Abstract

A disproportional understanding on wakaf assets, emphasising their immortality, cause people to give only non-moving things, mainly lands, as wakaf, while historically, Muslims also donated money or cash wakaf. This must become a common concern. Cash wakaf can be employed as an instrument to boost the economy of Muslim community through investments. It also supplements other philanthropic funds. Moreover, cash wakaf will provide a huge support to make non-moving wakaf assets more productive. Unused wakaf lands can be transformed into cash machines, using wakaf money, for example by making them cultivation areas, or to build factories, offices or a business center. By doing so, we do not need to depend on loans from foreign countries to alleviate poverty.

Abstract

The main focus of this research was analyzing the normative procedural decision of Sultan Adam Law which was applied by Sultan Adam during 1835 AD. Its emergence was for strengthening Islam Aqeedah for its believers and clinging on to Syafii Madhhab. Sultan Adam Law was remarkable to scrutinize, especially when associated with the modern law aspect. By employing the law history approach, this research attempted to respond to Sultan Adam Law procedural decision document issues which were associated with the modern law aspect. It could be seen through several sides such as political law, law substance, arrangement system as well as procedural aspect. The research also responded on how several factors explained Sultan Adam Law included in modern law. Based on the analysis result, it could be concluded that Sultan Adam Law was a written law decision which its existence in Banjarese people contained principles and legal norms as well as several procedural law decisions in a modern way. Although it was simple systematics which did not classify based on article and section, it contained several decision or principles and legal norms.

Abstract

Penelitian ini akan membahas mengenai metode penemuan hukum islam melalui pendekatan ushul. Dalam upaya menemukan hukum yang digali dari sumbernya, para pengali hukum Islam seyogianya bertitik tolak dari prinsip kemaslahatan dengan metode yang telah ditawarkan oleh para pendahulu yang ahli dibidangnya. Maka ditemukan metode maslahah, istihsan, pendekatan linguistik, dan metode kausasi.

Abstract

A dispute is a social problem thatdirectly in contact with the law and require solving integrally. Each order of society has various ways to get agreement in the proceedings or to resolve disputes among them. The People nowadays are starting to abandon habitual ways resorting to formal ways provided by law that are recognized by the state. There are various  kinds of way to dispute in the society that each has particular strengths and weaknesses, one of them is arbitration. Abstract

Abstract: Mediation in the settlement of divorce cases in the Religious Courts is a step that must be done. Mediation should be carried out directly face to face and in a closed room. However, due to the pandemic, mediation meetings were held online through long-distance audio visual communication. The implementation of online mediation in divorce cases can be done using audio visual communication in the form of zoom, google meet and Whatsapp.Although mediation meetings can be conducted through long-distance audio visual communication media, which allows all parties to see and hear each other directly and participate in meetings, due to network constraints and other reasons, mediation efforts cannot be maximized. Therefore, the important role of the mediator in carrying out the online mediation process is very necessary. Abstrak: Mediasi dalam penyelesaian perkara perceraian di Pengadilan Agama adalah merupakan tahapan yang harus dilakukan. Mediasi seyogyanya dilaksanakan secara langsung dengan tatap muka dan dalam satu ruangan tertutup. Namun karena adanya pandemi maka pertemuan mediasi pun dilaksanakan secara online melalui komunikasi audio visual jarak jauh. Pelaksanaan mediasi online dalam perkara perceraian dapat dilakukan dengan menggunakan komunikasi audio visual yang berupa zoom, google meet dan whatsapp.Meskipun pertemuan mediasi dapat dilakukan melalui media komunikasi audio visual jarak jauh yang memungkinkan semua pihak saling melihat dan mendengar secara langsung serta berpartisipasi dalam pertemuan Namun karena alasan terkendala jaringan dan lain lain, maka upaya mediasi  tidak bisa maksimal. Oleh karena itu peran penting mediator dalam melaksanakan proses mediasi on line ini sangat diperlukan.

Abstract

AbstractThe high number of early weddings in South Kalimantan, including both hand-arranged marriages and those performed formally with court-provided marriage dispensation services, is the subject of this study. to more thoroughly investigate the legal factors that South Kalimantan religious court judges take into account while handling cases of marriage dispensation. This study attempts to address the issue of early marriage in relation to the court's ability to grant dispensation from marriage as a requirement for legalizing marriage for those who have not reached the legal marriageable age through a constitutional approach, legal sociology, and legal anthropology. The review revealed that the majority of the dispensation petitions submitted had been approved. The judge uses procedural and substantive factors based on laws and regulations to decide the marriage dispensation case, taking into account the facts of the case while also paying attention to the fiqh and the guiding principles of Islamic law, which are derived from the verses of the Koran and hadith. Although there is a perception that judges are quick to grant requests or are thought to play a role in South Kalimantan's legalization of early marriage.AbstrakFokus kajian ini adalah mengenai tingginya pernikahan dini di Kalimantan Selatan baik yang dilakukan dibawah tangan maupun yang dilakukan scara resmi dengan fasilitas dispensasi kawin dari pengadilan. Untuk selanjutnya menelaah secara mendalam pertimbangan hukum hakim Pengadilan Agama di Kalimantan Selatan dalam memproses perkara dispensasi Kawin. Melalui pendekatan konstitusional dan pendekatan sosiologi hukum dan antropologi hukum penelitian ini  mencoba menjawab persoalan pernikahan dini dikaitkan dengan kewenangan pengadilan dalam memberikan dispensasi kawin sebagai syarat untuk melegalkan perkawinan bagi  mereka yang belum mencapai usia minimal kawin. Dari telaah yang dilakukan mendapatkan temuan bahwa sebagian besar permohonan dispensasi yang diajukan adalah dikabulkan. Hakim dalam memutus perkara dispensasi kawin didasarkan kepada fakta persidangan dengan menggunakan pertimbangan prosedural dan substansial yang di dasarkan peraturan perundangan dengan tetap memperhatikan prinsip Hukum Islam yang bersumber dari ayat ayat al Quran dan hadis serta kaidah kaidah fikih. Walaupun ada kesan hakim begitu gampang mengabulkan permohonan atau dianggap ikut terlibat dalam legalitas pernikahan dini di Kalimantan Selatan.

