Abstract

Background: The emerging of sex selection technology in Indonesia is sperm sorting, meanwhile sex selection with Preimplantation Genetic Diagnosis (PGD) methods is not widely used. The use of sperm sorting has bigger chance to fail than PGD, thus potentially cause ethical and legal problems that is selective abortion during pregnancy. The potency for selective abortion is enlarged by Indonesian law that permitting sex selection without distinction of medical and non-medical reasons. There is no special policy to regulate the selective abortion because of sex selection failure.  Aims: This study aims to find out the legal concept of selective abortion after preimplantation sex selection that appropriate to be applied in Indonesia.Methods: This research is normative research that use analytics method with legal approach and conceptual approach. The research material consists of primary legal material (legislation about sex selection and abortion in Indonesia), secondary legal materials (legal journals, law books, and legal proceedings), and also non-legal materials (journals, books, and health proceedings about sex selection and abortion).Results: In Indonesia meanwhile in general, abortion is permitted for pregnancy with medical indication and rape victim. Through a statue approach in Indonesia, selective abortion after preimplantation sex selection can be implemented for strong medical reasons. While the failure for non-medical reasons can’t be aborted. This regulation contrary with ethics, morals and religion. Selective abortion should not be done because of preimplantation sex selection failure either medical or non-medical reasons. Conclusion: Selective abortion after preimplantation sex selection both medical and non medical reason contrary with moral, ethical, and religion. Indonesia needs to regulate further policy about selective abortion if there is a failure of preimplantation sex selection.

Abstract

Dalam perkuliahan Kelistrikan dan Kemagnetan, banyak mahasiswa mengalami kesulitan memahami konsep-konsep yang melibatkan variabel-variabel mikroskopis, seperti muatan listrik dan medan listrik. Pada umumnya penjelasan di kelas tidak cukup membuat mahasiswa memahami konsep-konsep yang melibatkan variabel-variabel mikroskopis tersebut sehingga diperlukan media pembelajaran yang tepat dan juga pembelajaran mandiri untuk memahaminya. Peran media dalam pembelajaran sangat penting, sebab media membantu guru menolong siswa memahami materi pembelajaran. Saat ini sudah dikembangkan simulasi PhET yang dapat digunakan sebagai media pembelajaran. Penelitian ini mengangkat masalah tentang (i) bagaimana membuat desain pembelajaran mandiri tentang vektor medan listrik menggunakan simulasi PhET dan (ii) bagaimana efektivitas desain pembelajaran tersebut untuk membantu mahasiswa memahami materi tentang medan listrik. Tujuan penelitian ini adalah (i) membuat desain pembelajaran mandiri tentang vektor medan listrik menggunakan simulasi PhET dan (ii) mengetahui efektivitas desain pembelajaran tersebut untuk membantu mahasiswa memahami materi tentang vektor medan listrik. Penelitian ini bermanfaat untuk memberi contoh bentuk pembelajaran mandiri yang bisa digunakan mahasiswa untuk belajar vektor medan listrik. Penelitian ini adalah penelitian deskriptif kualitatif, dengan responden 15 mahasiswa Fisika dan Pendidikan Fisika Angkatan 2014. RPP dan modul tentang vektor medan listrik diimplementasikan dan diobservasi oleh observer lain, kemudian mahasiswa ditugaskan untuk mengerjakan soal post test dan kuesioner. Data yang diperoleh dianalisis secara deskriptif kuantitatif. Hasil analisa data menyatakan bahwa (i) 100% mahasiswa mendapatkan nilai tes di atas 80 dengan rata-rata nilai 100, (ii) 98,66% mahasiswa terlibat aktif dan antusias dalam pembelajaran, (iii) 73,33% mahasiswa memberikan sikap positif yaitu antusias dan bekerja sama selama pembelajaran berlangsung, dan (iv) 88,89% mahasiswa memberikan respon positif pada kuesioner. Jadi dapat disimpulkan bahwa penggunaan media simulasi PhET sebagai media pembelajaran Fisika efektif digunakan untuk membantu mahasiswa memahami vektor medan listrik dan memotivasi mahasiswa untuk belajar Fisika. Dengan demikian semua kriteria keberhasilan tercapai dan penelitian dinyatakan berhasil. On Electromagnetic class, mostly students are difficult to understand concepts that involved microscopic variables, such as charges and electric field. Generally explanations in class are not enough to make them understand it, so suitable media and independent learning are needed. The role of media in learning is very important, because media helps teachers to help students understand the learning material. Nowadays PhET simulation that can be used as learning media has been developed. This research is investigate (i) how to make independent learning design about electric field vectors using PhET simulation and (ii) how effective that learning design to help students understand concept of electric field. This study aims to design independent learning design about electric field vectors using PhET simulation and (ii) to determine the effectivity of that learning design to help students understand concept of electric field. Its advantages for giving example of independent learning that might be used by students to learn about electric field vector. This is a qualitatively descriptive research with 15 students of Physics and Physics Education Batch 2014 be as respondents. Lesson plan and modul of electric fields vector were implemented and were observed by other observer, then students were assigned to do post test and fill the questionnaire. Data were analyzed qualitatively and descriptively. The results state that (i) 100% students obtained evaluation score more than 80 with the mean of 100, (ii) 98,66% students actively involved and enthusiastic in learning process, (iii) 73,33% students showed positive attitude of enthusiastic and cooperative during learning process, and (iv) 88,89% students stated positive response in the questionnaire. Thus it could be concluded that the utilization of PhET simulation as physics learning media is effective to help students understand electric field vector and motivate students to learn physics.

