Abstract

Sampah harus dikelola dengan baik, jika sampah tidak dikelola dengan baik, dapat menimbulkan pencemaran udara, karena sampah dapat mengandung gas beracun yang membahayakan kesehatan manusia. Penanganan pengelolaan sampah harus melibatkan semua pihak, baik dari pemerintah maupun masyarakat, Pengelolaan sampah yang baik, dapat _ dilakukan dengan prinsip 3 R yaitu : Mengurangi adalah mengurangi segala sesuatu _ sesuatu yang menghasilkan sampah, Menggunakan kembali adalah memanfaatkan sampah yang masih ada _ dapat digunakan, untuk fungsinya sama, atau fungsi lainnya, sedangkan Recycle adalah mengolah kembali, atau mendaur ulang sampah menjadi barang produksi yang berguna dan baru. _ Dasar hukum pengelolaan sampah di Indonesia diatur dalam undang-undang. Nomor 18 Tahun 2008 tentang Pengelolaan Sampah. Pohon permasalahan dalam skripsi ini adalah : Bagaimana sistem pengelolaan sampah yang sesuai dengan peraturan perundang-undangan. N0.18 Tahun 2008, tentang Pengelolaan Sampah?, Bagaimana permasalahan hukum bagi Pemerintah Kabupaten Tapteng dalam sistem pengelolaan sampah di Tapteng?, dan Bagaimana solusi hukum dari Pemerintah Kabupaten Tapteng dalam sistem pengelolaan sampah di Tapteng? Kajian ini menggunakan metode Yuridis Normatif, yaitu penelitian yang dilakukan dengan cara, penelitian kepustakaan (Library Research), atau data sekunder yang meliputi buku-buku dan norma-norma hukum yang terdapat dalam Peraturan Perundang-undangan. Metode Yuridis Normatif dipilih karena penelitian ini bertujuan untuk mengetahui tata kelola sampah. pengelolaan sampah di Kabupaten Tapteng Tengah, Kendala hukum yang dihadapi Pemerintah Kabupaten Tapteng dalam hal pengelolaan sampah, dan untuk mendapatkan solusi dari Pemerintah Kabupaten Tapteng dalam pengelolaan sampah di Tapteng. TPA Aek Nabobar (Tempat Pembuangan Akhir) Kecamatan Pinagsori Kabupaten Tapanuli Tengah dan wawancara kepada Sekretaris Dinas Lingkungan Hidup Kabupaten Tapteng.

Abstract

In Kota Bagansiapiapi, it is common to find the Chinese community performing marriages based on their beliefs without registering them with the Civil Registry office. Divorce due to the death of the husband/father in such cases results in the marriage and child remaining unregistered. The unregistered child faces difficulties in inheriting paternal rights due to the lack of legal ties. This study aims to explore the mechanism of acknowledging children born from unregistered marriages within the Chinese community, the legal position of inheritance rights for children born from unregistered marriages, and the legal protection of a child's inheritance rights. The empirical research was conducted at the Vihara, the Civil Registration and Population Office, and Notaries in Kota Bagansiapiapi. The findings reveal the mechanism for acknowledging children and the implications of unregistered marriages on a child's inheritance rights. Legal protection for a child's inheritance rights remains fragmented and lacks harmonization with administrative regulations on population and marriage.

Abstract

The Toba Batak ethnic group living in the Samosir area is essentially a collection of traditional communities and generally are farmers who work on agricultural land and conceptualize land as not only an economic resource but also as a clan identity. The important role of land in human life, is that land is an object that is prone to disputes or disputes between humans. This type of research is empirical juridical research where the approach to the problem is carried out by examining the provisions of customary law in the Toba Samosir Regency. This research is normative and descriptive analysis, where this research attempts to describe, explain, and analyze the problems that arise, and then look for the correct answers as solutions to these problems. The results of the discussion of the problems that arise in this research are that legal efforts to resolve disputes over customary land tenure in Toba Samosir Regency can be carried out through non-litigation channels with consensus deliberation through traditional leaders and if a resolution cannot be obtained, then it will be taken through litigation. Legal efforts to resolve customary land tenure disputes in Toba Samosir Regency through litigation have provided legal certainty and legal protection.

Abstract

This research aims to determine and analyze the legal protection of the personal property of underage influencers The type of research used is normative legal research, specifically by examining or dissecting optional information as legal material, especially important legal material, and additional legal material, by understanding regulation as a set of guidelines or positive standards in a common set of laws. The exploratory idea used in this exam is analytical descriptive research on the legal relationship of underage influencers with their service providers. Underage influencers have a different legal status compared to adult influencers. Legal protection of the personal property of underage influencers. The law provides special protections for minors, including protection of their personal property as influencers. This protection includes a guardian to protect property.

Abstract

Undang-Undang Republik Indonesia Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum berikut peraturan pelaksananya, telah menetapkan upaya hukum apa saja yang dapat dilakukan oleh pihak yang berhak dalam proses pengadaan tanah. Dalam upaya hukum tersebut telah dibatasi dengan tenggang waktu dan tanpa ada upaya hukum banding sehingga keberatan terhadap putusan pengadilan negeri langsung mengajukan permohonan Kasasi. Putusan Kasasi juga merupakan putusan akhir dan final dan terhadap putusan tersebut tidak dapat dilakukan upaya hukum peninjauan kembali. Dengan demikian pihak-pihak yang terlibat dalam proses pengadaan tanah memiliki kepastian hukum, dimana jika terdapat keberatan sudah dapat diperhitungkan tenggang waktu penyelesaiannya, hal ini juga mempertimbangkan waktu pelaksanaan pembangunan bagi kepentingan umum. Profesionalisme hakim yang termanifestasi dalam putusan-putusanyang dibuatnya tersebut sangat dipengaruhi oleh: penguasaan atas ilmuhukum, kemampuan berpikir yuridik, kemahiran yuridik, dan kesadaranserta komitmen profesional. Penguasaan atas Ilmu Hukum, akan dapat melihat bagaimana pengetahuan, penguasaan, serta pengembangan secarasistematik, metodik dan rasional atas asas-asas, kaidah-kaidah, dan/atauaturan-aturan hukum.

