Abstract

This paper discusses about Islamic organizations and its influence on the formation and development of Islamic law in Indonesia. The idea to incorporate Islamic law into the reality of the lives of the people of Indonesia is in line with the call for reform of Islamic law which arises in most Mulsim countries since the early twenty century. Institutional and constitutional reforms at the level of religious organizations such as Muhammadiyah, Nahdatul Ulama (NU), and the Islamic Union (Persis), which are often regardd as the modern movement of Islamic organizations in Indonesia.

Abstract

The issue of religious pluralism is important to share. Even it becomes primary factor in creating climate of stress or conflict of religion which not rarely come up with cruel colour, ossify, war and murder, even the race sweeping. Along with the time, religious pluralism which initially rose in the 18th century represents a discourse and expands in Europe; yet, in the 20th century it is expanding at full speed enter into Islamic world Mulsim and it became a theme in so many provocating discussion activities. In this article, the writer emphasizes that religious pluralism has to be clearly understood because it generates pros and contra among good thinker and religion figures, including Muslim figures. This matter is important to consider because the understanding of religious pluralism shall be reckoned because it deals with religious doctrine.

Abstract

Artikel ini mendiskusikan tentang Islam dan kebudayaa. Islam mempunyai dua aspek, yakni segi agama dan segi kebudayaan. Dengan demikian, ada agama Islam dan ada kebudayaan Islam. Dalam pandangan ilmiah, antara keduanya dapat dibedakan, tetapi dalam pandangan Islam sendiri tak mungkin dipisahkan. Antara yang kedua dan yang pertama membentuk integrasi. Demikian eratnya jalinan integrasinya, sehingga sering sukar mendudukkan suatu perkara, apakah agama atau kebudayaan. Misalnya nikah, talak, rujuk, dan waris. Dipandang dari kacamata kebudayaan, perkara-perkara itu masuk kebudayaan. Tetapi ketentuan-ketentuannya berasal dari Tuhan.

Abstract

In the context of Islamic law, the Jakarta Charter was seen as one of the result of the trial BPUPKI, a persuasive source. New Islamic Law becomes authoritative sources (sources of law has been legally binding) in the state administration, when the July 5 Presidential Decree 1959 which recognizes that animates the Jakarta Charter 1945. Islamic law as a legal order that guided and adhered to by the majority of the population and the people of Indonesia is both the law that has been living within the community. It has also become the part of the teachings and beliefs of Islam that exists in the national law as well as the source of guidance and development.