Abstract

The purposes of this paper are to identify and examine the revocation of political rights for corruptors as an extra-ordinary measure. The research showed that law enforcement through penal policies still have shortcomings such as light criminal sentence for perpetrators of criminal acts of corruption as well as lack of awareness among judges to apply the additional sentence of fixed-time revocation of rights. Penal law enforcement requires integral and sustainable policies through non-penal policies (prevention). Preventive efforts should be responsive to the demands of the community at large for officials who are clean, honest and who have integrity. Non-penal law shall be enforced through the concept of developing smart and integrity-based politics.

Abstract

Tindak pidana korupsi sebagai extra ordinary crime mendorong pemerintah untuk memberantas tindak pidana korupsi secara lebih serius. Oleh karena itu dalam tindak pidana korupsi di muat ketentuan ancaman pidana minimum khusus dalam Undang-Undang No. 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi Jo Undang-Undang No. 20 Tahun 2001 Tentang Perubahan Atas Undang-Undang No. 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi. Ancaman pidana minimum khusus merupakan penyimpangan dari sistem dalam KUHP Karena KUHP menganut sistem maksimal dalam merumuskan ancaman pidananya. Penelitian ini merupakan penelitian yuridis normatif karena dalam penelitian ini menggunakan data sekunder yaitu data yang di peroleh dari buku, literatur yang berkaitan dengan kebijakan pidana minimum khusus Saat ini pola perumusan pidana minimum khusus dalam UU TPK masih belum terdapat keseragaraman dan belum disusunya aturan penerapan pidana minimum khusus yang menimbulkan permasalahan dalam penerapannya, yaitu ada beberapa hakim yang menjatuhkan pidana di bawah pidana minimum khusus. Sehingga diperlukan adanya pembaharuan mengenai ketentuan pidana minimum khusus dalam tindak pidana korupsi. Upaya pembaharuan kebijakan pidana minimum khusus dalam Undang-Undang Tindak Pidana Korupsi perlu memperhatikan 2 hal yaitu mengenai perumusan pola lamanya pidana minimum khusus yang seharusnya disusun dalam suatu pola yang seragam dengan memperhatikan perimbangan antara maksimum dan minimum pidananya dan aturan penerapan pidana minimum khusus yang harus memperhatikan model aturan penerapan pidana minimum khusus dan faktor yang memperingan dan memperberat pidana minimum khusus yang diatur dalam suatu ketentuan yang jelas dan tegas sehingga tidak menimbulkan permasalahan dalam penerapannya.

Abstract

Konsep KUHP melakukan penambahan kualifikasi dari asas legalitas yang mana tadinya berupa asas legalitas formil, menjadi asas legalitas formil dan asas legalitas materiil. Asas legalitas materiil memberikan ruang bagi hukum adat/ hukum tidak tertulis/ hukum yang hidup dalam  masyarakat untuk dapat menjadi sumber/dasar hukum yang diakui dalam sistem hukum pidana. Dikarenakan sifatnya yang mendasar dan penting dalam pelaksaan sistem hukum pidana di Indonesia maka dalam  hal pembaharuan asas legalitas yang terjadi dalam Konsep KUHP perlu dikaji secara yuridis dan filosofis agar dapat digali dan dimengerti adanya pergeseran yang menyebabkan terjadinya pembaharuan dalam asas legalitas dari KUHP kedalam Konsep KUHP. Penelitian ini bertujuan untuk menganalisis aspek yuridis dan filosofis serta urgansi dan prospek dari pembaharuan asas legalitas dalam Konsep KUHP yang mana menggunakan metode pendekatan yang bersifat yuridis empiris dan filosofis dengan spesifikasi penelitian deskriptif analitis.

