Abstract

The Concept of Amânah in Informed Consent. The Appeal Decision of the Supreme Court of the Republic of Indonesia Number 365K/Pid/2012 granted the appeal request of Public Prosecutor of Manado State Public Prosecutor’s Office. The Supreme Court annulled the Manado State Court Decision that imposed 10 (ten) months criminal imprisonment to each defendant. The Indonesian Doctors Association argued that the contract between doctor and patient is a contract of process, not a contract of result. At the very least, this Appeal Decision provided an opportunity for legal experts to test and evaluate the concept of informed consent both philosophically and juridically. This paper argues that informed consent should be built on the framework of amânah which is an important concept in Islamic law.DOI: 10.15408/ajis.v14i1.1240

Abstract

The problem in this study is the law of consumer protection for unprofessional laptop service whether it is protected or not. This research was conducted at the Laptop Service Shop in the Village of Growth in the District of Wampu Langkat Regency. This research is a field research namely research conducted at the location which is the object of research, namely in the Village of the District of Wampu Langkat District and library research. In this study the method used was interview and data obtained from the field. The conclusion of this thesis is the Consumer Protection Law Against unprofessional laptop services in the Wahbah Az-Zuhaili Perspective is mandatory, and the one who is obliged to provide responsibility is the Shop Owner who is the guarantor. Because according to Wahbah Az-Zuhaili's perspective, if something guaranteed is in the form of al-inAin (goods, not debt), the guarantor is demanded to surrender the guaranteed al-inAin, if indeed the goods still exist. But if it has been damaged, then he surrenders instead with similar items or at a value. Article 19 paragraph (1) of Law Number 8 of 1999 concerning consumer protection clearly stipulates: "Business actors are responsible for providing compensation for damage, pollution and / or losses suffered by consumers due to consuming goods and / or services produced or traded.

Abstract

The purpose of comparing the implementation of halal certification in various countries is to compare the framework of international halal certification arrangements, as well as halal certification arrangements in Indonesia. This article compares the management of halal certification in Malaysia, Singapore, and Israel with the implementation of halal certification in Indonesia. In addition, it is related to international halal certification regulations (in certain countries), international halal certification bodies, international halal certification monitoring, and international halal certification law enforcement.

Abstract

Pembiayaan modal usaha berperan penting dalam meningkatkan perekonomian masyarakat. Pembiayaan disediakan oleh lembaga keuangan guna mempermudah pengusaha atau pebisnis untuk memperoleh modal dan tambahan dana untuk usahanya. Penyedia pembiayaan diharapkan mampu memfasilitasi pelaku-pelaku usaha untuk meningkatkan kualitas dan kuantitas produk usaha melalui pemberdayaan dana modal usaha ini. Lembaga pembiayaan terdiri dari lembaga pembiayaan syariah dan lembaga pembiayaan non syariah. Lembaga pembiayaan syariah menerapkan prinsip-prinsip syariah dan ketentuan hukum berdasarkan al-Qur’an dan hadis, berada dibawah naungan Otoritas Jasa Keuangan dan diawasi oleh Dewan Syariah Nasional (DSN-MUI). Pada hakikatnya pengajuan pembiayaan modal usaha diajukan oleh nasabah yang bersangkutan. Dengan memenuhi persyaratan-persyaratan yang ditetapkan oleh lembaga pembiayaan, maka setiap pelaku usaha dapat memperoleh pembiayaan modal usaha. Permasalahan yang terjadi ialah pihak ketiga hadir di luar perjanjian pembiayaan. Penggunaan pihak ketiga tanpa sepengetahuan pihak pertama pada pengajuan pembiayaan modal usaha ini berpotensi menimbulkan sejumlah risiko. Untuk itu penulis merasa perlu dilakukannya penelitian mengenai permasalahan ini berdasarkan pada teori Sadd al-dzari’ah, guna memperoleh titik terang dan kepastisan hukum dari permasalahan yang terjadi

Abstract

Penelitian ini merupakan penelitian kompratif antara hukum nasional dengan hukum Islam yang membahas tentang grant sultan sebagai bukti kepemilikan tanah di Kota Medan. Hasil penelitian ini adalah kedudukan grant sultan sebagai bukti kepemilikan menurut hukum nasioanal bahwa sertifikat grant sultan sebagai alas hak kepemilikan bukan sebagai alat bukti kepemilikan. Sedangkan dalam hukum Islam: bahwa sertifikat grant sultan sebagai bukti kepemilikan. Grant sultan sebagai bukti pemberian tanah melalui cara al-iqtha’ (pemberian), negara memberikan kepada rakyat mejadi sebab timbulnya hak kepemilikan, maka sertifikat grant sultan yang diberikan oleh pihak Kesultanan Melayu sebagai pemerintah pada saat sebelum kemerdekaan secara hukum Islam merupakan tindakan yang sah. Rekomendasi; agar tidak terjadi pertentangan antar hukum nasional dan hukum Islam, kepada Pemerintahan agar tidak melakukan penerbitan SHM oleh pemerintah diatas tanah yang orang lain yang dianggap memiliki grant sultan, sepanjang belum dilakukannya pendataan atas asal-usul dan keaslian grant sultan tersebut.

