Abstract

Tatanan masyarakat Muslim Nusantara terbangun karena adanya hubungan antara ekonomi, pendidikan, dan politik. Karena, sendi sendi kebudayaan atau tradisi suatu bangsa pada dasarnya dibangun melalui proses ekonomi-akumulasi modal, pendidikan-akumulasi pengetahuan dan politik-akumulasi kekuasaan yang berkuasa. Sisi lain, perkembangan ekonomi di Indonesia semakin berkembang, dengan dibuktikan banyak berdirinya lembaga keuangan syariah yang sudah menjadi sendi kehidupan ekonomi di Indonesia, meskipun pada prakteknya masih terdapat pada wilayah kota saja. Lembaga pendidikan, khususnya pesantren bisa mengambil peran untuk perkembangan ekonomi tersebut, dengan mendirikan lembaga keuangan di internal sendiri, dalam konteks ini dengan mendirikan Bank Mini Syariah, melalui kerjasama dengan perbankan syariah yang telah ada. Keberadaan Pesantren Nurul Jadid tak lepas dari konstruksi kemasyarakatan yang mencitakan suatu transendensi atas perjalanan historisitas sosial. Hal yang menjadi titik penting adalah kenyataan eksistensi pesantren sebagai salah satu pemicu terwujudnya kohesi sosial. Keniscayaan ini karena pesantren hadir terbuka dengan semangat kesederhanaan, kekeluargaan dan kepedulian sosial. Pesantren Nurul Jadid sangat berpeluang untuk mendirikan Bank Mini Syariah sebagai layanan ekonomi masyarakat pesantren serta menjadi laboratorium bagi berbagai jurusan yang berhubungan dengan keuangan, selain itu pesantren memiliki kekuatan aset keuangan dari masyarakat pesantren yang dikemudian hari menjadi nasabah

Abstract

seeing the needs of the people in this disruptive era, the legal assurance and protection of halal product is very urgent for this, in live with the existing probematics. Having the legality of halal certification can become a standard measure of product. So in this case the state acts as a supervisor by making certification a mandatory tool . The legality of halal certification provides assurance and protection in a disruptive era. If judging in the era of disruptive, the legality oh halal certification is very urgent in a product.. This resecrh uses the type of library research with data analysis techniques. The results show that the inalibility of consumers to evaluate this, si it requires an institution that has the qualifications to evaluate it. That institution will be entitled to certify a product. After this BPJPH has been formally legalized by the goverment, the authority to issue halal certfition is in the hand of BPJPH as the halal certification guarantor institution under the auspices of the ministry of religion. Abstract

The reform of ushul fiqh is perhaps the most significant achievement in the rebirth of Islamic philosophy. Only when people realize the phenomenon of stagnation of traditional fiqh can ushul fiqh be renewed. This awareness can only be built if people realize the need for reform of religious thought and practice it on a large scale. Many scholars propose a reconstruction of ushul fiqh, intending to show that religion can be used to solve everyday problems. Sheikh Ali Jum'ah, Izzudin Ibn Abdus Salam, and Ibn Ashur were prominent figures. Brilliant ideas and practical solutions seem to have entered the paradigm of Indonesian Islamic thought, especially the paradigm of ushul fiqh reform, which is still stagnant. Another weakness of fiqh and ushul fiqh is that there is no dynamic relationship between them and the social sciences, thus losing their relevance to the needs of the people. The mufti of Egypt, Sheikh Ali Jum'ah, also had the same view regarding the reformulation of Usul fiqh produced by previous scholars. So that Usul fiqh can be more developed and adaptive to new problems. Sheikh Ali Jum'ah's tajdid offer, namely: Restoring the old study form of ushul fiqh with an updated structure; Returning several views on several issues and using new opinions on existing problems, as well as reusing aqli in discussing these problems; Returning some views on the application of the rules to this science and in this application sticking to other views; Restoring this scientific structure by the novelty of the illat, and make this renewal according to the character of ushul fiqh according to their respective streams.

