Abstract

AbstractFraud in the context of online transactions can occur despite consumer precautions. This article discusses consumer fraud practices in online transactions and prevention methods using a normative legal research method and statute and conceptual approach. The main findings of this article are that consumers play a crucial role in preventing online transaction fraud, such as verifying the website or online store before conducting transactions, not providing sensitive personal information, and reporting fraudulent activities to authorities. The impact of consumer understanding of their role and responsibility in preventing online transaction fraud is the potential reduction of fraudulent cases and protection of consumers from financial losses and misuse of personal information. This article aims to increase consumer awareness of the importance of taking preventive measures to prevent online transaction fraud.AbstrakPenipuan  dalam konteks transaksi online dapat terjadi meskipun konsumen telah melakukan tindakan pencegahan. Artikel ini membahas praktik penipuan dalam transaksi online oleh konsumen dan cara mencegahnya dengan menggunakan metode penelitian hukum normatif dan pendekatan statute dan conceptual approach. Temuan utama tulisan ini adalah bahwa konsumen memiliki peran penting dalam mencegah praktik penipuan dalam transaksi online, seperti melakukan verifikasi terhadap situs atau toko online sebelum melakukan transaksi, tidak memberikan informasi pribadi yang sensitif, dan melaporkan tindakan penipuan kepada pihak berwenang. Dampak dari pemahaman konsumen terhadap peran dan tanggung jawab mereka dalam mencegah praktik penipuan dalam transaksi online adalah dapat mengurangi jumlah kasus penipuan online yang terjadi dan melindungi konsumen dari kerugian finansial dan informasi pribadi yang dapat disalahgunakan. Artikel ini diharapkan dapat meningkatkan kesadaran konsumen tentang pentingnya melakukan tindakan preventif untuk mencegah praktik penipuan dalam transaksi online.

Abstract

Banks can deal with negative credit by purchasing, selling, and transferring the rights to receivables (cessie). According to the District Court's ruling in case No. 129/Pdt.G/2016/ PN.Pbr, the lawsuit was filed by a cessionary who had acquired receivables from the troubled PT Bank Tabungan Negara (Persero) Tbk. The Receivables Sale Purchase Agreement and Transfer of Cessie are the two (two) Notarial Deeds that include the terms of the transfer of receivables. According to the ruling, the Pekanbaru District Court approved the transfer of Land Ownership Certificates that had been pledged as security for the debtor (cessionaris). The problem is stated as follows: 1. Can the sale and purchase of receivables and the transfer of claim rights (cessie) give buyers of cessie legal certainty? 2. What are the legal ramifications of the debtor's assurance in light of Pekanbaru District Court Decision Number 129/Pdt.G/2016/PN.Pbr? and the purpose of this study is to comprehend the problem's genesis and offer solutions. The research method used in this study is known as normative legal research (doctrinaire), and it entails research on legal principles, legal aspects, and law as it is conceptualized as norms or rules that apply in society. It also includes an analysis of both written and unwritten legal rules that exist and develop in society, and it makes use of secondary data derived from primary, secondary, and tertiary legal materials. It is clear from this study that the sale and purchase of receivables and the transfer of cessie do not terminate the credit agreement between the cedent and cessus; rather, it is a transfer and delivery of receivables from the cedent to the cessionaris, and the transfer of cessus collateral must be based on a ruling made through litigation at the local District Court. And in this case, the transfer of Cessie and the sale and purchase of receivables are legal and do not violate the terms of the agreement. The judges' panel also believes that since the Cessus guarantee is not secured by a mortgage, the Cessus collateral object may be used to repay the debt by reclaiming the cessionaris name. Neither of these situations violates the rights to the bedding described in Article 1154 of the Civil Code.

Abstract

Payments can also have limited consequences in the sense that these payments only result in the role of the Creditor being replaced by another Creditor and the Debtor will be faced with a new Creditor who has the right to request payment from the Debtor or what is known as Subrogation and in this study occurs in the case of ships over 20 m2 as a Hipotek . Ships can meet the criteria or requirements to become collateral for credit settlement in the form of a Hipotek. Ships As Collateral for Repayment of Credit where the Hipotek is a material right to immovable objects. Ships can be divided into two, namely those weighing above 20 m 3 and below 20 m 3 . This paper aims to find out which ships can be charged with a Hipotek, so that they can be used as collateral for credit repayment. The method used is normative legal research, namely an approach by studying the applicable laws and regulations. The conclusion of this paper is that a Hipotek is a form of credit repayment guarantee, which is regulated in Burgelik Wetboek . Hipotek can be applied to objects in the form of ships. Ships As Guarantees for Repayment of Credit where the Hipotek is a material right to immovable objects which in this study uses subrogation as a legal remedy used.

