Abstract

Tulisan ini menyoroti problematika yang melanda dunia hukum sekarang.  Mengapa hukum modern gagal menciptakan keadilan sejati (substantial justice)? Selain itu, tulisan ini juga mencoba menelusuri mengapa sistem hukum modern yang berlaku saat ini, termasuk di Indonesia, sangat mudah ditegakkan terhadap kaum yang lemah, akan tetapi tidak berdaya memberangus kelompok elit, utamanya mereka yang memiliki modal yang besar.  Bagaimana sesungguhnya kawah candradimuka alias setting medan sosial yang mewadahi lahirnya sistem hukum modern? Pada bagian akhir, penulis mengungkapkan ke arah mana trend studi hukum berkiblat sekarang sehubungan dengan telah gagalnya sistem hukum modern mengatasi problematika dunia saat ini dan bagaimana posisi (studi) hukum Islam dalam arus (studi hukum) tersebut. Keywords:  Law, modern legal system, capitalism, Islamic law.

Abstract

This study discusses a socio-juridical analysis of underage marriages caused by pre-marital pregnancy in Banggai Islands Regency. The aims of this study are to discuss socio-juridical review of underage marriage in Banggai Islands Regency and the impacts from the existence of underage marriages on household harmony. This study used a qualitative method. The data was collected through direct observation, in-depth interviews, and writeen document analysis. The data, then, was analysed using themnatic analysis to find themes from the data. This study found that based on Law no. 16 of 2019 concerning marriage age limit, women are permitted to be married after age nineteen years old and . However, in an eergency case, a woman under nineteen years olad is allowed to be marreid if her parents obtain a dispensation from the religious court. Such emergency condition may be pre-marital pregnancy or economic problems. In some cases of underage marriage, we found that cauples underage marriages experience more negative impacts than positive impacts on the harmony in the their relationship. Negative impacts include women physical and mental health, and also economic limitation. We also found that most of pre-marital pregnancies were caused by permissive relationship, low education, lack of parental attention, promiscuity, misuse of technology, and lack of knowledge or understanding of religion.

Abstract

Marriage is a physical and mental bond between a man and a woman. It is hoped that it will give birth to a harmonious and happy family, including having offspring who will then care for them well. In reality, couples from different religions who later divorce and have children become a problem, because custody becomes a struggle between the father and mother. This research discusses the child custody rights of an apostate mother as happened in the Parigi religious court decision case, Central Sulawesi. This study uses empirical legal methods with a maqāṣid al-sharī'ah approach. The data collection techniques used were interviews and document study. The informants interviewed were judges, academics and ulama. The documents analyzed were religious court decisions, journal articles, legal rules and books related to the discussion. The results of the research show that in deciding cases, the panel of judges set aside the written law which was used as a reference, and the compilation of Islamic law in order to fulfill the principle of benefit from fulfilling legal objectives. There are several reasons for the judge to overrule these two laws: the interests of the child, social aspects, the principle of benefit (mashlahat) for all. In the end, the judge's decision within the framework of maqāṣid al-sharī'ahanalysis has implications for the maintenance of the soul, eyesight, and the maintenance of offspring, as well as the maintenance of religion.

Abstract

This research reveals the activities of the Prophet's maulid at mosques in West Sumatra, Indonesia. This celebration is a routine activity that is believed to have ethical and aesthetic values, so it has become a religious ritual for the community. This research uses qualitative methods to reveal the meaning of people's behavior in various social situations, to find out the meaning of the Prophet's maulid ceremony at mosques in West Sumatra. The results of the research show that the malelang celebration is an expression of the Islamic religion with various activities, such as: malelang cake, malelang singgang ayam, and is a local cultural identity of the nagari community. There are various forms of activities such as competing in goodness and mutual cooperation in the activities of the Prophet's maulid, including cake auctions and chicken roast auctions to collect donations for the construction of mosques. These activities are related to various events that are considered important for the community. The results of the research show that the malelang tradition is understood by the people of nagari in West Sumatra as a good tradition to maintain its existence, because in its implementation it provides benefits in their lives, expressions of gratitude and competing with each other in goodness, because on this occasion many people gather again get to know, remember and increase love for the Prophet Muhammad SAW.

