Abstract

Penelitian ini bertujuan untuk menelaah praktik penjualan pisang yang dilapisi cat pilox di Kecamatan Martubung, Kota Medan, yang berpotensi menimbulkan dampak serius dan merugikan kesehatan konsumen. Praktik tersebut secara nyata bertentangan dengan ketentuan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen yang menjamin hak konsumen atas keamanan, keselamatan, dan kenyamanan dalam mengonsumsi barang. Dari perspektif Maqashid Syari’ah, tindakan ini bertentangan dengan prinsip Hifz al-Nafs (menjaga jiwa) karena membahayakan kesehatan konsumen, serta Hifz al-Mal (menjaga harta) karena menimbulkan kerugian finansial akibat penipuan. Penelitian ini termasuk dalam jenis penelitian empiris dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Data dikumpulkan melalui wawancara, observasi, serta studi dokumen, kemudian diolah dan dianalisis dengan metode kualitatif. Hasil penelitian menunjukkan bahwa praktik tersebut mengandung unsur penipuan (tadlīs) yang dilarang, mencederai prinsip keadilan dalam muʿāmalah, serta bertentangan dengan ketentuan hukum positif dan hukum Islam. Oleh sebab itu, pengawasan yang lebih ketat sangat diperlukan.

Abstract

Penelitian ini dilatarbelakangi oleh masih ditemukannya praktik pemungutan biaya dalam pengurusan dokumen kependudukan yang seharusnya tidak dipungut biaya sebagaimana diatur dalam Pasal 79A Undang-Undang Nomor 24 Tahun 2013 tentang Administrasi Kependudukan. Penelitian ini bertujuan untuk menganalisis implementasi ketentuan tersebut serta mengkaji praktik pemungutan biaya dalam pengurusan Kartu Keluarga (KK) di Kelurahan Tanjung Leidong Kabupaten Labuhanbatu Utara dalam perspektif siyasah dusturiyah. Penelitian ini merupakan penelitian yuridis empiris dengan pendekatan studi kasus. Data diperoleh melalui wawancara mendalam, observasi lapangan, dan dokumentasi dengan melibatkan 8 informan yang terdiri dari 6 masyarakat dan 2 aparatur kelurahan. Data yang diperoleh kemudian dianalisis menggunakan teknik analisis kualitatif deskriptif, yaitu dengan menggambarkan dan menginterpretasikan data secara sistematis berdasarkan fakta di lapangan serta mengaitkannya dengan teori implementasi kebijakan publik. Hasil penelitian menunjukkan bahwa implementasi Pasal 79A belum berjalan secara optimal karena masih ditemukan praktik pemungutan biaya dengan dalih administrasi dan percepatan pelayanan. Faktor penyebabnya meliputi lemahnya pengawasan, budaya birokrasi yang permisif, keterbatasan sumber daya aparatur, serta rendahnya pemahaman masyarakat terhadap hak pelayanan gratis. Dalam perspektif siyasah dusturiyah, praktik tersebut bertentangan dengan prinsip amanah dan keadilan serta tidak sejalan dengan tujuan perlindungan harta (hifz al-mal), karena mengandung unsur penyalahgunaan wewenang dan merugikan masyarakat

Abstract

General Background The prolonged employment of honorary workers necessitates structural bureaucratic reorganization by late 2024. Specific Background To accommodate non-tenured staff, the state introduced the part time work agreement scheme. This system demands administrative compliance but lacks equitable guarantees for salaries and social security due to regional fiscal disparities. Knowledge Gap While previous literature evaluates statutory safeguards for contract workers, specific analysis regarding their remuneration rights through the Islamic jurisprudence lens remains unexplored. Aims This study investigates the statutory frameworks securing part time personnel remuneration amidst payment delays and evaluates these policies using the Maslahah Mursalah paradigm. Results Statutory analysis reveals regulatory voids, as current ministerial decrees lack definitive funding mechanisms. This deficiency causes widespread salary arrears across local authorities. The temporary utilization of educational assistance funds provides only short-term relief rather than structural resolution. Furthermore, the policy fulfills only partial necessities by granting formal employment status, yet fails to comprehensively secure the protection of wealth, life, and lineage. Novelty This research integrates positive state employment regulations with Islamic legal ethics to evaluate the substantive justice of flexible bureaucratic remuneration systems. Implications State authorities must formulate a comprehensive national regulation establishing binding financial mechanisms to guarantee timely compensation. Such measures are essential to fulfill constitutional mandates and Maqashid Syariah principles. Highlights: Current ministerial decrees exhibit normative voids causing widespread salary payment delays across regional institutions. The bureaucratic transition policy fails to fully secure fundamental Islamic principles regarding wealth and life protection. Establishing comprehensive national regulations with definitive funding mechanisms is essential to guarantee workers' financial rights. Abstract

The growth of e-commerce has made commercial transactions more convenient, but at the same time has opened the door to fraud through the sale of counterfeit products, which harms consumers. This situation raises questions regarding the characteristics of such fraud and the criminal liability of the perpetrators from the perspectives of Indonesian positive law and Islamic criminal law. This study aims to analyze the characteristics of fraud through the sale of counterfeit products in e-commerce transactions as well as the criminal liability of the perpetrators based on these two legal perspectives. This study employs a normative legal research method using a statutory approach, a conceptual approach, and a comparative approach. Primary, secondary, and tertiary legal materials were collected through a literature review and analyzed qualitatively using a descriptive-analytical method. The results of the study indicate that the characteristics of fraud are marked by the manipulation of product information, the use of misleading identities or attributes, deceitful tactics, and the intentional pursuit of profit that causes consumer harm. Under Indonesian positive law, perpetrators may be held criminally liable if they are proven to have fulfilled the elements of fraud as stipulated in Article 492 of Law No. 1 of 2023 on the Criminal Code and meet the requirements for criminal liability. From the perspective of Islamic criminal law, such acts contain the elements of ghish and tadlis and may be categorized as a ta’zir offense if committed intentionally by a legally accountable (mukallaf) perpetrator and result in harm. This study concludes that both perspectives converge in identifying intent, deception, and loss as the basis for liability, although they differ in the construction and mechanisms of their sanctions. Therefore, law enforcement against the sale of counterfeit products through e-commerce needs to be strengthened through digital evidence, oversight of electronic commerce, and consumer protection, while continuing to uphold the principles of justice and the public interest.
