non-litigation) sudah diatur melalui peraturan perundang-undangan. Implementasi Lembaga Arbitrase berdasarkan prinsip non-litigious minded sebagaimana penyelesaian sengketa secaramusyawarah dan mencari perdamaian para pihak sehingga meminimalisir permusuhan ataupun dendam dari para pihak bersengketa. Permasalahan penelitian ini adalah pertama, Bagaimana Pelaksanaan Penyelesaian Sengketa Bisnis melalui Arbitrase di Indonesia berdasarkan Prinsip Non-Litigious Minded. Kedua, Bagaimana Para pihak Menghormati Putusan Arbitrase Terhadap Penyelesaian Sengketa Bisnis. Penelitian ini menggunakan metode yuridis normative yang dimana menggunakan sumber data penelitian studi kepustakaan yang menggunakan sumber data sekunder seperti dokumen-dokumen resmi, buku, laporan penelitian, skripsi, tesis, disertasi, dan peraturan perundang-undangan yang berkaitan dengan objek penelitian yang sedang diteliti. Abstract

A good and healthy environment is a human right of every Indonesian citizen. The mandate of the 1945 Constitution is not obtained by citizens as they should. The proof is that high air pollution, such as air quality in some areas, causes environmental damage. As for the negative impact of air pollution, in addition to material losses, it also causes immaterial losses in poor air quality. Facing the occurrence of environmental damage due to air pollution in the city of Jakarta, citizens have the right to sue the government as state administrators who have neglected to protect the rights of their citizens, as regulated in Article 91 paragraph (1) and (2) of Law no. 32 of 2009. The results of this study are that the Citizen Lawsuit lawsuit becomes a forum for the community if they experience losses due to pollution and environmental damage. This Citizen Lawsuit lawsuit only asks for accountability for Government policies that result in losses for citizens, such as the lawsuit filed by the Optimistic Capital Coalition on Number 374/Pdt.G/2019/Pn.Jkt.Pst which was received by the Panel of Judges in 2021.

Abstract

In civil matters, the parties will not be separated from the legal relationship. The legal relationship itself arises when there are rights and obligations of the parties so that what is agreed can be achieved. The parties are given freedom to make a contract. The contract itself must meet both subjective and objective requirements. One of the subjective conditions, which is the agreement between the parties, must be based on the principle of freedom of contract. The basis of freedom of contract according to Article 1338 BW "All legally made agreements are legally binding on those who make them”. The purpose of Article 1338 BW is that the basis for the parties to carry out the contract must be equality, justice, honesty and truth. The meaning of freedom of contract does not mean that the law allows parties to deviate from legal regulations or immoral acts. The Draft Law or what is known as (RUU) Engagements is a draft sub-codification of the national engagement law which previously, sub-engagements were regulated in Book III BW/Perdata. A special codification of contract law regulates sharia contracts as a form of implementing cooperation or business agreements with sharia principles. Therefore, in this article the author will explore the principle of freedom of contract in sharia agreements in cooperation agreements between parties in society. This research is legal research (doctrinal research) with an analytical approach (analytical research), a statutory approach (statues approach), and a conceptual approach (conceptual approach). The formulation of the problem to be studied is as follows, first Basis of Freedom of Contract in Agreements, Second, Freedom of the parties in carrying out the agreement, and third, The application of the basic freedom of contract is reviewed from the sharia alliance. The results of the research explain firstly, freedom of contract in contractual relationships is the essence of individuals being able to carry out the agreements agreed to in the contract as long as they do not conflict with public order and legislation. Second, freedom of contract on a contract must be based on good faith (good faith) the parties and state their wishes (conduct) proportionally. Third, The application of freedom of contract in sharia agreements places greater emphasis on benefits for the benefit of the parties and is not merely individualistic.

Abstract

West Sumatra is a province that has undoubted delicious cuisine that has gone global and is known as Minangkabau cuisine. One of the famous Minangkabau dishes is Nasi Kapau. Nasi Kapau is a traditional dish originating from Nagari Kapau and has special processed products that are different from dishes in the Minangkabau realm. In Law Number 20 of 2016 concerning Brands, the role of Brands and Geographical Indications is very important, especially in maintaining healthy, fair business competition, protecting consumers, as well as protecting Micro, Small and Medium Enterprises and domestic industry. In fact, there are already several Nasi Kapau dishes that have been registered with the Ministry of Law and Human Rights, such as Nasi Kapau Uni Lis.  The potential for not carrying out an inventory or recording it will give rise to legal problems, namely legal disputes. Various cases that have occurred bothclaim"The ownership of intellectual property by other people or other countries causes cultural losses and even loss of commercial value. The results of this research explain that First, Registration of the trademark on Nasi Kapau is an effort to avoid recognition by other countries which violates the ownership of the owner of the processed product. Second, Registration of the Kapau rice brand as a form of preservation carried out by the Nagari Kapau community for the advancement of Minangkabau culture in Indonesia. Third, The government encourages the public to register processed products in the form of kapau rice through individual brands and communal brands in the form of nasi Padang licenses. It is advisable for the people of Nagari Kapau to register their processed Kapau rice products in the form of a patent as a form of intellectual property rights protection in the form of appreciating their work for the sake of community welfare and a healthy business climate.

Abstract

Pada Tahun 1999 Indonesia mengalami suatu krisis ekonomi salah satu penyebabnya adalah kegagalan atas penerapan corporate governance. Corporate governance merupakan suatu tata Kelola bagi jalannya suatu kegiatan industrial terutama perbankan. Pentingnya tata Kelola suatu industri perbankan untuk menciptakan suatu mengatasi masalah ekonomi sehingga tidak berdampak sistemik. Penerapan Corporate governance bagian dari budaya hukum dalam lingkungan bisnis sehingga perbankan dapat mempertanggungjawabkan kepada stakeholder maupun shareholder secara prinsip akuntabilitas dan responsibilitas. Penelitian ini menggunakan metode Yuridis Normatif (doctrinal research). Hasil penelitian ini menjelaskan bahwa Corporate governance memperhatikan keseimbangan kepentingan pihak-pihak yang terkait dalam suatu keberadaan perusahaan berdasarkan prinsip keterbukaan, keadilan, akuntabilitas dan pertanggungjawaban. Lalu, Budaya hukum dalam bidang perbankan mempengaruhui tata kelola perusahaan (Good Corporate Governance) dalam industri perbankan Indonesia. Faktor-faktor patrimonialism, family capitalism, crony capitalism, harus dicermati dalam penerapan corporate governance di Indonesia.

Abstract

Indemnity is a civil case, but damages can be pursued simultaneously with criminal cases when criminal law is applied. Although criminal law laws allow claims to incorporate damages in criminal cases, this type of case is rarely found in court as not all criminal cases can be sought for damages. This situation arises when the basis of the charges in a criminal case is an act committed by the accused. The study primarily utilizes a normative juridical approach, which entails studying existing problems based on applicable laws and regulations. In legal matters related to compensation, civil law is the governing jurisdiction. On the other hand, criminal matters are regulated by the Criminal Procedure Code. In cases involving both civil and criminal actions, the judge has the power to decide whether the compensation case should be merged with the criminal case. Based on the description provided, the paper will discuss the application of Article 98 of the Code of Criminal Procedure in compensating for unlawful acts under Article 1365 of the Civil Code. The paper will also explore the legal certainty of applying Article 98 of the Code of Criminal Procedure in compensating for unlawful acts under Article 1365 of the Civil Code.