Abstract

In developed countries, social security is a priority. So much so that social security is one of the administrative requirements that must be fulfilled by every citizen. Social security, especially for  workers, should be placed on a primary scale because its function can help ensure the welfare of workers in the future. Indonesia is the country with the largest number of Muslims, but the development of social security is far behind, even though Islam has rules, including regarding social relations which are based on the concept of mutual help as contained in the zakat regulations. This situation is an opportunity, the obstacle lies in state regulations which do not yet require Indonesian Migrant Workers (PMI) to be participants in all existing programs, only requiring Accident Insurance (JKK) and Death Insurance (JKM), while Old Age Insurance/Pension Insurance (JHT) is optional. Another thing is that it is not easy for PMI who have worked in other countries to become participants, especially those who do not have a written contract, because one of the requirements is the existence of a written contract. This was complained about by PMI who worked in Malaysia through the forgiveness program from the Malaysian government. Using qualitative research methods, this research places the researcher as the key instrument. The data collection technique was carried out by combining results obtained through interviews, observation and literature study, combined with inductive data analysis.

Abstract

A birth certificate is a right for every child. Every child has the right to receive a birth certificate, therefore even fathers and mothers who are in unregistered marriages have children's rights protected by the state. People who want to arrange a birth certificate can come directly to the Dukcapil office or arrange it online. If the parents are not legally married then the birth certificate will contain a phrase stating that the child born from the marriage has not been registered. The formulation of the problem in this thesis is what is the mechanism for registering birth certificates for children resulting from unregistered marriages after the enactment of Law Number 24 of 2013 concerning Population Administration and Minister of Home Affairs Regulation Number 109 of 2019 concerning Forms and Books used in Population Administration in North Labuhan-batu Regency , what are the rights of those born as a result of sirri marriages with the issuance of birth certificates in North Labuhan-Batu Regency, what is the role of the Population and Civil Registration Service of North Labuhan-batu Regency in registering Birth Certificates for children resulting from sirri marriages. This paper described Through the use of Statement of Absolute Responsibility Letter (SPTJM) as an alternative to a marriage certificate, this service seeks to guarantee children's civil rights, including the right to legal identity. Despite facing various challenges and dilemmas, this service continues to try to balance legal compliance and protecting children's rights, while providing services and information to the community about procedures that can be taken to legalize marital status. Thus, the Population and Civil Registration Service plays an important role in ensuring that every child, including those born from unregistered marriages, can obtain a birth certificate and the rights that accompany it, even though there is still the potential for administrative difficulties in the future due to the parents' unregistered marital status. formally.

Abstract

Transfer of land rights is the transfer of land rights from the old right holder to the new right holder according to the provisions of the applicable laws and regulations. There are 2 (two) ways of transferring land rights, namely transfer and transfer. The transfer of rights to land that has been certified as ownership should be carried out by means of a legal act of sale and purchase carried out before a public official, namely the PPAT, which has the authority to make authentic deeds regarding land rights or ownership rights to apartment units. The transfer of land rights that have been certified as ownership through an agreement with a private letter still has legal force and can be used as evidence in court. However, it is not as strong and complete as an authentic deed made before a public official. This research method uses a Normative Juridical research type which is descriptive analytical in nature. The data source uses secondary data sources using legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials using library research data collection techniques (Library Research) and the data collection tool in this research is document study. The results of the research show that the transfer of title to land with certificate of ownership with a private letter still has valid legal force, based on the laws in force in Indonesia. Regarding land matters, there are 3 (three) forms of law that can be used as guidelines, namely the Basic Agrarian Law (UUPA), the Civil Code (KUHPerdata) and Customary Law. The transfer of land rights based on customary law is considered valid if it does not conflict with applicable laws and regulations according to the legal hierarchy. Legal protection for legal subjects who carry out legal acts of transferring title to certified land with private documents will be guaranteed and protected by the state as long as it can be proven in the judicial process. The essence of this case is that there was an unlawful act committed by one of the parties as the seller which resulted in an error which violated the statutory regulations, there was a loss experienced by the other party as the buyer of the plot of land so that the buyer was unable to carry out the process of changing the name of the a quo land. the. The legal basis is that there is an unlawful act against the conditions for the validity of an agreement written in article 1320 of the Civil Code.

Abstract

Child marriage still occurs in Indonesia, even though Law No. 16/2019 has increased the minimum age for getting married from 16 year old for the bride specified in Article 7, paragraph 1 and 19 year old for the groom to 19 year old for both of them. Indonesia is the country which participates in the Convention of Elimination of All Types of Discrimination Against Women as it is specified in Article 16, paragraph 2 which reads : “the betrothal and the marriage of a child shall have no legal effect, and all necessary action, including legislation, shall be taken to specify a minimum age for marriage and to make the registration of marriages in an official registry compulsory.” Indonesia is also the country which participates in Beijing Declaration and Platform for Action in which there is the 12th of critical areas of concern : one of them is the elimination of all types of discrimination towards girls.