Abstract

in a marriage relationship, there will must be a conflict between husband and wife, this cannot be denied because each partner has a sectoral ego. The conflict can sometimes be resolved peacefully, but not the least that ends in divorce. The divorce process is arranged, must go through the trial process of the Religious Court with the specified procedural law. The proceedings for a lawsuit in the Religious Court must go through a mediation process between the two parties. Mediation is a way in the process of resolving disputes outside the trial in the presence of a third party tasked with reconciling the parties. Mediation is a mandate of the law to be carried out, so that the proceedings in court can be in accordance with the principle, which is fast, simple and inexpensive. The necessity of conducting mediation in a court, especially a religious court, is to reduce the number of divorces which is increasing in number over the years. Solving problems through mediation, is also a manifestation of maqashid al-shariah, namely hifdz al-nasl, because when there are problems in marriage, the marriage relationship will be damaged and problems will occur. Following up on the maqashid, in Indonesia there was a requirement to carry out mediation in the settlement of every case that went to court. The main objective is to minimize cases that must be decided, so that mediation can be resolved peacefully and safely. Keywords: Maqashid Al-Shariah, Mediation, Religious Court

Abstract

All forms of muamalah can be done unless evidence forbids it. In Islam, lending and borrowing are not prohibited. Even people who give debts or loans to other people who are in dire need are something that is liked or recommended because in it there is a great reward. The reality in society is that the financial transactions carried out are not by sharia values; this is evidenced by the absence of elements that must be found in the transaction, such as contracts and clarity of the price of goods. Most Indonesian occupation adherents of the Syafii madhhab, which in the sharia fiqh discourse, all transactions carried out must be based on a clear contract. Apart from that, the public has not been adequately educated regarding the urgency of sharia transactions in each economic activity because this is correlated with carrying out God's commands and religious values . In every sharia transaction, the contract agreement is made by the parties to be implemented/fulfilled together, not to be violated or ignored, because the contract agreement has a binding nature for the parties agreeing. Hence, the contract is a powerful tool and has an urgent position in every sharia transaction. The contract must be fulfilled and maintained as a joint commitment, and the contract is the primary reference in the event of a dispute. The dharuriyyah element in a sharia transaction can be found in Islamic values that must appear in every contract carried out by each individual; this shows the implementation of hifz al-din because carrying out religious orders related to a contract. So with the description above, the values of Islamic teachings contained in a contract or transaction that must be implemented are a form of maqashid al-shari'ah that must exist in the practice of muamalah.

Abstract

The Compilation of Islamic Law specifies that wills are only required for adopted children and their adoptive parents. The parties involved may petition the courts, even though these regulations are less binding. This research uses the type of normative legal research because what is examined in this research is the norm contained in the hadith texts related to the inheritance law above. The case approach is used as an approach in research because the case of inheritance of different religions that are discussed in a separate case within the family sphere, where there is no legal argument or norm that can answer the case above, so the case approach. The research results show that in Article 209 of the Kompilasi Hukum Islam (KHI), describe the law of Wasiat Wajibah. It cannot, therefore, be regarded contrary to Islamic law. Because leaving a bequest to an adopted kid or adoptive parent does not conflict with the general requirements of the Qur'an and the Prophet's Sunnah. The Cassation Decision No. 368 K/Ag/1995, issued 16 July 1998, marked the beginning of the practice of non-Muslim heirs obtaining a portion of the inheritance from Muslim heirs via Wasiat Wajibahs, which created a body of law within the Religious Courts. Non-Muslims inherit the same proportion of their Muslim parents' required bequests as other Muslim heirs. This necessary will is intended to preserve the integrity of the family and accommodate the multicultural, multiethnic, and multireligious nature of Indonesian society. In addition, implementing a sense of fairness is an advantage of this decision. Giving wills to non-Muslim spouses, children, parents, and relatives has contributed to the revival of Islamic law in Indonesia, demonstrating a sense of social fairness.

