Abstract

The use of the Deoxyribo Nucleic Acid (DNA) in the human embryo cloningis definitely a great invention of the centuries, yet the impact of its utilization bringsmore complicated problems. It is because the DNA can be taken from desired persons.It surely will lead to the problematical issues due to future offspring pedigree. It will behard to find out whose kids these cloning babies? Therefore, the law will be messed upwith things related to birth certificate and inheritance right. Even though the cloninguses the similar method with the IVF, it uses other cells but sperm. These cells bringother people’s DNA information with them therefore the children produced by thismethod will copy all the characteristics of the owners even without the help of penetrationbetween their parents. Hence it can be said that, in making a baby, woman does notneed man and marriage anymore. The reasons behind this human cloning inventionare to make perfect offspring that are far more intelligent, good looking, healthier,stronger, and perfectly same with the owner of the DNA. Embryo cloning, however, isthe sort of intervention of Allah creation. It means that people who involving in cloningprocess deny the Almighty of Allah. Is this the playing of Allah’s creation? How theIslamic laws see this phenomenon and give legal fatwa on the utilization of DNA incloning human embryo? How the National Laws of Indonesia sees this case? Abstract

Indonesia is a country with abundant natural resources, yet the case of malnutrition has gone on since a longtime ago. The non-serious handling of malnutrition causes various health conditions such as stunting. Thiswill influence economic capacities and productivity; thus, it becomes a serious threat. This research uses aquantitative method, by using primary and secondary legal sources.Stunting may have implications on children’s health both in the short and in the long run. It may influence thecountry’s economy. The roles of the government, parents, family, and the society is not enough in protectingchildren from stunting. The government has not maximally implied various programs in preventing andhandling stunting, thus the rate of stunting is not yet according to the standard given by WHO. This describessome aspects and the citizens’ rights which are not yet fulfilled, including the rights to live, the right forhealth, the right for children to grow, and other rights.

Abstract

Digitalization of the economic field to welcome the era of industrial revolution 4.0 needs to be addressed intelligently so it is not harm the consumers and business actors through the transformation of consumer protection instruments into a more contemporary way. Currently, Indonesia has about 93.4 million Internet users and approximately 71 million users of smart phones which makes the internet and of course online transactions, as part of a lifestyle that is reflected through shopping behavior. The task of the State is to bring legal protection to consumers. Based on the consideration of actuality and urgency, to create the necessary level of certainty in business transactions and protect the consumer rights of e-commerce transactions the Government finally issued Presidential Regulation No. 74 of 2017. This regulation regulates the Electronic Road Based Electronic System Road Map (road map e-commerce). The Policy Package is intended to make Indonesia the largest digital economy in Southeast Asia by 2020. Legal umbrella is required in the form of law so that the state can provide a simultaneous and comprehensive legal protection of consumer rights in e-commerce transactions in the era of digital economy.

