Abstract

The Indonesian Financial Transaction Reports and Analysis Center (PPATK) in Indonesia has uncovered a significant issue concerning illegal financial transactions linked to environmental crimes. They have identified that approximately 1 trillion Rupiah, obtained from such green financial crimes, is being funnelled into political parties for the 2024 elections. This discovery is particularly alarming, as it raises serious concerns about the integrity of the democratic process and the sustainability of the nation's political future. The PPATK's findings indicate that this illegal funding comes from various environmental crimes, including illegal logging and other environmentally damaging activities. The fact that these funds are being used to finance political campaigns implies a deeply concerning intersection between environmental crime and political corruption. This situation exemplifies a broader category of 'green financial crime', where environmental exploitation is directly linked to illicit financial gains. Results This research investigates the implications of these financial irregularities for the country's commitment to environmental conservation and the development of green policies. It discusses the broader implications for Indonesia's democratic order and urges a re-evaluation of current political funding mechanisms, advocating for transparent and accountable practices to ensure electoral integrity and promote a sustainable democratic future. The importance of collective action, involving civil society, policymakers, and international partners, to address the linkages between politics, democracy, and green financial crime ultimately protects Indonesia's democratic values and environmental heritage.

Abstract

Femicide is the taking of the life of a woman or girl because she is a woman or because of gender-based violence. The type of femicide that is often found in the field is intimate femicide, which is committed by people who have a relationship with the victim. Indonesia has various laws and regulations that regulate the protection of women and girls, including the Human Rights Law, the Child Protection Law, the Domestic Violence Law, and the TPKS Law, but the specific regulation of femicide has not been explicitly described in these various laws and regulations. This research uses a normative juridical method, which is legal research that places the law as a building system of norms that are studied through principles, norms, rules of laws and regulations, agreements, and doctrine. Based on the results of the discussion, it is found that there are 7 types of femicide that occur in the society, including the Indonesian society. the regulation of femicide has not been explicitly regulated in the Human Rights Law or in the TPKS Law. The Human Rights Law regulates the protection of human rights including women's rights in Article 45. Meanwhile, the TPKS Law further regulates the types of femicide that occur in Indonesia such as gender-based sexual violence, pornography, dating and domestic violence. Abstract

Pencurian merupakan sebuah tindak pidana yang ahir-ahir ini kerap terjadi di masyarakat hingga mengakibatkan kerugian yang signifikan, sehingga perlu ditanggulangi secara bersama-sama. Pendekatan penelitian ini adalah normatif-empiris, dengan spesifikasi diskriptif-analitis. Pengumpulan data dilaksanakan dengan studi kepustakaan dan wawancara, dengan analisis kualitatif. Hasil penelitian menunjukkan bahwa pelaksanaan pidana melalui pembinaan di lembaga pemasyarakatan saat ini adalah upaya pembinaan yang berorientasi pada pelaku tindak pidana (warga binaan). Lembaga Pemasyarakatan Klas 1 Semarang dalam melaksanakan pembinaan bagi warga binaan pemasyarakatan telah melakukan pembinaan dengan memperhatikan hak dan kewajiban warga binaan. Sebagaimana diatur dalam formulasi Undang-undang Nomor 12 Tahun 1995 Tentang Pemasyarakatan. Pembinaan yang telah dilaksanakan oleh Lembaga Pemasyarakatan Klas 1 Semarang diharapkan dapat membentuk sikap dan perilaku warga binaan pemasyarakatan menjadi pribadi yang lebih baik dalam artian warga binaan pemasyarakatan setelah selesai menjalani masa pidananya tidak kembali melakukan pengulangan tindak pidana.

Abstract

When government functions must be carried out and cannot be halted, even if the law does not clearly or completely regulate them, the role of discretionary authority (discretion) becomes crucial. This is particularly evident in the discretionary authority held by the Indonesian National Police, which is essential both for the police themselves and in the execution of their duties in conducting investigations and prosecutions. This study focuses on the application and implementation of discretion by the police in conducting investigations and prosecutions, and how a progressive legal framework can revolutionize the pursuit of justice. By employing a qualitative analysis and the constructivism paradigm, this research explores how law enforcement officers understand and apply their discretionary powers. It also examines the implications of these practices for achieving justice within society. The findings reveal that police discretion is inherently intertwined with the identity of the police, both as individuals and as an organization. The use of this authority is pivotal in ensuring that law enforcement officers perform their duties effectively, not only to promote good governance but also to foster justice within the community. Justice, as a fundamental value in human life, remains a complex and multifaceted issue. Various interpretations of justice lead to diverse perceptions among individuals and groups, influenced by their knowledge and experiences. Therefore, it is essential to recognize that 'justice will be understood differently according to the paradigm adopted. By adopting a progressive legal lens, this study highlights the potential for transformative changes in law enforcement practices, ultimately contributing to a more just and equitable society
