Praperadilan Sebagai Upaya Hukum Bagi Tersangka Purba, Tumian Lian Daya

Abstract

Prapradilan di Indonesia terinspirasi oleh hakim komisaris di negara Eropa. Pada dasarnya permohonan Praperadilan diajukan kepada pengadilan, bilamana ada hak-hak yang dilanggar. Hak untuk mengajukan Praperadilan dimiliki oleh tersangka atau korban, keluarganya, atau pihak lain yang diberi kuasa, penyidik dan penuntut umum, serta pihak ketiga. Objek tulisan ini terkait dengan Peranan praperadilan untuk melindungi hak-hak dari tersangka atau terdakwa dan peranan praperadilan muncul dalam rangka penegakan aturan yang ada untuk melindungi hak dari tersangka, dengan menggunakan metode yuridis normatif. Hasil penelitian menunjukkan upaya hukum melalui Praperadilan yang diajukan oleh tersangka/keluarga tersangka ditolak oleh hakim Praperadilan. Praperadilan yang terjadi di Pengadilan Negeri Kelas IA Jayapura yang menerima dan memutus inkracht praperadilan hanya 65% dari total kasus dari Tahun 2014 sampai dengan 2016 dan yang ditolak dan tidak diterima Praperadilannya 35% dari total kasus dari tahun 2014 sampai dengan 2016. Namun ada satu kasus praperadilan yang sama diajukan dalam tahun yang berbeda memiliki putusan hakim praperadilan yang berbeda, di tahun 2014 satu kasus praperadilan ditolak oleh hakim praperadilan namun dalam tahun 2015 kasus praperadilan diajukan kembali dan dapat diterima oleh hakim praperadilan dan diputus inkracht di tahun 2015. Hal ini dapat diperhatikan bahwa putusan hakim yang berbeda dalam kasus yang sama dalam kasus praperadilan dapat terjadi karena adanya perbedaan penafsiran yang terdapat dalam hakim praperadilan. Praperadilan yang tersedia dalam KUHAP dirasakan sudah tidak dapat lagi memenuhi rasa keadilan tersangka/keluarga tersangka. Dalam hal ini, Praperadilan harus tetap dipertahankan dengan hakim yang tidak bersifat tunggal, kedepannya Praperadilan harus bersifat hakim ad hoc yang terdiri dari hakim karier, akademisi, dan praktisi sehingga diharapkan oleh para pencari keadilan untuk tersangka/keluarga tersangka secara benar-benar terwujud melalui putusan-putusan hakim ad hoc dapt secara objektif dengan mempetimbangkan berbagai macam aspek.

Abstract

Dalam menjalankan fungsinya pemerintah atau penguasa setempat memerlukan dana. Dana yang diperlukan sebagai sumber penerimaan yang digunakan untuk membiayai pengeluaran itu salah satunya bersumber dari pungutan berupa pajak dari rakyatnya. Melalui adanya kesadaran masyarakat di bidang perpajakan akan mengakibatkan meningkatnya jumlah pembayaran pajak dalam suatu pemahaman yang mengarah kepada kewajiban dalam melaksanakan peraturan perundang-undangan perpajakan yang terus meningkat. Sebagai konsekuensinya semakin banyak jumlah potensi sengketa pajak yang terjadi. Penelitian ini dilakukan di Kantor Pelayanan Pajak Kota Jayapura dengan menggunakan metode penelitian yuridis normatif dan yuridis empiris. Hasil penelitian menunjukkan bahwa jenis-jenis ketetapan yang menjadi sengketa pajak adalah Surat Ketetapan Pajak Bayar Kurang (SKPBK) dan Surat Ketetapan Pajak Bayar Lebih (SKPBL). Sengketa pajak terjadi diakibatkan kurangnya pemahaman masyarakat wajib pajak tentang sistem self assessment dan juga tentang wajib pajak. Proses penyelesaian sengketa pajak yang dilakukan adalah pihak kantor pelayanan Jayapura yakni bagi wajib pajak yang kooperatif, akan diberikan reward berupa sanksi bunga, dengan cara mengangsur tunggakan. Sedangkan bagi penanggung pajak yang non kooperatif akan dikeluarkan himbauan berdasarkan surat edaran Dirjen Pajak No. 02. P.J.2000, dalam jangka waktu 3-4 bulan tidak menghiraukan juga himbauan ini maka akan digunakan cara penyelesaian dengan pasal 25 UU No.19 Tahun 2000 tentang Surat Paksa yaitu surat teguran dan surat paksa.

