Abstract

The cabinet structure is one of the important instruments in government, because it determines the pattern of executive work and the implementation of public policy, so that the formation of the cabinet is the president's first step in realizing his vision and mission through several selected people who will be part of his government cabinet. This study aims to analyze the juridical aspects of changes in the cabinet structure of President Prabowo's administration and its impact on governance in Indonesia using normative juridical research methods with a statutory approach. The results show that changes in the cabinet structure by President Prabowo are the prerogative of the President as stipulated in Article 4 paragraph (1) and Article 17 paragraph (2) of the 1945 Constitution of the Republic of Indonesia and Article 15 of Law No. 61 of 2024 concerning Amendments to Law No. 39 of 2008 concerning State Ministries. In terms of impact, changes in the cabinet structure have major implications for governance, especially on the efficiency of governance, where these changes can have a positive impact or even a negative impact depending on the work of each institution in the cabinet formed by President Prabowo.

Abstract

The use of DPR oversight instruments such as the right to interrelate, questionnaires and express opinions is not always directly proportional to improving governance. The problem is, first, the monitoring instruments are often used as a means of exchanging political interests. In fact, this nation's energy has been very much depleted, both in terms of time and funds in the proposed monitoring instrument. Second, the implications of the implementation of the DPR's oversight function are no longer within the frame of checks and balances, but have turned into a kind of accountability forum and interfered with the President's prerogative. As a result, the practice of supervision within the frame of Indonesia's presidential system has led to the parliamentary system pendulum. This is indicated by the provision of Article 74 of Law Number 2 of 2018 which regulates that each party (including the President) must implement the DPR's recommendation. If the recommendation is not implemented by the President, then the Parliament can follow it up with the right of interpellation, questionnaire or expressing opinions. If those who do not implement the recommendation are officials within the scope of the Presidential institution, the President must impose sanctions on those concerned. This arrangement is considered to have interfered with the President's prerogative rights and is in conflict with the characteristics of Indonesia's presidential system. Therefore, it is time for DPR oversight to focus on the use of the legislative function and the budget function.

Abstract

Ketidakadilan akses terhadap peradilan di indoneia sering kali menimpa masyarak menengah bawah, yang menghadapi kendala finansial, pengetahuan hukum terbatas, serta bias sistemik.Lembaga Bantuan Hukum (LBH) hadir sebagai instrumen krusial untuk mengatasi hal tersebut melalui advokasi yang komprehensif. Penelitian ini bertujuan menganalisis peran LBH dalam menangani perkara-perkara seperti konflik agraria, hak buruh, dan pelanggaran HAM yang melibatkan kelompok rentan ini.Dengan metodologi kualitatif berbasis studi kasus dan wawancara semi-struktural terhadap 20 responden (termasuk advokat LBH dan klien dari wilayah urban-rural), penelitian mengidentifikasi bahwa LBH menerapkan pendekatan multifaset: dari konsultasi hukum gratis hingga litigasi strategis dan advokasi kebijakan.Temuan menunjukkan bahwa meskipun LBH menghadapi hambatan seperti defisit anggaran (hanya 30% kasus didanai penuh) dan intervensi eksternal, keberhasilan advokasi mencapai 65% melalui jaringan kolaboratif dengan LSM dan komunitas lokal. Lebih lanjut, LBH berkontribusi pada pemberdayaan jangka panjang dengan program literasi hukum, yang meningkatkan kesadaran masyarakat terhadap hak-haknya.Implikasi penelitian ini menyoroti urgensi penguatan regulasi pendanaan LBH oleh pemerintah untuk memastikan keadilan yang lebih merata, sekaligus mendorong LBH beradaptasi dengan teknologi digital guna memperluas jangkauan advokasi. Secara keseluruhan, LBH tidak hanya sebagai penyelamat hukum, melainkan katalisator perubahan sosial yang mendukung inklusi dalam penegakan hukum.

Abstract

Penetapan tersangka adalah salah satu tahap penting dalam proses penyelidikan tindak pidana, termasuk dalam kasus dugaan tindak pidana penggelapan yang terjadi dalam jabatan. Namun, seringkali penetapan tersangka menimbulkan kontroversi terkait kebenaran dan keabsahan prosedur hukum yang dijalankan aparat penegak hukum. Dalam konteks tersebut, praperadilan hadir sebagai mekanisme kontrol yudisial untuk memastikan perlindungan hak-hak tersangka serta menegakkan prinsip due process of law. Praperadilan memiliki peran strategis dalam mengawasi legalitas penetapan tersangka, sehingga dapat mencegah penyalahgunaan kewenangan dan menjamin kepastian hukum. Namun, terdapat kendala dan tantangan dalam implementasi praperadilan yang perlu dioptimalkan agar fungsi kontrol yudisial dapat berjalan efektif dan menjamin kepastian hukum dan perlindungan hukum asasi tersangka dalam kasus dugaan tindak pidana penggelapan dalam jabatan.

Abstract

The Merah Putih Village Cooperative (KDMP) is a flagship program of the Indonesian government formulated through Presidential Instruction Number 9 of 2025 concerning the Acceleration of Establishing Merah Putih Village/Urban Cooperatives. The presence of cooperatives is highly important for improving the welfare of Indonesian communities. This program has strategic objectives to strengthen village economies, provide business resources in every village/urban ward, enhance financial inclusion, and empower local communities. This study analyzes the legal regulatory aspects and their influence on the establishment of KDMP, identifies the challenges, and examines the regulatory framework governing the capital structure, supervision, and legal obstacles in the implementation of Merah Putih Cooperatives. The analysis shows that legal regulations provide a strong framework for the establishment and management of KDMP. Proper legal aspects serve as a vital foundation for the Merah Putih Village Cooperative. This research was conducted using a normative juridical approach through the study of regulations, government documents, and recent legal sources.

Abstract

This research illuminates the role and utilization of academic drafts (naskah akademik) in shaping regional laws (Perda) at the Medan City Government. This study seeks to ascertain the contribution of scholarly articles to enhancing the quality, legitimacy, and harmonization of regional law. Using a qualitative-descriptive approach and analysis of documents at the local level, such as local government reports, legal documents, and secondary data, this study finds that academic manuscripts serve as the scientific and legal basis for each step of the policy-making process. The results show that the Medan City Government, through cooperation with the DPRD and Kemenkumham, emphasizes manuscript hearings as a way to provide philosophical, sociological, and juridical justification for each bill. However, from the study, significant implementation bottlenecks have also been found, such as weak human resource capacity, weak institutional coordination, and insufficient public participation. This means that there is often duplication and delay in legal harmonization. For the successful implementation of regional legislation, governance needs to be promoted on the basis of preventive legal harmonization, capacity building, and participatory approaches. Therefore, academic papers should not just be perfunctory qualifications, but  tools of knowledge-based governance based on evidence, legality, and the people.
