Abstract

This article aims to analyse the practice of Hajj insurance at the Ministry of Religious Affairs of Banda Aceh City with a review according to Fatwa DSN-MUI Number 39 of 2002 concerning Hajj insurance. The role of the government in the management of Hajj insurance and the mechanism for submitting Hajj insurance claims are analysed. The problems in this study focus on how is the practice of Hajj insurance for pilgrims and the mechanism for submitting Hajj insurance claims at the Ministry of Religious Affairs of Banda Aceh City with relevance to the DSN-MUI Fatwa Number 39 of 2002 concerning Hajj Insurance Practices. The primary data is gathered from interviews and observations. While secondary data is obtained from the results of research related to this study. The results showed that, first, the insurance practice at the Ministry of Religious Affairs of Banda Aceh City is only limited as a facility provider who proposes to the Central Ministry of Religion Office as a policy holder, so that the insurance claim process occurs at the central level and can be confusing for pilgrims. Nevertheless, the Hajj insurance used by pilgrims is considered in accordance with Islamic teachings because it is sharia-based. Second, the mechanism for submitting insurance claims, families can apply for insurance to the provincial ministry of religion office which will then be submitted to the centre while carrying a number of requirements. Some of the requirements include a death certificate (SKK), a statement letter of heirs from the sub-district and the account number of the deceased or heirs. Third, in the review of the DSN-MUI fatwa No.39 of 2002 concerning Hajj insurance, the practice of Hajj insurance that occurs at the Ministry of Religious Affairs of Banda Aceh City is still less than optimal. Hajj pilgrims do not even know at all about the insurance claim process. Especially for pilgrims from the regions, the process of submitting claims is considered difficult to understand. In fact, the heirs of pilgrims often do not know how to submit insurance claims used by pilgrims, the absence of representatives from PT Asuransi Takaful Keluarga in the regions is also an obstacle in the process of submitting claims, so that the families of pilgrims face challenges in submitting claims with a long procedures.

Abstract

The purpose of the study carried out is to describe the implementation of hiwalah carried out in Islamic banking according to the DSN-MUI fatwa No.31/DSN-MUI/VI/2002 / regarding the transfer of debt which is generally closely related to hiwalah in hiwalah there are three parties involved, namely muhil, muhal, and muhal 'alaihi. The study method used in the study carried out is qualitative using the type of literature study (libarary research). Data is taken directly from primary data in the form of DSN-MUI fatwas and secondary data sourced from literature related to the discussion, namely books, scientific works in the form of journals and articles related to the research topic. The study findings indicate that if the transfer of debt from conventional financial institutions to Islamic financial institutions is carried out based on the DSN-MUI fatwa which explains about each alternative financing which is a series of contracts that are carried out, it has conformity and does not contradict the DSN-MUI fatwa No.31/DSN-MUI/VI/2002 regarding debt transfer. In practice, hiwalah is used in various Islamic financial transactions, for example in financing, investment, and risk management.

Abstract

The Authority of Customary Court Institutions in Settling Disputes through Customary Courts is one of the Alternatives in resolving disputes. Customary courts generally accommodate the interests of the disputing parties in the customary law area that applies both in civil law and criminal law that are resolved through customary courts are acts that violate Customary Norms. This study is related to customary court decisions that were not implemented in Lawe Sempilang Village, Lawe Alas District, Southeast Aceh Regency. This study aims to determine how the process of resolving customary disputes through customary justice: A study in Lawe Sempilang Village, Lawe Alas District, Southeast Aceh Regency. This type of research is empirical legal research (field research) research that studies phenomena in its natural environment with a sociological legal approach. Data collection techniques through interviews, observations and documentation. While the analysis technique uses qualitative descriptive methods. The results of the study indicate that customary justice has not been effectively used in Lawe Sempilang Village, Lawe Alas District, Southeast Aceh Regency with other required provisions in the form of replacement money/fines to perpetrators who are proven guilty and if the perpetrator is unable to pay, the victim can report to the police and sue in public court.

Abstract

Penelitian ini bertujuan untuk mengembangkan E-Modul berbantuan Web MIT App Inventor yang digunakan sebagai media pembelajaran pada mata pelajaran Sistem Kendali Elektronik di SMK Negeri 5 Padang. Metode yang digunakan pada penelitian ini adalah model 4D (Define, Design, Develop, Disseminate). Perancangan e-modul dimulai dengan melakukan beberapa analisis, setelah itu dilakukan perancangan desain awal e-modul untuk dilihat tingkat kevalidannya. Validasi dilakukan oleh 2 orang validator ahli materi dan 2 orang validator ahli media. E-Modul yang dinyatakan layak akan diuji untuk mengetahui respon pengguna melalui uji praktikalitas. Hasil dari penelitian pengembangan e-modul telah divalidasi oleh validator ahli materi dan validator ahli media. Hasil penilaian dari validator ahli materi sebesar 80.3 % dengan kategori sangat valid. Hasil penilaian dari validator ahli media sebesar 88.6 % dengan kriteria sangat valid. Hasil uji respon pengguna e-modul melalui uji praktikalitas kepada 20 orang siswa/i kelas XI TEI memperoleh hasil sebesar 86 % dengan kategori sangat praktis.Kata kunci : E-Modul, MIT App Inventor, Sistem Kendali Elektronik, 4DThis research aims to develop an E-Module assisted by Web MIT App Inventor which is used as a learning media in the Electronic Control System subject at SMK Negeri 5 Padang. The method used in this research is the 4D model (Define, Design, Develop, Disseminate). The design of the e-module begins with conducting several analyzes, after which the initial design of the e-module is carried out to see the level of validity. Validation was carried out by 2 material expert validators and 2 media expert validators. E-Modules that are declared feasible will be tested to determine user response through a practicality test. The results of the e-module development research have been validated by material expert validators and media expert validators. The assessment results from material expert validators amounted to 80.3% with a very valid category. The assessment results from media expert validators amounted to 88.6% with very valid criteria. The results of the e-module user response test through the practicality test to 20 students in class XI TEI obtained a result of 86% with a very practical category.Keywords: E-Modul, MIT App Inventor, Electronic Control System, 4D

Abstract

This study analyzes the validity of used goods auction practices through social media Facebook from the perspective of Islamic law, focusing on the existence of elements of gharar (unclarity) and tadlis (fraud). The author uses a qualitative research method with an empirical approach to understand social problems or human problems based on the creation of holistic images formed with words, reporting the views of informants in detail, and arranged in a scientific setting. Online auctions are a popular alternative to buying and selling, but often cause problems related to the clarity of goods and the transparency of the auction process. The practice of gharar is found in incomplete descriptions of goods, while tadlis occurs through price manipulation by sellers or auction participants. In Islamic law, the validity of an auction depends on the fulfillment of the pillars and conditions of buying and selling, including the clarity of the object, price, and honesty of the parties to the contract. This study emphasizes the importance of transparency, fairness, and openness in online auctions to ensure compliance with sharia principles, thus creating fair transactions and avoiding losses for the parties involved.
