Abstract

Indonesia is no longer an authoritarian country, and no longer centralized government. Decentralization processes since 1999 has changed local democratization in a wider participation. Nevertheless, the culture of openness and incorrupt have been far from the more ideal situation. Bribery, corruption and unresponsive public services have been continuously and more systematic taking place. In that context, the Government of Indonesia enacted Law No. 14 of 2008 concerning Public Information Openness (Keterbukaan Informasi Publik or called PIO Law), which is implemented since 30 April 2010. The PIO law is believed to contribute to the better decentralization processes and economic-political democratization at local level. Nevertheless, although right to access information was guaranteed by law, but it has been applied in limited process. Such situation actually gives clear evidence that decentralized Indonesia should be questioned, especially in terms of how the right to access information has been applied in a meaningful way after the enactment PIO Law in 2008 and, what the dominant problems in implementing right to access information are. This article will elaborate the norms and practices of PIO Law by using the rule of law point of view.

Abstract

This article examines the genesis and evolution of Indonesia's National Human Rights Action Plan (NHRAP), known as Rencana Aksi Nasional Hak Asasi Manusia (Ranham), throughout the Reform era from 1998 to 2020. Ranham stands as an important national policy document designed to articulate two primary objectives: first, to delineate how the state integrates human rights principles and norms into its policies; and second, to establish benchmarks for measuring its notable achievements in this domain. Adopted and implemented by successive Indonesian governments, Ranham has been instituted through Presidential Regulations across five distinct phases over two decades of the Reform era. The foundation of Ranham can be traced back to the Vienna Declaration and Program of Action (VDPA) of 1993, a seminal international human rights framework. Currently, over 70 countries, Indonesia among them, have formulated their respective versions of Ranham. This article underscores Ranham's role as a manifestation of Indonesia's commitment to advancing the human rights agenda nationally. However, it also identifies a significant challenge: the insufficient conceptualization of human rights, which hampers the robust development and fortification of Indonesia's national human rights framework.

Abstract

This article focuses on the Indonesian Police (Polri) efforts in the realization of human rights-based policing, as well as its articulation in the forming education (pendidikan pembentukan/ DIKTUKBA) of Polri, specifically at the State Police School (Sekolah Polisi Negara/SPN) in North Sumatra, established in 1960-s and one of the oldest SPN in Indonesia. Since 2021, Polri has acknowledged and developed the ‘presisi’ curriculum to become a starting point for transformation agenda and, of course, to strive Polri’s obligation in the implementation of human rights values, principles and standards in the police functions. The research applied a qualitative approach with a descriptive design. Data collection was employed using documents, FGD, observations and literature relevant to police and human rights issues. Respondents were selected using a purposive sampling technique. Data validation was carried out by extending observations and triangulation and analyzed using the spiral technique. Human rights-based policing through the DIKTUKBA POLRI level at the SPN Poldasu brings the vision of ‘presisi’ police through the ‘presisi’ curriculum. The ‘presisi’ curriculum offers good ways to achieve the transformation of the Polri. However, the increasingly short training period for the DIKTUKBA POLRI represents a challenge to improve human rights-based policing. The challenges affirm the correlation between human rights and policing in a dynamic police workspace. In this context, the instructors’s capacity must continuously acquire knowledge and experience. Therefore, collaboration and innovation in using learning models and methods such as group learning, problem-solving, discussion, and active involvement of students can be continuously developed.

Abstract

AbstractChild-friendly school (CFS) is a concept, program, and model that places children as a key educational subject whose rights are protected and respected in the whole of the learning and policy-making process in schools. SRA aims to ensure children enjoy their rights at school safely and healthily. This paper examines the essence of SRA and its contribution to respecting and protecting the rights of children with mental disabilities, in particular, intellectual disability at the Melati Aisyiah Special School (SLB) in Deli Serdang Regency. This article uses a case study approach to explain the general and special conditions that occur. Data collection through interviews was carried out to support library data from various reading sources, such as books, journals and other relevant reading sources. This article also finds that SRA is the appropriate concept to be implemented because fulfilling children's rights, especially for vulnerable groups with intellectual disabilities as children with special needs, requires a commitment and good actualization space supported by stakeholders to ensure the availability of a healthy and safe school environment.------------AbstrakSekolah Ramah Anak (SRA) merupakan konsep dan model yang menempatkan anak sebagai subjek pendidikan yang dilindungi dan dihormati hak-haknya dalam setiap proses pembelajaran dan pengambilan kebijakan di sekolah. SRA bertujuan memastikan anak-anak menikmati hak-hak mereka di sekolah dengan aman dan sehat. Tulisan ini mengkaji esensi SRA dan kontribusinya dalam upaya menghormati dan melindungi hak-hak anak penyandang disabilitas grahita di Sekolah Luar Biasa (SLB) Melati Aisyah di Kabupaten Deli Serdang. Artikel ini menggunakan pendekatan studi kasus untuk menjelaskan kondisi umum dan khusus yang terjadi. Koleksi data melalui wawancara dilakukan untuk mendukung data kepustakaan dari berbagai sumber bacaan, seperti buku, jurnal dan sumber bacaan lain yang relevan. Artikel ini menemukan bahwa SRA adalah konsep yang tepat untuk dilaksanakan karena pemenuhan hak-hak anak, khususnya kelompok rentan penyandang disabilitas grahita sebagai anak berkebutuhan khusus membutuhkan ruang aktualisasi yang baik yang didukung ketersediaan lingkungan sekolah yang sehat dan aman.