Abstract

The results of the creativity of judges in conducting legal discovery with various methods allow for decisions that contain legal discretion in order to realize progressive legal justice. The presence of discretion to correct all weaknesses, independence is very important in the aspect of legal sources. Through in-depth research using normative legal studies on several decisions of the Religious Courts in South Kalimantan, it was found that a form of free discretion was found when the judge in the purification of the inheritance gave part of the inheritance through the establishment of a mandatory will for the ex-wife and justified the use of the inheritance for the payment of the spirit ritual debt. Such discretion of judges is categorized as ideal discretion because it is very progressive, where judges not only use normative interpretation but rather use sociological interpretation and connect the law with humanity, and morality.

Abstract

Ihdad is a form of mourning carried out by families. The sharia mandates ihdad for women who have lost their husbands. There is no fiqh regarding ihdad for husbands. It often gives rise to the perception that there is a tendency to discriminate against women. However, customary law has regulations for mourning periods for husbands. This article aims to determine the relevance of Islamic law in regulating the mourning period for women and men with the value of protecting human rights. The research was carried out normatively by comparing shariah, positive legal regulations in Indonesia, notably the customs of the Banjar community, and regulations in Malaysia. The theories underlying this research include customary law theory, al-maslahah, and human rights protection. The results of this research illustrate that Islamic fiqh does not regulate ihdad for husbands. In Indonesia, KHI regulates the mourning period (ihdad) not only for wives but also for husbands. Meanwhile, in Malaysia, there is no ihdad for husbands, and the rules are explicit in the Enactment of the Islamic Family Law. The customary law of the Banjar community regulates the mourning period for the husband by not remarrying and not interfering with inheritance matters during the mourning period for a period of one hundred days. Customary laws that do not conflict with sharia and meet the requirements for implementing 'urf can be implemented. Ihdad is and will continue to be relevant to protecting human rights by prioritizing the values of maslahah and respect. The rules in Indonesia and Malaysia are based on Islamic law, considering religious and humanist values in the form of leniency.

Abstract

In Religious Courts, numerous cases within the sphere of absolute authority are not exclusively fortified by material legal sources through legislation. The ingenuity of judges becomes indispensable in extracting the essence of the law from various sources, including the rich tapestry of local cultural customs inherent within the community. The concept also leads to the emergence of cases decided through the discretionary methods employed by judges. Therefore, this study aimed to discuss the local cultural forms that served as points of reference for judges when exercising their discretion in rendering verdicts on inheritance disputes within the Religious Courts of South Kalimantan. The existence of judicial discretion in the decision-making process was unravelled, particularly when legal considerations aligned with the mandates of the heirs, emanating from the local culture of the Banjar people residing in the region. Furthermore, the translation of the heir's mandate, resembling a testament, exemplified the exercise of unrestrained discretion by the judges. Local culture was viewed as an indispensable component of the living law that pervaded society, with its ability to adapt and engage with the ever-changing landscape.

Abstract

Wedding dowries are typically given as gifts or assets of a specified value, such as money, gold, real estate, houses, automobiles, or other commodities. Couples are now creating bitcoin as a wedding dowry, in keeping with the times. The use of bitcoin as a dowry in marriage raises an interesting issue because it cannot be regarded as an object because it lacks a physical form and cannot be regarded as legal tender because it is not issued by the appropriate government. A literature review was the approach employed in this investigation. This study found that there are two opinions on the permissibility of bitcoin as a dowry, firstly bitcoin should not be used as a dowry in a marriage because of the element of gharar in bitcoin. The second opinion is that bitcoin can be used as a wedding dowry because there is regulation by the government, but it is an asset or commodity like gold that can be traded, and this bitcoin has a useful value according to the legal terms of the dowry.Mahar pernikahan pada umumnya berbentuk barang atau harta denominas itertentu, seperti uang tunai, emas, tanah, apartemen, mobil, atau barang berharga lainnya. Seiring dengan perkembangan zaman, terdapat pasangan yang menjadikan bitcoin sebagai mahar pernikahan. Bitcoin tidak dapat dikatakan sebagai barang karena tidak mempunyai bentuk fisik serta tidak bisa dikatakan sebagai uang yang sah karena tidak diterbitkan oleh otoritas yang berwenang, sehingga menjadi pertanyaan menarik terhadap penggunaan bitcoin sebagai mahar dalam pernikahan. Metode yang digunakan dalam penelitian ini adalah kajian pustaka. Penelitian ini menemukan bahwa ada dua pendapat kebolehan  bitcoin sebagai mahar, pertama bitcoin  tidak boleh digunakan sebagai mahar dalam pernikahan karena adanya unsurg harar dalam bitcoin. Pendapat kedua, bitcoin ini boleh digunakan sebagai mahar pernikahan karena sudah ada regulasi oleh pemerintah, namun sebagai aset atau komoditi layaknya emas yang dapat diperdagangkan, dan bitcoin ini memiliki nilai manfaat sesuai dengan syarat sah mahar.
