Abstract

The dominance of political party chairmen in the process of formulating public policy in Indonesia indicates a serious problem in democratic practices. The common fact that every draft law discussed in parliament must be approved by the party chairmen indicates an excessive centralization of power in the hands of political party chairmen. This condition creates a paradox, where political parties, as a means of articulating and aggregating public interests, actually become instruments of the interests of a handful of elite parties. This study aims to determine the level of democracy within political parties and examine how to constitutionally limit the term of office of political party chairmen. This study uses a normative legal research method with a statute approach. The legal sources used are primary legal sources, namely legal materials that include provisions of applicable laws and regulations and secondary legal materials that support primary legal sources, namely scientific journals related to public office and justice. Data collection techniques use legal interpretation and are analyzed using analytical descriptive techniques. The results of this study indicate that the general chairperson of a political party still holds absolute power without adequate control mechanisms, including the absence of term limits which allows for the emergence of a prolonged political oligarchy. Reconstruction of the political party system can be carried out by conducting a judicial review of Article 23 paragraph (1) of the political party law or by revising the political party law organically through the legislative body

Abstract

Background. Food security is a critical issue in Indonesia, where the Navy possesses logistical infrastructure suitable for distribution but faces significant legal and institutional barriers. The Kodaeral v Surabaya case exemplifies legal ambiguities that limit the Navy’s involvement in non-traditional security sectors. Purpose. This study aims to analyze how existing legal frameworks can be restructured to formalize and integrate the Indonesian Navy’s role into the national food security strategy, especially during emergencies. Method. A qualitative approach was employed, combining the legal analysis of court rulings and policy documents with interviews with defense and food security experts. Results. The findings indicate that the absence of a formal legal mandate limits the Navy’s operational capacity in food security operations, despite its established logistical capabilities. Conclusion. Legal reforms are necessary to integrate the Navy into national resilience strategies, enabling a comprehensive approach that enhances their contribution to national welfare.

Abstract

Abstract. The North Natuna Sea is often the site of various threats to Indonesia's maritime sovereignty, including territorial violations by foreign vessels, illegal fishing, and unauthorized survey and exploration activities. These threats require a rapid, precise, and coordinated defense response to maintain regional stability. The Indonesian Navy (TNI AL) implements an adaptive defense strategy, utilizing routine patrols using warships and reconnaissance aircraft, technology-based surveillance such as radar and Vessel Monitoring System (VMS), and inter-agency coordination. This approach ensures that any incidents of violations can be detected early and responded to effectively. Qualitative analysis shows that the effectiveness of the TNI AL's defense depends on personnel readiness, strategic planning, and the involvement of coastal communities. The physical presence of the TNI AL in the waters, combined with scheduled patrols and rapid response, has a preventive effect on illegal activities. In addition, coordination with relevant agencies and the use of technology strengthen threat detection and mitigation capabilities, thereby maintaining the security of the border zone. The results of the study confirm that a holistic and responsive defense strategy is a key factor in maintaining the security and sovereignty of the North Natuna Sea. Adapting to the dynamics of threats and strengthening coordination between units enables the Indonesian Navy to maintain an effective presence, while also In addition, coordination with relevant agencies and the use of technology strengthen threat detection and mitigation capabilities, thereby maintaining security in the border zone. The results of the study confirm that a holistic and responsive defense strategy is a key factor in maintaining the security and sovereignty of the North Natuna Sea.