Abstract

The problems contained in this scientific paper are about how the parameters of a situation can be called Force Majure in the view of Islam, and whether the Covid-19 pandemic can be used as the basis for Force Majure, and how Islam views credit relaxation in the midst of the COVID-19 pandemic. This study uses a juridical-normative approach whose main data source is secondary data in the form of written materials about the law which are then analyzed qualitatively with the aim of producing analytical descriptive data. From this study it was found that the parameters of a situation that can be called force majeure can be divided into two, namely absolute force majeure and relative force majeure, absolute force majeure is a situation that can no longer be implemented while relative force majeure is a situation that can actually be done but because there are something it is impossible to carry out his will and if done then the effect is great. The Covid-19 pandemic in general cannot be said to be a force majeure situation, but because the Government has issued Presidential Decree No. 12 of 2020 which states that COVID-19 is a non-natural disaster and is a national disaster and restrictions on carrying out an activity, this can potentially be a force majeure so that with the existence of a limitation on activities, the state must be present in providing a national economic stimulus, one of which is the provision of credit relaxation. The provision of credit relaxation is a policy issued by the state as an effort so that business actors can still continue their business activities in the midst of a pandemic and of course can again support the country's economy, but in practice the provision of credit relaxation by financial service institutions is not optimal.Permasalahan yang terdapat karya ilmiah ini adalah mengenai bagaimana parameter suatu keadaan dapat disebut sebagai Force Majure dalam pandangan Islam, serta apakah pandemi Covid-19 dapat dijadikan dasar sebagai Force Majure, serta bagaimana padangan Islam terhadap  relaksasi kredit di tengah tengah pandemic covid 19  . Penelitian ini menggunakan metode pendekatan yuridis-normatif yang sumber data utamanya adalah data sekunder yakni berupa bahan-bahan tertulis tentang hukum yang kemudian dianalisis secara kualitatif yang bertujuan menghasilkan data deskriptif analitis. Dari penelitian ini diperoleh bahwa parameter suatu keadaan dapat disebut sebagai force majure dapat dibagi menjadi dua yaitu force majure absolute dan force majure relatif, force majure absolut adalah keadaan yang sudah tidak bisa dilaksanakan lagi sedangkan force majure relatif adalah keadaan yang sebenarnya bisa dilakukan namun karena ada suatu hal maka tidak mungkin melaksanakan kehendaknya dan jika dilakukan maka pengaruhnya besar. Pandemi Covid-19 secara umum tidak dapat dikatakan sebagai keadaan force majure, namun karena Pemerintah telah mengeluarkan Keppres Nomor 12 tahun 2020 yang menyatakan covid-19 merupakan bencana non-alam dan merupakan bencana nasional serta pembatasan melakukan suatu kegiatan, maka hal demikian dapat berpotensi sebagai force majure sehingga kemudian dengan adanya suatu pembatasan kegiatan, negara harus hadir dalam memberikan stimulus perekonomian nasional yakni salah satunya pemberian relaksasi kredit. Pemberian relaksasi kredit merupakan kebijakan yang dikeluarkan oleh negara sebagai upaya agar para pelaku usaha masih dapat melanjutkan kegiatan usahanya di tengah pandemi dan tentunya dapat kembali menunjang perekonomian negara, namun dalam praktiknya pemberian relaksasi kredit oleh lembaga jasa keuangan belum optimal

Abstract

Purpose: This research aims to ascertain the practice of land pawning as security for loans and understand its law. A land pawner utilizes the collateral and retains the proceeds. However, a land pawnbroker is not entitled to obtain the pawner’s land management results.Methodology: This study belongs to normative juridical research, examining the relevant legal provisions and their implementation in society. This research investigated problem-solving in the practice of land pawning under customary law.Findings: The findings reveal that the customary pawning practice refers to the pawner’s land position as collateral. Muslim communities sometimes commit land pawning to obtain loans. The land pawner utilizes the collateral and retains the proceeds. In contrast, the land pawnbroker receives no benefit from the pawner’s land management.Practicality: This study is anticipated to guide pawnshops and banking institutions to ensure that solutions that conform to Islamic law are developed when pawning land following customary law. Islamic law offers a solution to employ a multi-contract, not a single one, as conducted so far, among others via qard and ijarah contracts.Novelty/Originality: The solution to the land pawning issue is utilizing a multi-contract, such as qard and ijarah contracts. An ijarah contract is not a condition or ta’aluq of the qard contract, as is the case with customary law’s practice of pawning. The ijarah agreement is entered into when pawned commodities are used as a means out of the deadlock created by the practice of land pawning contracts according to customary law, which utilizes a single contract. The profit earned by the pawner is derived from ijarah. Both parties gain equally in this case; the owner of the pawned property retains ownership of the lien and receives a profit share from the rent on the land used as collateral for his obligations.