Abstract

Strengthening sub-district government capacity after the emergence of the regional autonomy policy in Reform era of Indonesia is really mandated to incorporating a human rights-based approach to development (HRBA). As a conceptual framework, HRBA seeks to address the root of the problem and touch the interests of the most vulnerable groups from human rights violations due to isolated development of border areas and marginalization of human rights protection. HRBA has become an important and interesting issue in the formulation of sustainable development that are able to empower and even improve the welfare of society. This article examines the government's capacity of the Besitang sub-District in planning and driving action HRBA into development practices in their regions. The article resulted from qualitative descriptive research. Data were collected by using focused group discussions, field studies, and literature review, then analysed through an interactive analysis. Finally, this article concludes that improving the performance of apparatus and good mechanisms for institutional assistance at the village level, including community leaders and disadvantages of community participation, is a significant effort to accelerate the realization of HRBA in Besitang sub-District.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana pencatatan Perkawinan beda agama dalam tinjauan administrasi keadilan menurut SEMA No. 2 Tahun 2023. Metode penelitian yang digunakan adalah yuridis normatif. Penelitian yuridis normatif merupakan penelitian hukum dengan studi dokumen, yaitu mengkaji dokumen-dokumen penting seperti peraturan perundang- undangan, putusan atau penetapan pengadilan, teori hukum, doktrin, atau pendapat para ahli hukum. Penelitian yuridis normatif dilakukan di berbagai perpustakaan dan melalui media internet. Data sekunder yang digunakan diperoleh dari buku dan jurnal dan artikel yang relevan. Teknik pengumpulan data pada penelitian menggunakan studi pustaka untuk mengumpulkan bahan hukum atau data sekunder. Teknik analisis data menggunakan metode analisis kualitatif. Hasil peneltian yaitu UU Perkawinan tidak mengatur secara jelas dan rinci mengenai perkawinan beda agama, dan  pencatatan perkawinan beda agama dalam tinjauan administrasi keadilan dianggap tidak adil dikarenakan beberapa aspek yang mendukung hal tersebut.

Abstract

Warga Desa Gamber mengalami dampak multidimensional akibat Pandemi Covid-19. Semakin beratnya dampak yang dirasakan oleh warga, karena warga Desa Gamber telah direlokasi akibat erupsi gunung Sinabung. UU Desa membandatkan subsidiaritas mengatur dan mengurus kepentingan warga setempat. Tata kelola pemerintahan Desa berbasis HAM penting untuk memastikan perlindungan dan pemenuhan HAM yang inheren dengan kemartabatan manusia untuk bangkit dari krisis. PKM dilaksanakan dengan paradigma people centered development. Pelatihan mengintegrasikan konsep pendidikan untuk orang dewasa (andragogi). Karenanya pelatihan didesain partisipatif. Pelatihan efektif meningkatkan kualitas pemahaman peserta secara teoritis dan praktis tata kelola pemerintahan desa gamber berbasis HAM. Peningkatan pemahaman peserta diperoleh dari observasi yang dilakukan pada saat focused group discussion. Peserta mendikusikan sebuah kasus berkaitan dengan topik pelatihan. Fasilitator melakukan observasi peningkatan kualitas pemahaman teoritis dan praktis pasca pelatihan dilaksanakan. Melihat urgensi dan efektivitas pelaksanaan pelatihan untuk meningkatkan tata kelola pemerintahan berbasis HAM, perlu kiranya kegiatan serupa untuk merespon penanganan krisis dan bangkit dari krisis tanpa mengesampingkan kewajiban perlindungan, penghormatan, dan pemenuhan HAM.