Abstract

PKM Law clinic formil in a marriage performed for the Distrik Sentani Timur on their Kampung Asei Kecil and Kampung Harapan Nolokla. Basically the province of Papua are still abnormally low level of community knowledge about the implementation of lawful matrimony according to the law number 1 of 1974 about the marriages. District of Sentani Timur still have higher rates of domestic violence is a to alamoth probably the treble because of the limited the knowledge of a community in protect of the rights. Peoples insight to which most of the work as farmers and fishermen .The people living in village’s Asei Kecil and village’s Harapan Nolokla a lot of do not know a result of not marriages between the single last year, so that an increasing number of households the proportion who experienced violence especially was happening in the wife who escorted them on. A virtuous and worthy wife do not have a marriage certificate will be more will be done to anyone in the law of national. Method in the implementation of the PKM this by means of talk and discussions with the purpose of open peoples insight about the importance of registration marriage, technical training and assistance directly involving an advocate, population and civil last, the board the customs and religious leaders local. The outer covering of PKM this is increase the amount of community awareness of the importance of the implementation of lawful matrimony according to legislative regulations, and the issuance of the marriage certificate, other the population documents namely family card, an identity card. Abstract

This service is carried out under the title of applying Anti-Corruption Education Science and Technology for the LETHO Regional Leadership Council organization, which was carried out on Friday, August 28 2020. Service within the LETHO Regional Leadership Council organization which is an observer of the work of the nation's children and a distributor of aid for disadvantaged areas, the Leadership Council The LETHO area of Jayapura City also oversees a clean and just government. This activity was carried out due to a lack of understanding about Anti-Corruption Education for the LETHO Regional Leadership Council organization due to the ignorance of organizational members who are very vulnerable to corruption, especially within the LETHO Regional Leadership Council in Jayapura City so that they have a better understanding and can take lessons from corruption cases that have occurred. has occurred and can take precautions in the future so that corruption does not continue to grow and become a culture, especially in Papua. The target of this service is an organization, by taking good steps and providing a better understanding of Anti-Corruption Education for the LETHO Regional Leadership Council organization as part of the community has a significant role in prevention efforts and is expected to be an agent of change and is expected to be able to has a character that is not permissive to corruption and subversive actions. Abstract

Devotion this was done in the title of the application of IPTEKS the act number 20 year 2001 on corruption eradication that was done on tuesday on 11 july 2017 in the vicinity of the candidates and the member of a Party City Hanura Jayapura and on wednesday, on 12 july 2017 who held at the candidates and the member of a Party District Keerom Hanura. Activity is done due to lack of understanding about the importance of conducting corruption eradication for candidates and party members in the neighborhood hanura party because of the ignorance the council of representatives and prospective members of representatives particularly dilingkungan hanura party leadership council branches and the city of jayapura leadership council district branch keerom have understanding for better and can take the lesson from from cases of corruption that has happened and can do prevention at a later date so that corruption not continue to grow and become culture particularly in papua province. Abstract

This service will be carried out under the title Application of Science and Technology Use of Information Technology and Electronic Transaction Information Law at YPPK Taruna Darma Kotaraja High School, activities that will be carried out to partners due to lack of student knowledge about the use of information technology and Electronic Transaction Information Laws, which now have many children students are not wise in using information technology media and do not violate the law through social media. The obstacle is that students do not understand and master the use of information technology and the Electronic Transaction Information Law so that with the expertise possessed by servants, they can implement the science and technology. The method of implementing this service is carried out by applying science and technology and providing assistance to partners. Abstract

