Abstract

Indonesia mengenal hukum adat atau yang secara umum disebut living law, yang berfokus pada penerapannya di masyarakat, dan penerapan hukum erat kaitannya dengan sosiologi hukum. Tujuan penelitian ini untuk mengkaji peran sosiologi hukum terhadap ketaatan masyarakat maupun penegak hukum, terkait aturan lalu lintas. Penelitian  ini  merupakan  penelitian  yuridis normatif dengan perspektif sosiologi hukum yang bersinggungan langsung dengan realita masyarakat (penerapan hukum). Sosiologi hukum memiliki banyak instrumen, untuk mengantarkan pemahaman masyarakat maupun penegak hukum tentang perlunya mentaati peraturan hukum, tidak ada orang yang dengan sengaja ingin mengalami musibah yaitu kecelakaan lalu-lintas. Pengaturan hukum dalam lalu linta  tetap mengacu pemahaman hukum umum, yaitu peristiwa hukum yang merugikan seseorang, maka menimbulkan kewajiban dari pihak yang melakukan kesalahan untuk mengganti kerugian.  Maka didapati bahwa sosiologi hukum tidak dapat menghindarkan kewajiban pemenuhan terhadap penegakan hukum yang berkepastian; hambatan penerapan sosiologi hukum dalam penegakan hukum lalu lintas antara lain masih kurangnya sosialisasi dan edukasi pentingnya kesadaran/edukasi berlalu lintas kepada masyarakat (belum menjadi kebiasaann/ kepatuhan hukum).

Abstract

Government procurement of goods/services always changes in the context of presidential regulations (Perpres), by making these regulations complete and in more detail; In this case, it is certainly a positive development to provide legal protection for contracting parties in the form of goods/services procurement agreements. Agreement or akad (Arabic) which is interpreted as a bond or conclusion; Meanwhile, according to the term, a contract is a mutual agreement or commitment, whether verbal, signed or written, between two/more parties which has binding legal consequences to carry it out. This research analyzes the principle of freedom of contract and balance, which is a principle that is generally used as a reference, even though it seems that there has been a violation of this principle, legally the contract is still acceptable; On the legal side, there is a backbone in the field of civil law, but in its development it often overlaps with the field of criminal law (corruption), and in this research it is linked to Islamic law. The perspective of Islamic law has stated that in the context of civil law a broken promise is qualified as a group that betrays Allah SWT; Meanwhile, according to criminal law, corruption is contrary to the theory of benefit.

Abstract

It is inevitable that industry 4.0 has become a new phenomenon that makes human life very dependent on digital technology. Online media products are also increasingly mushrooming in their use which can positively help public activities in various sectors of life. Including the presence of social media which is currently very multifunctional, and can even provide quite promising financial benefits. This Community Service Activity aims to educate groups of housewives in Nitiprayan Village, Yogyakarta to be more productive and have a commitment to taking advantage of opportunities in the digital era. The method of implementing the activity is carried out in stages and face to face, namely: oral presentations, interactive discussions, simulations and special evaluations by the facilitator team. This activity was attended by 25 participants, which was held at the Nitibudoyo Studio, Nitiprayan Village, Bantul Regency, Yogyakarta. The superiority of local culture inherent in the activity location becomes capital that can be elaborated in the media activities of the partner group. Although the beneficiary group must still choose the most potential digital platform with their respective expertise. Simple ideas can in principle be created from habits that are often done at home. So that this activity is expected to answer the gap in access to the use of modern communication technology, especially those that are suspected to occur a lot among women. That way, issues related to the generation gap, especially in the use of gadgets and even adaptation to the latest trends which are inevitable, will be easier to overcome, even with the most enjoyable efforts. Activity participants gain new experiences to be able to directly practice creating content that can then be disseminated through their social media.

Abstract

The Covid-19 pandemic that has hit the world since early 2020 has had an impact on various aspects including the fields of communication and information. Several cases had ended  in the legal realm relate to the ITE Law. This research examines cases of fake and misleading news that are widespread in Indonesia, in 3 fields, namely Health, Government and General Elections. The urgency of fake news  related to consumer losses. Not all fake news causing consumer harm. What are the factors that delays in law enforcement for criminal acts of spreading false and misleading news related to the pandemic and what efforts should be made to deal with it? This research uses normative juridical methods with secondary legal materials; Criminal acts conected to spreading fake news are regulated in the qualifications of Article 35 of the ITE Law 11/2008, which places more emphasis on the phrase manipulation and destruction of information if the result arises, namely consumer losses, then Article 28 (1) of the ITE Law is imposed. Meanwhile, those that cause riots in society in general can be recognized as Article 28 (3).