Abstract

Penelitian ini bertujuan untuk mengkaji tentang “Analisis Hak Ijbar Wali Terhadap Tindak Pidana Kekerasan Seksual (CSV)” dengan menggunakan metodologi penelitian normatif studi pustaka (Librari Research) yang menggunakan beberapa buku, jurnal, dan literatur-literatur lainnya sebagai objek utama untuk mendapatkan data mengenai hak ijbar dan CSV. Terbentuknya penegasan dan penetapan tindak pidana kekerasan seksual (CSV) dikarenakan banyaknya laporan terkait kekerasan yang dilakukan terhadap perempuan, baik diawali oleh ayahnya sendiri yang memaksakan putrinya melangsungkan perkawinan sampai pada kekerasan seksual yang dilakukan suaminya dikarenakan ketidak relaan istrinya untuk melayaninya yang disebabkan adanya paksaan perkawinan oleh ayahnya dan yang akan berakibat pada perceraian. Berdasarkan hasil penelitian tersebut hak ijbar perlu dikaji ulang oleh seorang ayah ataupun wali yang memiliki hak ijbar agar tidak salah dalam pengaplikasiannya dan harus mengetahui apa tujuan dari hak ijbar terhadap anak perempuannya. Karena banyaknya fenomena yang terjadi atas hak ijbar yang diberikan kepada ayah atau wali. Sehingga perlunya adanya penetapan hukum Terhadap Tindak Pidana Kekerasan Seksual (CSV) yang dilakukan pemerintah untuk mengurangi angka kekerasan yang dialami oleh perempuan terutama dalam pemaksaan perkawinan yang tentu akan berkemungkinan besar untuk mendapat kekerasan seksual dari suaminya dikarenakan enggan melayani.

Abstract

The occurrence of Marital Rape is due to a person who cannot withstand the turmoil of his passions without thinking about his partner who is still unable to serve because of some things that make him unwilling. This study aims to examine the “Analysis of Marital Rape Phenomena on the fulfillment of marital goals” by using a research methodology Literature study (Library Research) which uses several books, journals, and other literature as the main object to obtain data on Marital Rape. Based on the results of this study, Marital Rape should be avoided by someone who is married, because if the husband commits forced contact with his wife, it will have a bad impact such as hurting the wife either physically or psychically, the wife is afraid, the wife will be traumatized, there will also be less trust and affection of the wife towards the husband. Whereas in marriage there are several fulfillments and goals to be achieved by all couples such as the purpose of carrying out God’s commands and worship, Following the sunnah of Rosul, continuing heredity, and for psychological needs in the fulfillment of one’s sexual gratification needs. If Marital Rapeis performed by men then certainly in the family there will be no more harmony and there will be no achievement of the purpose of the execution of marriage.

Abstract

Marriage with teenagers under the age of 20 who are not ready to marry is known as "early marriage." Early marriage is seen as a way for teenagers to avoid sins, namely free sex, but there are also those who do it outside of marriage and become pregnant outside of marriage. This often happens in society. Therefore, Islam recommends kafaah in marriage in order to form a family that is sakinah mawaddah warahmah. Because it has a positive impact on the course of marriage, kafaah is considered a topic that must be considered when choosing a partner. Through the concept of kafaah, one can make balanced choices for oneself, allowing families to feel compatible with one another. This type of research uses a sociological approach in the field. The primary data source for this research is field data, which includes the results of interviews and observations. Meanwhile, secondary data sources were obtained from journal articles, theses, hadiths, and the Koran. The purpose of this study was to determine the effect of kafa'ah on the frequency of early marriage. Based on the findings of this study, there are several internal and external factors that encourage youth in Karang Melok Village to marry young. Internal factors include the need for love to meet one's needs. while external factors such as the existence of peers influence the implementation of marriage.

Abstract

This study aims to reduce the occurrence of marriage at an early age. This research uses a normative approach method by examining the results of previous researchers. Adolescence is an age that bridges between the ages of children and adults. In adolescence, there are many changes that are not easy for a child to deal with, of course, they need help and protection from parents and adults. The development in the era of technology, it is very easy for teenagers to fall into free struggle and not a few teenagers who choose to get married at an early age. In a relationship, marriage becomes a very natural thing to do without thinking about what will be faced afterwards. Many problems occur in a couple after marriage, especially at an early age, because there is no prior readiness. In mental readiness that is often underestimated can have a bad impact on family members. Divorce is often preceded by various conflicts caused by a lack of psychological readiness in the face of marriage. Therefore, researchers conducted research related to mental weakness in adolescence and what things need to be prepared before marriage so as not to bring harm to the family.
