Abstract

Upah menjadi tujuan utama setiap tenaga kerja, yaitu balas jasa yang didapat tenaga kerja dari pemberi kerja dalam hubungan kerja yang tertuang dalam suatu perjanjian kerja. Pemberi kerja dalam memberikan upah harus memperhatikan tiga aspek antara lain aspek teknis, aspek ekonomis dan aspek hukum. Semua aspek ini harus saling berkaitan dalam pemberian upah kepada tenaga kerja tidak satupun boleh dihilangkan. Dalam penelitian ini menggunakan metode yurudis empiris dengan mewawancarai beberapa tenaga kerja kontrak yang dibawa dari daerah luar Papua untuk di pekerjakan di Papua. Juga dengan menggunakan studi kepustakaan dengan menggunakan pendekatan dalam pengumpulan bahan, materi dan data yang berkaitan dangan pengupahan tenaga kerja. Hasil penelitian ini menyimpulkan bahwa apabila tenaga kerja yang digunakan pemberi kerja dari luar daerah tempat kerjanya misalnya dari daerah Sumatera ke Papua maka seharusnya pemberi kerja memberikan upah sesuai dengan ketentuan upah minimum daerah tempat tujuan kerja tenaga kerja tersebut. Sistem diperlukan agar penetapan upah berada di atas kebutuhan hidup minimum tenaga kerja. Pemberlakuan upah minimum melalui sistem pengupahan juga diarahkan untuk meningkatkan kesejahteraan tenaga kerja, meningkatkan produktivitas, dan mengupayakan pemerataan pendapatan dalam rangka menciptakan keadilan sosial.

Abstract

The rapid growth of micro, small, and medium enterprises (UMKM) in Papua requires legal literacy support to ensure business sustainability and access to formal financing. This community service program implemented legal entrepreneurship education at SMU YPPK Taruna Darma Kotaraja, Jayapura City, on May 12, 2023, targeting high school students as future entrepreneurs. Using participatory education methods, the program provided comprehensive understanding of business legality, Business Identification Number (NIB) procedures, and Online Single Submission (OSS) system. Results showed significant improvement in students' legal awareness, with 85% of participants demonstrating increased understanding of business establishment procedures and 78% expressing interest in legal entrepreneurship. The program addressed critical gaps in legal literacy, considering that 44 million of Indonesia's 65 million UMKM lack access to formal financing due to legality issues. Papua's MSMEs, totaling 151,470 units with only 2.7% having NIB certification, urgently need legal literacy intervention. This educational approach proves effective in preparing compliance-ready entrepreneurs while supporting Papua's 2026 export target and sustainable economic development goals.

Abstract

This article discusses the comparison between restorative and retributive criminal justice systems in resolving criminal cases in Indonesia. The background of this study is the growing urgency to implement a more humanistic criminal justice model that not only focuses on punishment or retaliation, but also emphasizes efforts to restore the losses of victims and achieve reconciliation between perpetrators, victims, and the community. This study aims to analyze the fundamental differences between the two approaches, assess their effectiveness in the Indonesian context, and identify challenges in their implementation. A qualitative approach is applied through literature review and policy analysis by examining legal regulations, law enforcement practices, and implementation experiences across various judicial institutions. The findings reveal that the retributive justice system remains dominant, particularly in cases involving serious and violent crimes. However, the restorative justice model has been increasingly introduced in minor offenses and complaint-based cases, especially through mechanisms such as mediation and community involvement. Restorative justice is found to offer greater potential in reducing recidivism rates, increasing victim satisfaction, and promoting long-term social harmony. Despite its advantages, the implementation of restorative justice in Indonesia still faces multiple challenges, including limited regulatory support, lack of public awareness, and resistance within legal institutions due to entrenched punitive mindsets. This study concludes that a balanced integration of restorative and retributive approaches is necessary, depending on the nature and severity of the crime. Strengthening the legal framework, enhancing institutional capacity, and promoting a cultural shift within law enforcement are crucial steps toward establishing restorative justice as a legitimate, humane, and sustainable alternative in Indonesia’s criminal justice system.