Abstract

This study uses a normative juridical research type that refers to law or legislation and other literature as literacy support. The research approach used is in the form of statutory and conceptual approaches to answer the problems being researched with primary legal sources in this study in the form of laws Law Number 8 of 1999 concerning Consumer Protection. The results of this study explain that there is a neglect of the theory of legal certainty in regulating health information on electronic cigarettes in Indonesia. This is because the regulation of electronic cigarettes until now is only contained in the Minister of Finance Regulation No.146/PMK.010/2017 concerning customs and excise rates only and is not accompanied by legality related to electronic cigarette health information, of course this regulatory vacuum is very contrary to guarantees on consumer rights contained in article 4 of Law no. 8 of 1999 namely the right to correct, clear and honest information about a product/goods. So it is very dangerous if consumers are essentially Indonesian people consuming goods whose health standards are unclear.

Abstract

Tanah publik ( public land ) dikuasai oleh negara dan dipergunakan sebesar-besarnya untuk kemakmuran rakyat. Tujuan penelitian ini untuk mengetahui bagaimana hukum mengelola lahan yang bukan hak milik. Pengelolaan tanah bukan hak milik tanpa izin merupakan tindakan ilegal yang melanggar hukum, baik dari perspektif hukum negara maupun hukum syariah. Tujuan penelitian ini mengeksplorasi permasalahan pengelolaan wisata alam ilegal di Desa Botung, Kabupaten Padang Lawas, Sumatera Utara, dengan fokus pada Persepktif Wahbah Az-zuhaili. Hasil penelitian menyoroti kompleksitas masalah tersebut dan perlunya mematuhi hukum yang mengatur hak atas tanah serta memperoleh izin dari pemerintah dalam pengelolaan sumber daya alam atau wisata alam. Konflik antara persepktif hukum negara dan syariah islam menjadi sorotan dalam penelitian ini. Solusi yang sesuai dengan hukum yang berlaku perlu ditemukan untuk memastikan pengelolaan sumber daya alam yang adil dan sesuai dengan hukum yang berlaku. Metode penelitian yang digunakan adalah metode penelitian yuridis empiris dengan pendekatan kualitatif.

Abstract

This research discusses how the law protects business actors from consumers who do not have good faith in carrying out their obligations in paying installments. So, this study aims to analyze, prove, and find value on the principle of default committed by consumers in cases between PT. SINARMAS MULTIFINANCE MEDAN BRANCH with its debtors in decision No. 688/Pdt.Sus-Bpsk/2018/PN Medan. Based on the objectives to be achieved, this study uses a normative juridical method using references from various books, journals, legislation, and other supporting literacy. The results of this study reveal that the agreement given by the consumer finance party regarding the rights and obligations imposed on the debtor is to pay instalments, if this obligation is not fulfilled then a subpoena can be given. If it is not fulfilled, then the goods that are used as objects can be withdrawn, as a result the debtor can lose the right to the goods, and the consumer finance party can terminate the agreement unilaterally. Finally, this study concludes that there has been an act of default by the debtor to the creditor. Furthermore, he found that the form of protection for consumer finance for motorized vehicles for consumer default, namely the agreement of substitution power for unit acquisition and the sale of fiduciary guarantees.

Abstract

ABSTRACTThis study intends to examine how online customer reviews and ratings affect purchase choices. Purposive sampling is used in this form of study to choose the sample, which might include as many as 96 Tokopedia customers who have made purchases there. It is associated with a quantitative approach. Primary data are the kind used. The information utilized was derived from the responses provided by the respondents to the questionnaires that were given out. Utilizing the SPSS 25 for Windows application, validity testing, reliability testing, traditional assumption testing, and hypothesis testing are the data analysis methodologies performed. The study's findings show that online customer reviews (X1) and online customer ratings (X2) have a substantial impact on purchase decisions (Y) at Tokopedia.Keywords: Online Customer Review, Online Customer Rating and Purchase Decision.
