Abstract

Pawning fields in Risa and Kalampa Villages, Woha District, Bima Regency, West Nusa Tenggara Province is a debt agreement between the pawner and the recipient of the pawn. Pawning rice fields have been going on for a long time and have become a local community tradition because it is considered to have social value. This study aims to determine and determine the law of the practice of pawning from the perspective of 'urf. This research is descriptive qualitative with a normative sociological approach. The results showed that first, the practice of pawning the fields in Risa and Kalampa villages is a debt agreement between the rain (pawner) and curtain (pawn recipient) in which the pawnbroker (rahin) will provide a guarantee in the form of rice fields to the pawn recipient (murtahin). Second, if viewed from the perspective of 'urf, this practice of pawning belongs to the category of 'urf, which is faced (damaged) because the recipient of the pawn (murtahin) does not ask for permission either verbally or in writing to the pawner (rahin) regarding the management of rice fields that are used as collateral for the debt. In the sharia economic literature, the practice of pawning fields like this is included in the category of usury because they get property in a vanity way, namely, in addition to the recipient of the pawn (murtahin) getting their money back, there is also an attempt to exploit the collateral field belonging to the pawner (rahin) in order to get multiple benefits.

Abstract

The purpose of this research is to analyze the exchange of virtual cryptocurrency money with real rupiah money from the perspective of sharia economic law. Currently there is a lot of money in virtual form, one of which is bitcoin. The emergence of this type of virtual money is proof of one of the latest technological advances. Bitcoin has been widely used by several countries and even makes it a transaction tool. Cryptocurrency is becoming a booming trend as a new investment opportunity. Not even a few believe that crypto becomes an attraction because it is considered to have different characteristics in solving expenses without using a third party. Some of the provisions in the exchange contract between the same and different currencies, namely exchanging money with similar types such as rupiah with Rupiah and must be done in cash, if different currencies such as Rupiah and Dollar must also be in cash, if the exchange occurs between money and commodities, the most important thing is agreement between the seller and the buyer. Cryptocurrency (Bitcoin) is legal to use for people who accept and acknowledge it, but MUI and OJK do not allow it as a commodity and similarly BI does not allow it as a legal transaction tool to be used in Indonesia because it is considered not to meet the requirements as a currency like Rupiah. and in the perspective of sharia economic law that cryptocurrency (Bitcoin) is an object or object that is not allowed (haram).

Abstract

Globally, the COVID-19 pandemic has affected changing in the decline in the worldeconomy, including the Islamic banking industry, but the performance of BPRS stillshows a positive direction. Therefore, this study is interested in discussing theimplementation of sharia compliance in murabahah contracts at BPRS Dana AmanahSurakarta murabahah which is one of the most widely applied types of contracts inIslamic banking financing activities and the impact of the pandemic on murabahahcontracts. The purpose of this study is to examine sharia compliance in theimplementation of murabahah contracts and the impact of the pandemic on murabahahcontracts at BPRS Dana Amanah Surakarta. This research is a field research with aninterpretive approach. Data analysis in this study uses content analysis which analyzesthe main sources of research in the form of interview data and contract documentsrelated to murabahah at BPRS Dana Amanah Surakarta. The conclusion is that thereare two kinds of murabahah financing: Sindication and non sindication. And there aaretwo kinds of murabaha contracts, namely the murabahah bil wa'ad lil syira contract andthe murabahah bi wakalah contract. In the murabahah bil wakalah contract, there aretwo schemes, the first is direct payment to the supplier and the second is paymentthrough the customer's account. Sharia compliance in the murabahah contract is inaccordance with sharia and the DSN-MUI fatwa, there is only a slight difference in theapplication of the second scheme of murabahah bil wakalah with the DSN-MUI fatwa.

Abstract

Tujuan dari penelitian ini adalah untuk mengungkap bagaimana penerapan strategi mengatasi moral hazard nasabah dengan instrumen ta’zir dan ta’widh pada bank syariah. Metode yang digunakan adalah jenis penelitian kualitatif dengan sumber data dari kepustakaan, diantaranya fatwa nomor 17/DSN-MUI/IX/2000 dan fatwa nomor 43/DSN-MUI/VIII/2004, pendekatannya menggunakan deskriptif analisis, semua hasil penelitian akan dideskripsikan dan disajikan dalam bentuk laporan penelitian. Hasil penelitian menunjukkan bahwa ta’zir dan ta’widh merupakan instrumen preventif yang lahir untuk mengantisipasi terjadinya moral hazard nasabah terhadap perjanjian kontrak dengan perbankan dan bertujuan untuk mendisiplinkan nasabah agar dapat memenuhi prestasi yang dijanjikan, di mana ta’zir merupakan sejumlah hukuman yang ditetapkan di awal akad, pasti, dan dana ditetapkan sebagai dana sosial. Sedangkan ta’widh berupa ganti rugi yang ditetapkan oleh bank, tidak ditentukan di awal akad, akan tetapi dihitung berdasarkan kerugian instan yang dialami bank dan dana tersebut dimasukkan sebagai imbalan (pendapatan bank).