Abstract

Perdagangan orang erat kaitannya dengan perbudakan dan tindakan serupa perbudakan, yang sudah dilarang di seluruh dunia. Hal ini jelas terlihat dengan begitu beragamnya faktor penyebab terjadinya perdagangan orang demikian juga dengan korban perdagangan orang. Korban pada umunya tidak hanya mengalami kerugian material saja, tetapi juga kerugian immaterial berupa kerugian psikis/psikologis, dan juga kerugian sosial lainnya. Permasalahan di dalam penelitian ini yaitu, bagaimana penerapan politik kriminal secara integral dalam menanggulangi tindak pidana human trafficking dan bagaimana upaya kepolisian daerah Jawa Tengah untuk mengatasi kendala dalam menanggulangi tindak pidana human trafficking. Metode yang digunakan dalam penelitian ini adalah yuridis empiris yang bersifat deskriptif yaitu dengan menggambarkan atau melukiskan keadaan objek penelitian pada saat sekarang berdasarkan fakta-fakta yang ada dan permasalahan secara rinci, sistematis dan menyeluruh sebagai segala sesuatu yang berkaitan dengan upaya pendekatan politik kriminal dalam penanggulangan kejahatan perdagangan orang. Pembahasan dilakukan dengan menghubungkan bagaimana penerapan politik kriminal secara integral dalam menanggulangi tindak pidana human trafficking dengan meyebutkan beberapa pengaturan dalam Undang-Undang Nomor 21 Tahun 2007 Tentang Pemberantasan Tindak Pidana Perdagangan Orang. Bagaimana upaya kepolisian daerah Jawa Tengah untuk mengatasi kendala dalam menanggulangi tindak pidana human trafficking diserati dengan wawancara dan mengumpulkan data mengenai daftar perkembangan perdagangan orang.

Abstract

Individuals who commit criminal acts will receive criminal sanctions for them. However, criminal sanctions for corporations that commit criminal acts are not regulated in the Criminal Code. This research uses normative legal research methods. This study aims to examine the criminal liability arrangements by corporations as well as what sanctions can be applied. In Indonesia, criminal liability by corporations has been regulated in several statutory regulations that are outside the Criminal Code. Sanctions that can be applied to corporations include basic crimes such as criminal fines, additional crimes, and corporate confiscation.

Abstract

Besides offering various facilities and economic benefits, globalization also has many negative impacts. Commercial sexual exploitation of children is one of the negative impacts caused by the current of globalization. Sexual exploitation of children is currently experiencing developments influenced by globalization, one of which is the sexual exploitation of children through online media or social media. In some cases in Indonesia, sexual exploitation of children through social media is usually done through live broadcasts called by the term “vidsex (video sex)” or “vidcallsex (video call sex)” which is interpreted as a live video call for sexual scenes. Therefore this normative study wants to examine the Indonesian government’s policy efforts as a preventive effort in tackling the sexual exploitation of children through social media. The results of this study indicate that the regulation as a preventive measure for the protection of children against sexual exploitation of children through social media has generally been regulated in legislation such as the Child Protection Law and the Information and Electronic Transaction Law.

Abstract

Indonesian National Amil Zakat Board (BAZNAS) has collaborated with the largest and popular Indonesian payment gateways, e-commerce and crowdfunding fintechs such as ovo, Gojek, Kitabisa.com, Tokopedia.com etc. to optimize the collection of Islamic social funds like  Zakah,  infaq (charity spending), waqf (endowment) and sadaqah (voluntary charity) or usually called ZISWAF by depositing Rupiah currency into the e-wallet platform. However, fundraising cross-border ZISWAF stated in Article 16 Law No. 23/2011 on Zakat Management is carried out by Baznas by forming UPZ representatives of the Republic of Indonesia abroad.  The power of fintech that might be operated on global scale can be an alternative for ZISWAF international friendly transfers. Based on the Islamic Finance News (IFN) report, as many as 142 Islamic fintechs are available worldwide. Islamic FinTech offers the opportunity to become more applicable to a global Muslims. This article is a normative economic analysis on the basis of secondary data, this study found that the potential for raising ZISWAF funds across several countries is very large especially in countries with many immigrants from Indonesia through international types of fintech services such as remittances and payments that has allowed or collaborated with Bank Indonesia.

Abstract

This article aimed to analyze the problem of legal cases accumulation, especially default on credit contracts in court. It also analyzes the effectiveness of implementing a small claim court in contract default and the independence of a single judge in handling cases through the small claim court mechanism. Small claim court also to offer a breakthrough in the settlement of bad loans related to contract defaults to reduce the burden on courts in Indonesia and provide legal certainty to business actors. The sole judge also examine, resolve and decide on inheritance cases in a fast and efficient process to issue a fair decision for all parties. This normative study was carried out using statutory, case, comparative law, and analysis content approaches. The research results showed that the filing of small claim court increased 10 times from 2015 to 2020, with the plaintiffs dominated by banks in bad credit cases. A small claim court provides benefits the bank and the customer because it speeds up the settlement of the plaintiff's money in a bad credit case with a case value of not more than 500 million, especially for microloans in a maximum period of 25 days. Furthermore, the latest regulation of 2019 concerning small claim court gives judges the authority to confiscate guarantees and conduct auctions to carry out forced executions through the Court Execution Auction process.