Abstract

Penelitian ini mengkaji kedudukan hukum ahli waris dalam sengketa pertanahan antara ahli waris dan pemerintah daerah serta pertanggungjawaban perbuatan melawan hukum pejabat publik. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan yuridis-kualitatif, memfokuskan analisis pada bahan hukum primer (UUPA 1960, KUHPerdata, PP No. 24/1997, Peraturan BPN No. 3/1997, dan putusan PN Bireuen, PT Banda Aceh, serta MA No. 6581 K/Pdt/2024) dan bahan sekunder berupa literatur hukum dan jurnal ilmiah. Objek kajian dalam penelitian ini adalah perkara M. Dewantara bin H. Hasballah Daud vs. Pemkab Aceh Utara/Bireuen, di mana gugatan ahli waris atas tanah seluas ±35.000 m² berujung pada penolakan formil di tiga tingkat peradilan. Temuan utama menunjukkan bahwa meski ahli waris memiliki landasan substantif kuat dan bukti sertifikat, gugatan gagal karena obscuur libel, plurium litis consortium, dan daluwarsa agraria—menegaskan dominasi formalitas hukum acara perdata atas keadilan substansial. Hasil ini merekomendasikan penyusunan gugatan yang cermat dan reformasi prosedur administrasi pendaftaran tanah warisan untuk mendorong perlindungan hak waris secara efektif.

Abstract

Sebelum adanya putusan MK 18/PUU-XVII/2019 mekanisme Pelaksanaan eksekusi jaminan fidusia berdasarkan Pasal 15 ayat (2) dan (3)UU Nomor 42 tahun 1999 Tentang Jaminan Fidusia, yang terdapat pada Sertifikat Jaminan Fidusia yang memuat irah-irah sebagaimana dimaksud dalam ayat (1) mempunyai kekuatan eksekutorial yang sama dengan putusan pengadilan yang telah memperoleh kekuatan hukum tetap, pasca Putusan Mahkamah Konstitusi (MK) Nomor 18/PUU-XVII/2019, telah mencabut Pasal 15 ayat (2) dan (3) UU Nomor 42 tahun 1999 UU JF, yang mengubah mekanisme eksekusi, khususnya terkait eksekusi sepihak oleh kreditur dalam hal debitur wanprestasi. Putusan ini mewajibkan adanya persetujuan debitur dengan cara sukarela dan mengharuskan kreditur mengajukan permohonan eksekusi pada pengadilan jika debitur mengajukan keberatan. Perlindungan hukum bagi para kreditur dalam setiap perjanjian pembiayaan sangat krusial. Hak untuk mengeksekusi oleh kreditur adalah komponen paling utama dari jaminan fidusia. Namun posisi kreditur pasca putusan MK tersebut sangat lemah dan tidak adanya perlindungan hukum bagi kreditur. Penyebab pelaksanaan jaminan fidusia mencakup pelanggaran perjanjian oleh debitur, perubahan keadaan finansial, pemindahan objek jaminan fidusia tanpa persetujuan kreditur, kerusakan pada aset, serta keterlibatan pihak ketiga. Risiko yang timbul dari pelaksanaan ini dapat berupa kerugian oleh kreditur serta ketidakpastian hukum dan perlindungan hukum kreditur lembaga pembiayaan.

Abstract

Indonesian Migrant Workers (PMI) make a significant contribution to the national economy but continue to face serious challenges in terms of legal and institutional protection. The institutional transformation from BNP2TKI to BP2MI, followed by the establishment of the Ministry for the Protection of Indonesian Migrant Workers (KP2MI) through Presidential Regulation (Perpres) No. 165 of 2024, and the simultaneous reissuance of Perpres No. 166 of 2024 reinstating BP2MI, has raised concerns about overlapping functions and legal uncertainty. This study uses a normative juridical approach to analyze the institutional design compatibility of KP2MI and BP2MI with the principles of administrative law and good governance. The findings indicate a duplication of functions that contradicts the principles of legality, bureaucratic efficiency, and public accountability. Overlapping authority undermines law enforcement and weakens the overall protection of migrant workers. This study recommends a comprehensive institutional restructuring, either through the revocation of Perpres 166/2024 or amendments to both regulations with a clear delineation of functions, and the implementation of transparency, accountability, and cross-sector coordination to establish more efficient and human rights-responsive governance in the protection of Indonesian migrant workers.