Abstract

Praktik gadai sawah di di Pulau Sumbawa Provinsi Nusa Tenggara Barat merupakan akad utang piutang antara penggadai (rahin) dan penerima gadai (murtahin), yakni menjadikan harta berupa sawah sebagai bentuk kepercayaan dari pihak yang berpiutang. Praktik gadai sawah di pulau ini sudah berlangsung lama dan tetap bertahan di tengah masyarakat karena dipandang memiliki nilai sosial yang sangat tinggi yaitu sarana tolong menolong. Jenis penelitian ini adalah deskriptif kualitatif yang bertujuan menjelaskan praktik gadai sawah di Pulau Sumbawa perspektif imam madzhab. Metode penelitian yakni observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa praktik gadai sawah di Pulau Sumbawa pada dasarnya adalah akad hutang piutang antara pihak rahin (penggadai) dan murtahin (penerima gadai) yang mana penggadai (rahin) akan memberikan jaminan sawah miliknya kepada penerima gadai (murtahin) sebagai penguat perjanjian. Dilihat dari perspektif imam madzhab maka praktik seperti ini termasuk kebiasaan yang tidak dibenarkan oleh syara‟ karena murtahin tidak meminta ijin baik secara lisan maupun tertulis kepada penggadai (rahin) terkait pengelolalan sawah jaminan tersebut, serta pengelolaan sepenuhnya dikuasai oleh penerima gadai (murtahin). Dalam literatur fikih Islam bahwa praktik seperti ini termasuk kategori riba karena ada usaha ekploitasi sawah milik rahin oleh murtahin guna mendapatkan keuntungan yang berlipat.

Abstract

Adanya lebih dari satu madzhab fiqih dalam satu daerah atau negara menyebabkan adanya perbedaan di dalam amaliah satu ibadah. Seringkali perbedaan amaliah tersebut di anggap sesuatu hal yang salah oleh satu pihak atau saling menyalahkan di antara mereka dan tidak jarang diakhiri dengan permusuhan. Misalnya dalam satu tempat ada sekelompok jamaah yang berkeyakinan imam harus mengeraskan bacaan bismillah pada sholat jahr sedangkan kelompok lain tidak mengeraskan bacaan bismillah pada sholat jahr kemudian mereka sholat jama‟ah dalam satu masjid, tentu hal ini akan menimbulkan permasalahan. Contoh lain, bacaan qunut dalam sholat shubuh. Penelitian ini akan membandingkan amaliah shalat jama‟ah di antara madzhab Imam Syafi‟i dan madzhab Imam Ahmad di dalam Matan Ghayah wa at-Taqrib dan Matan Zaad Al-Mustaqni. Fokus penelitian adalah menganalisis perbedaan amaliah sholat berjamaah serta bagaimana cara menyikapi perbedaan-perbedaan tersebut. Metode penelitian yang digunakan adalah metode kualitatif dengan analisis komparatif dan termasuk penelitian kepustakaan (library research). Data primer yang ada, yaitu kitab Matan Ghayah wa at-Taqrib dan kitab Zaad Al-Mustaqni akan dibandingkan dan dianalisis satu persatu kemudian di cari perbedaan di antara kedua matan tersebut. Selanjutnya akan dijelaskan cara menyikapi perbedaaan-perbedaan tersebut. Hasil penelitian menunjukkan terdapat perbedaan-perbedaan pokok di antara kedua matan. Perbedaan-perbedaan tersebut antara lain: hukum shalat jama‟ah, hukum niat menjadi imam bagi imam, hukum membaca surat Al-fatihah bagi makmum, keabsahan keimaman anak kecil (yang belum baligh) dan keabsahan posisi makmum laki-laki sendirian berdiri di sebelah kiri imam atau makmum sendirian di belakang imam atau di belakang barisan seorang diri. Perbedaan-perbedaan fiqih sudah terjadi pada masa awal agama Islam yang disebabkan perbedaan metode istimbath atau menyimpulkan hukum dari dalil (Al-Qur‟an dan Sunnah). Maka, perbedaan fiqih pada umumnya dan khususnya di dalam permasalahan sholat harus disikapi dengan ilmu yang benar, akal pikiran terbuka, lapang dada dan tidak fanatik kepada satu kelompok (golongan) atau madzhab.
