Abstract

President Jokowi signed the Law of the Republic of Indonesia No. 11 of 2020 on Job Creation (UU Cipta Kerja), but the Constitutional Court (MK) decided to conduct a judicial review. According to the Constitutional Court, the government must revise the Job Creation Law within two years. Two of the five petitioners for judicial review express concern about the Job Creation Law's inclusion of Specific Time Employee Agreements (PKWT). A Specific Time Employee Agreement is a contract between a business/employer and its employees for a specified period. The purpose of this study is to examine Specific Time Employee Agreements. This study employs a normative judicial methodology. The research is unique in discussing Specific Time Employee Agreements from two perspectives: the worker and the employer. Additionally, this research examines how Specific Time Employee Agreements have been implemented in practice thus far. The research concludes that workers lack understanding of Specific Time Employee Agreements, raising concerns about the Job Creation Law. The absence of a formulation regarding precarious work creates legal uncertainty for workers. Ineffective communication between the employer and employees has raised suspicions regarding the Specific Time Employee Agreement between the two parties. The Job Creation Law's socialization of labor cluster legislation requires improvement. To avoid misinterpretation, the definition of non-permanent work must be clarified

Abstract

Notarial documents are important legal evidence, but their validity depends on the fulfillment of the provisions of the UUJN, especially Article 16 paragraph (1) letter m. This research aims to analyze the legal consequences of notarial deeds that do not comply with the provisions of Article 16 paragraph (1) letter m of the UUJN, as well as understand the responsibilities of notaries in ensuring the validity of the documents they create. This research uses a doctrinal approach by analyzing legal norms through a literature review of relevant literature and legal sources. The main focus is on the legal consequences of notarial deeds that do not comply with the provisions of Article 16 paragraph (1) letter m of the UUJN. The research found that a notarial document that is not read and signed in the presence of the parties involved potentially loses its evidentiary power and is considered an underhand deed. Notaries are fully responsible for this mistake, which can result in administrative, civil and criminal sanctions. The obligation to read the deed orally by the notary is essential to ensure that all parties understand the contents of the document and agree to its terms. Violation of this obligation not only harms the parties involved but also undermines the integrity of the notary profession. The conclusion of this study confirms that the fulfillment of the provisions of Article 16 paragraph (1) letter m of the UUJN is mandatory to maintain the validity of notarial deeds.

Abstract

Terlepas dengan fungsi dari transportasi sebagai salah satu fasilitas yang membantu mobilitas masyarakat, terdapat juga kegunaan lainnya dari transportasi, yaitu sebagai salah satu faktor pendukung dari kegiatan perekonomian yang berjalan di Indonesia. Dalam pengangkutan penumpang pesawat, hubungan hukum ini bisa digolongkan sebagai hubungan pelaku usaha dan konsumen (contractual), oleh karena itu perjanjian antara konsumen dengan maskapai penerbangan yang dalam hal ini AirAsia dimulai pada saat konsumen membeli tiket pesawat. Atas dasar penelitian yang diamati dan diteliti, maka jenis penelitiannya adalah penelitian hukum normatif, di mana hukum dikonsepsikan sebagai apa yang tertulis dalam peraturan perundang-undangan (law in books) atau hukum yang dikonsepsikan sebagai suatu norma atau kaidah. Dengan demikian penulisan ini menghasilkan kesimpulan berupa, maskapai penerbangan di dalam menjalankan tanggung jawabnya harus dapat bersandarkan dan memperhatikan UUPK. Tidak hanya itu, apabila terjadi pembatalan penerbangan yang disebabkan oleh pihak maskapai, maka sebagai bentuk tanggung jawab atas tindakannya maskapai harus dapat memberikan itikad baik.

Abstract

Layanan transportasi online telah mengubah pola interaksi masyarakat dengan moda transportasi, membawa efisiensi serta integrasi digital melalui pemesanan berbasis aplikasi. Tiga aktor utama dalam layanan transportasi online: penyedia aplikasi, pengemudi, dan konsumen. Transportasi online seperti Gojek memfasilitasi mobilitas serta menawarkan berbagai fitur. Namun, kemudahan ini juga diiringi tantangan, termasuk permasalahan komunikasi antara pengemudi dan konsumen yang kadang bersifat tidak pantas. Penelitian ini menganalisis perlindungan konsumen dalam interaksi digital yang tidak pantas di layanan transportasi online, terutama dalam konteks pesan-pesan kasar yang menimbulkan ketidaknyamanan bagi konsumen, berdasarkan Undang-Undang Perlindungan Konsumen (UUPK) Nomor 8 Tahun 1999. Dengan metode penelitian hukum normatif, penelitian ini mengulas hak-hak konsumen yang dilindungi, seperti kenyamanan, keamanan, dan hak atas pengaduan.