Abstract

Indonesian society is known as a society with complex heterogeneity, including a very dynamic structure in terms of political, economic, socio-cultural, and legal aspects. The enormous number of Muslim populations in Indonesia is the reason for continuing to strive for the development of the sharia economy which in its journey has met several obstacles. The dominance of the theory of capitalism in Indonesia, which originates from West and is even the focus of almost all countries today, has created economic injustice, because it only benefits West through the hegemony of paper currency and usury lending system. Economic theories formulated by experts are not able to present a just and civilized economic order for society, and even create a dichotomy between the interests of individuals, society, the state and relations between countries. In addition, it is also unable to maintain the sustainability of natural resources. According to the Islamic worldview, the capitalist economic system that is ingrained in Indonesia is a system that must be Islamized. So, of course the aspired economic theory is an economic system that can create justice and mutual prosperity accompanied by the blessings of the world and the hereafter. The theory is Islamic economics is sourced from Allah's law which brings justice and prosperity to all humankind, because Islam is a mercy to all of nature.

Abstract

Penelitian yang membahas bagaimana perlindungan hukum terhadap konsumen dalam jual beli online dan bagaimana tanggung jawab pelaku usaha terhadap perlindungan konsumen dalam jual beli online ini, menggunakan metode pendekatan yuridis-normatif dengan data sekunder sebagai sumber data utamanya. Dari penelitian ini diperoleh hasil penelitian bahwa perlindungan hukum terhadap konsumen dalam jual beli online diatur di dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 8 Tahun 2011 tentang Informasi dan Transaksi Elektronik, serta Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik. Pada prinsipnya pelaku usaha dapat dituntut pertanggungjawaban dalam transaksi online lewat pertanggungjawaban kontraktual prinsip tanggung jawab berdasarkan unsus kesalahan, prinsip praduga untuk selalu bertanggung jawab, prinsip tanggung jawab mutlak.

Abstract

This study aims to analyze the strategy carried out and analyze the problems in determining the strategy as an effort to increase local revenue during the New Normal Pandemic Covid 19. The object of this research is the strategy for increasing local tax revenues and levies prepared by the Banda Aceh City Government. Meanwhile, the subjects in this study are the Head of the BPKK Office, the Secretary of the BPKK, the Head of Billing, the Head of Data Collection, and the Head of Accounting who are divided into duties and obligations to participate in developing strategies for increasing regional revenues. This research is a descriptive study, while the approach is a qualitative approach. Data collection was carried out in two ways, namely library data collection and field data collection. The results showed that; (1) Problems that exist in Pemko Banda Aceh are fiscal dependence on the Central Government, not optimal exploration of regional potential, inefficient performance of regional financial management and weak systems and socialization. (2) The strategy adopted by Pemko Banda Aceh is to implement intensification and extensification efforts. (3) Problems faced in realizing the strategy for increasing regional revenue include unattainable organizational goals, lack of coordination with other parties, weak supervision including instruments, lack of use of information technology, and limited quality of human resources.

Abstract

Penelitian ini bertujuan untuk melihat perkembangan pola kehidupan manusia senantiasa berubah, bahkan perubahannya bersifat disruptif dimana banyak hal-hal baru yang belum terjadi sebelumnya. Pandemi yang terjadi sejak 2019 juga menuntut produktivitas fatwa terkait hal-hal baru. Penelitian ini bertujuan untuk melihat secara lebih mendalam metode sadd adz-dzari’ah dan aplikasinya dalam penetapan fatwa Majelis Ulama Indonesia yang berkaitan dengan bidang kesehatan. Metode yang digunakan dalam penelitian ini adanya metode kualitatif dengan cara menganalisis secara holistic terhadap obyek penelitian. Hasil penelitian didapatkan bahwa kedudukan sadd adz-dzari’ah dalam proses penetapan fatwa Majelis Ulama Indonesia adalah sangat penting demi mencegah terjadinya kemudhorotan dan mencapai kemaslahatan