This study examines the role of evidence in proving intent in murder cases within the criminal justice system. Intent is an element in distinguishing between different types of homicide, such as premeditated murder and manslaughter. The complexity of proving intent is influenced by the types of evidence available, including direct, circumstantial, forensic, and testimonial evidence. Direct evidence, such as confessions or eyewitness testimony, is the most definitive but is often unavailable, making circumstantial evidence essential in many cases. Forensic evidence, particularly autopsy results, provides significant insights into whether the actions were deliberate or accidental. Motive also plays an important role in strengthening the case for intent, offering contextual understanding of the perpetrator's reasons for committing the crime. Witness testimony, although important, requires careful evaluation to ensure its reliability. Psychological factors, such as emotional distress or provocation, can further complicate proving intent, as they may reduce the level of premeditation and influence the legal classification of the crime. This paper argues that proving intent in murder cases requires a comprehensive approach that integrates multiple forms of evidence to ensure accurate legal outcomes and fair justice.

Abstract

This research, entitled Legal Analysis of Bank Accounts with Children's Names as Customers , was carried out at several Jayapura City Bank branches. The methods used in this research are normative juridical and empirical juridical . The problem of this research is how children as customers can be said to be competent according to the legal rules of agreements related to opening bank savings accounts; Then, is it worth continuing to open an account with a child as a customer as an offer that is in accordance with the subjective requirements of the depositor? So this needs to be researched because there are still banking products that offer savings to child customers . It is hoped that this research can provide input to banks regarding their savings product offerings and knowledge for the people of Jayapura City . There is no uniformity in Indonesian law, the age limit for adult children is determined by the child's actions. One way to protect parties (child customers) who are not yet able to realize their actions and the extent of the legal consequences of their actions is to limit their ability to act.

Abstract

Artikel ini memaparkan hasil kegiatan pengabdian kepada masyarakat yang bertujuan meningkatkan literasi digital dan keterampilan sehat bermedia sosial pada generasi muda di Kota Jayapura, Papua. Program ini dilaksanakan sebagai respons terhadap meningkatnya kasus cyberbullying di Papua yang diperburuk dengan kesenjangan digital dan keterbatasan akses terhadap edukasi media sosial. Metode yang digunakan meliputi penyuluhan, pelatihan keterampilan praktis, pembentukan peer support group, dan kampanye media sosial positif yang disesuaikan dengan konteks budaya lokal. Sebanyak 215 peserta yang terdiri dari siswa, SMA di Kota Jayapura terlibat dalam program ini. Hasil evaluasi menunjukkan peningkatan signifikan dalam pemahaman tentang cyberbullying, kesadaran tentang dampaknya dan keterampilan dalam mengidentifikasi serta mengatasi cyberbullying. Pembahasan hasil mengungkapkan bahwa pendekatan yang mempertimbangkan kearifan lokal dan melibatkan tokoh masyarakat adat terbukti efektif dalam konteks Papua. Implikasi dari program ini adalah perlunya pengembangan model literasi digital yang kontekstual dengan mempertimbangkan karakteristik sosio-kultural masyarakat setempat.

Abstract

This paper examines the application of restorative justice in cases of juvenile homicide under Indonesian law, focusing specifically on a case study involving the murder of a child in Subang, as reviewed in Subang District Court Decision Number 1/Pid.Sus-Anak/2025/PN Sng. The study uses a normative juridical approach to analyze the feasibility of applying restorative justice principles in such serious criminal cases, particularly those involving minors. The Indonesian Criminal Code (KUHP), Law on the Juvenile Court (UUPA), and restorative justice frameworks are explored in relation to the case. The paper discusses the role of the offender's age, mental state, and the victim’s family's involvement in the restorative process, highlighting both the potential benefits and challenges of implementing restorative justice in juvenile homicide cases. The findings suggest that while restorative justice can be a rehabilitative tool for juvenile offenders, its application in cases involving serious offenses like murder is complex and requires careful consideration of the emotional impact on the victim’s family, the offender’s potential for reform, and societal expectations for justice. The paper concludes by recommending further exploration of restorative justice as part of broader juvenile justice reforms in Indonesia.