Abstract

ABSTRACT Purpose of the Study: The repressive law enforcement carried out as a response against the crime of terrorism has caused issues with law enforcement's effectiveness in Indonesia. It was discovered that the normative approach did not cut the chain of terrorism. On the contrary, it created new terrorists.  This paper aimed to construct the relationship between law enforcement, judicial decisions, and legal objectives. Methodology : This research used the dogmatic legal research method by statutory and library approaches. The data of this research were gathered from news and judicial decisions on terrorism cases. Results : Results suggest that law enforcement, especially normative-repressive judicial decisions, has resulted in new issues, namely society's rampant actions against the state, particularly towards the law enforcement apparatus. Applications of this Study : This condition will further imply with the rampant actions of state delegitimating in society. In line with that, this paper suggests that a new style of law enforcement should be applied in solving terrorism cases in this country.  The said approach is law enforcement who emphasizes the humanity of the suspect, heavily addressing the protection of the suspect's rights in the crime of terrorism. Novelty/Originality of this study: This is the pilot research discussing judicial decisions in courts concerning terrorist cases in Poso and its surroundings. Keywords: Law enforcement, judicial decisions, terrorism, social resistance, legal justice.   ABSTRAK  Tujuan Studi: Penegakan hukum represif yang dilakukan sebagai tanggapan terhadap kejahatan terorisme telah menimbulkan masalah dengan efektivitas penegak hukum di Indonesia. Ia menemukan bahwa pendekatan normatif tidak memotong rantai terorisme. Sebaliknya, ia menciptakan teroris baru.  Dokumen ini bertujuan untuk membangun hubungan antara penegakan hukum, keputusan pengadilan, dan tujuan hukum. Metodologi: Penelitian ini menggunakan metode penelitian hukum dogmatis dengan pendekatan undang-undang dan perpustakaan. Data dari penelitian ini dikumpulkan dari berita dan keputusan pengadilan tentang kasus terorisme. Hasil: Hasilnya menunjukkan bahwa penegakan hukum, terutama keputusan-keputusan pengadilan normatif-represif, telah menghasilkan masalah baru, yaitu tindakan ramping masyarakat terhadap negara, terutama terhadap aparat penegak hukum. Aplikasi dari Studi ini: Kondisi ini akan lebih menyiratkan dengan tindakan ramping delegitimating negara di masyarakat. Sesuai dengan itu, makalah ini menyarankan bahwa gaya penegakan hukum baru harus diterapkan dalam menyelesaikan kasus terorisme di negara ini.  Pendekatan yang disebutkan adalah penegakan hukum yang menekankan kemanusiaan tersangka, dengan serius menangani perlindungan hak tersangka dalam kejahatan terorisme. Kebaruan/Orisinalitas: Ini adalah penelitian pilot yang membahas keputusan pengadilan di pengadilan mengenai kasus terorisme di Poso dan sekitarnya. Kata kunci: penegakan hukum, keputusan pengadilan, terorisme, perlawanan sosial, keadilan hukum.

Abstract

This study aims to construct the form of customary law empowerment as a means of overcoming family conflict. The research design used is empirical legal research with a qualitative-naturalistic approach. The research was conducted in Palu City, especially in Birobuli Utara Village. The data for this study came from field observations and interviews with traditional leaders. The results of the study indicate that customary law empowerment as a means of overcoming family conflict is constructed in the form of implementing alternative dispute resolution, a method of resolving disputes outside the court with mediation and negotiation techniques. Customary law empowerment as a means of overcoming family conflict should continue to be strengthened from various aspects so that it can be more optimal in carrying out its function as an alternative dispute resolution institution, considering that this institution has been proven to be able to resolve family disputes simply, quickly, and at low cost (speedy administration of justice), while maintaining community harmony. Otherwise, this very valuable social capital will only become wisdom that is increasingly being marginalized.

Abstract

This study critically inquires the role of religious figures within the framework of instilling the concept of religious moderation in Indonesia. The main reason for this study is that social facts in Indonesia today, indicate that there are certain people who interpret religion in extreme ways. This is the background behind the issuance of Presidential Regulation Number 18 of 2020 which places religious moderation as a fundamental social capital for nation building. In line with that, this paper maps out the strategies run by religious leaders in carrying out their roles in grounding the concept of religious moderation. This article is based on socio-legal research. The data were collected through observation, in-depth interviews, and documentation. The result of this study shows that religious leaders play an important role in instilling religious moderation by acting as inspirations in inter-religious interactions, motivators in understanding religious moderation, role models in moderation behavior, initiators of moderate religious perspectives, promoters of internal and external dialogue, mediators, catalysts, in carrying out Islam as rahmatan li al-alamin, and is at the forefront (spearhead) in socializing the concept of religious moderation.