Abstract

Corporations as legal entities play a significant role in social, economic, and political dynamics. Alongside the increasing incidence of corporate crimes, the recognition of corporations as subjects of criminal law has become crucial. This study examines corporations as subjects of criminal law through a comparative analysis of Indonesia, the United States, and the Netherlands. The primary focus is on the differences in the concept of corporate criminal liability and the legal models applied. The research employs a normative juridical approach with a comparative study method. The findings reveal fundamental differences in the application of corporate criminal liability across the three countries, particularly regarding principles and forms of liability. The United States implements a more stringent principle of vicarious liability, the Netherlands has specific provisions in its Criminal Code (Wetboek van Strafrecht) that comprehensively accommodate corporate liability, whereas Indonesia still adopts a sectoral approach and lacks an integrated system. This study is expected to contribute to the strengthening of corporate criminal law policy in Indonesia.

Abstract

The enactment of the 2022 Criminal Code (KUHP) marks a milestone in reforming Indonesia’s national law, replacing the Dutch colonial legacy that has prevailed for over a century. Nevertheless, its effectiveness depends on the existence of procedural law as an implementing instrument, namely the 2025 Draft Criminal Procedure Code (RKUHAP), which is currently under discussion. Synchronization between the KUHP and the RKUHAP is essential since substantive and procedural law form a unified criminal law system. This study aims to analyze the synchronization of the 2025 RKUHAP with the KUHP, focusing on obstacles, normative inconsistencies, and the application of the principle of ultimum remedium. The method employed is normative juridical legal research with legislative, conceptual, and comparative approaches, complemented by case analysis. Research data consist of primary legal materials (KUHP, RKUHAP, and related regulations), secondary materials from academic literature, and tertiary supporting materials. The analysis is conducted qualitatively by identifying and interpreting norms, then testing them against doctrines and criminal law principles. Findings reveal three issues: obstacles from overlapping articles and different orientations, with RKUHAP remaining retributive while KUHP embraces restorative justice; normative inconsistencies in detention provisions that risk violating legality and fair trial principles; and inadequate reflection of ultimum remedium since minor and administrative offenses still tend toward criminalization. The study concludes that without proper synchronization, risks of legal disharmony and excessive criminalization may emerge, undermining human rights protection. Therefore, ultimum remedium must serve as the guiding principle in drafting the 2025 RKUHAP to ensure a fair, modern, and rights-oriented criminal law system in Indonesia.

Abstract

The transformation of the penal paradigm for children from a retributive to a rehabilitative approach through  the mechanism of diversion is a crucial component in realizing the best interests of the child within Indonesia’s juvenile justice system. Diversion not onlyoffers a more humane resolution to cases shielding children from the adverse impacts of formal litigation but also creates space for psychosocial recovery and social reintegration. However, its effectiveness in practice continues to face major challenges, includingthe limited awareness and capacity of law enforcement officers, insufficient victim participation, and the shortage of qualified facilitators such as community corrections officers. To address these issues, an integrative implementation model is required, onebased on multidisciplinary psychosocial assessment and involving the collaboration of legal authorities, correctional institutions, communities, andeducational entities. Furthermore, strong institutionaland policy support through thedevelopment of operational regulations, adequate budget allocations, continuous training, and a child-friendly legal culture is essential to ensure that the transformation of penal policy towards rehabilitation becomes a substantive reality rather than a merely normative aspiration

Abstract

This study examines the legal perspective on data privacy protection as a human right in Indonesia through a normative juridical approach. The increasing use of digital technology and the proliferation of personal data collection have intensified concerns over the misuse of personal information and inadequate legal safeguards. The research analyzes Indonesia’s constitutional provisions, statutory frameworks—including Law No. 27 of 2022 on Personal Data Protection (PDP Law)—and their alignment with international human rights instruments such as the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR). Findings indicate that Indonesia has made substantial progress in establishing a legal foundation for data privacy through the PDP Law, which emphasizes principles of consent, transparency, and accountability. However, implementation challenges remain, particularly in institutional enforcement, public awareness, and regulatory coordination. The study concludes that effective protection of data privacy requires not only strong legal frameworks but also a rights-based approach that upholds human dignity, ensures government accountability, and promotes digital justice in the information age.
