Abstract

Pemikiran mengenai penyelesaian di luar proses pengadilan dalam perkara TPLH melalui proses mediasi penal, merupakan hal yang relatif baru. Hal ini tidak terlepas dari pemahaman bahwa, karena peraturan perundang-undangan tidak mengatur adanya penyelesaian di luar proses pengadilan terhadap TPLH, maka terbentuklah pemahaman umum bahwa tidak ada pilihan lain, TPLH hanya dapat diselesaikan melalui pengadilan. Tujuan dari penelitian ini adalah bahwa adanya model mediasi penal ini yaitu merupakan alternatif penyelesaian perkara tindak pidana lingkungan hidup pada lahan basah di provinsi Kalimantan Selatan, yang secara substantial sejalan dengan hakikat perlindungan lingkungan hidup. Kebijakan mediasi penal sebagai salah satu alternatif penyelesaian perkara di bidang hukum pidana secara teoritis lebih efisien (dari segi biaya, tenaga dan waktu) serta memiliki potensi untuk bisa melahirkan kesepakatan yang win-win solution. Metode yang dilakukan untuk menyusun penelitian ini adalah penelitian hukum doktrinal. Penelitian hukum disini tidak semata-mata menelaah hukum sebagai kaidah perundang-undangan, tetapi juga menelaah bagaimana agar hukum berpengaruh positif dalam kehidupan masyarakat.

Abstract

Perkembangan teknologi digital mendorong pemerintah Indonesia melakukan transformasi administrasi pertanahan melalui penerapan sertipikat tanah elektronik sebagaimana diatur dalam Permen ATR/BPN No. 1 Tahun 2021. Kebijakan ini bertujuan meningkatkan efisiensi pelayanan, mencegah pemalsuan dokumen, dan memperkuat perlindungan hukum. Penelitian ini bertujuan untuk menganalisis kepastian hukum sertipikat tanah elektronik terhadap pinjaman yang tidak didaftarkan hak tanggungan serta mengevaluasi implikasi hukumnya. Metode penelitian menggunakan pendekatan hukum normatif dengan analisis preskriptif-analitis melalui studi kepustakaan, menggunakan bahan hukum primer, sekunder, dan perbandingan internasional dengan praktik di Belanda, Australia, dan Singapura. Hasil penelitian menunjukkan bahwa tidak didaftarkannya hak tanggungan menyebabkan hilangnya asas publisitas, kekuatan eksekutorial, dan hak preferen bagi kreditur. Penelitian ini merekomendasikan reformulasi regulasi pertanahan berbasis digital melalui harmonisasi UU Hak Tanggungan, Permen ATR/BPN, dan praktik perbankan, sehingga tercipta sistem administrasi pertanahan elektronik yang efisien, transparan, dan berkeadilan.

Abstract

The Indonesian Law No. 11 of 2012 concerning the Juvenile Criminal Justice Sistem (SPPA Law) established Diversion and Restorative Justice as core pillars for handling Children in Conflict with the Law (CICL). The Public Prosecutor (JPU) plays a mandatory role in attempting Diversion, as stated in Article 7(1) of the SPPA Law. However, the implementation of Diversion is hindered by judicial limitations, such as restrictions on crimes with a prison sentence of less than seven years and the lack of specific government regulations (PP). These barriers often deny children the opportunity for Diversion, exposing them to the formal justice process and stigmatization. This study analyzes the challenges within the JPU’s authority regarding Diversion and proposes legal reforms to strengthen their role. Using normative legal research and a conceptual approach, the study examines primary and secondary legal materials and suggests the implementation of a Digital Decision Support Sistem (DSS) to guide prosecutorial discretion. The findings reveal that restrictive penal criteria and the absence of a review mechanism for rejected Diversion cases undermine Restorative Justice efforts. The paper argues that legal reforms are necessary to revise penal limitations, develop a detailed regulatory framework, and implement an integrated information sistem to support rehabilitation programs, ensuring the best interests of children and reducing reoffending.

Abstract

The paradigm of the Indonesian criminal justice system is currently undergoing a significant shift from a retributive approach toward a restorative one. Criminal offenses resulting from negligence (culpa) present a unique case within this transition, as they lack malicious intent (mens rea in the form of dolus), yet often result in severe harm or loss of life. Despite its potential, the application of restorative justice for culpa offenses remains hindered by fragmented and sectoral regulations among law enforcement agencies, leading to legal uncertainty and inconsistent implementation. This research aims to analyze the urgency of restorative justice in negligence cases and proposes a model for its reconstruction. Using a normative juridical research method with statutory and conceptual approaches, this study examines existing regulations from the National Police, the Attorney General’s Office, and the Supreme Court. The findings indicate that the current framework requires a structural reconstruction through the synchronization of inter-institutional policies and the integration of restorative justice principles into the National Criminal Procedure Code (KUHAP). This reconstruction is essential to ensure a unified standard that balances legal certainty, the rehabilitation of the offender, and the restoration of the victim’s rights in unintentional crimes.

Abstract

Although the authority of notaries to provide legal counseling has been regulated in Article 15 paragraph (2) letter e of the Notary Office Law (UUJN), normative ambiguity regarding the definition, scope, and limits of this authority still gives rise to multiple interpretations and differences in practice. This study aims to analyze the ratio legis of this provision and its relevance to the social function of notaries as public officials. This study uses a normative legal method that is descriptive-analytical and prescriptive in nature, with statutory, conceptual, and historical approaches. Primary legal materials include the UUJN, the Advocate Law, and the Notary Code of Ethics, while secondary legal materials comprise relevant legal literature and scholarly journals. The results of the study show that the ratio legis of the authority of notaries to provide legal counseling is built upon three interrelated main pillars, namely philosophical, sociological, and juridical reasons. Philosophically, this authority reflects the implementation of the Pancasila rule-of-law state, preventive justice, and the principle of officium nobile. Sociologically, this authority is relevant to the low level of public legal awareness and limited access to advocate services. Juridically, legal counseling by notaries needs to be understood as an authority that is aligned with the main function of notaries and does not conflict with the regulation of the advocate profession. The conclusion of the study affirms that the authority to provide legal counseling is a manifestation of the social function of notaries as public officials, but the normative ambiguity in its regulation requires the formulation of clearer operational definitions and limits of authority. The implications of this study provide theoretical contributions to the development of notarial law as well as practical recommendations for the formulation of implementing regulations to ensure legal certainty for notaries and the public.
