Abstract

In Islam, the term mahram means a person who is forbidden to marry. Although Islam has determined it, in jorong Bandar Mas nagari Cubadak Pasaman district, there is a tradition of prohibiting marriage relations for reasons outside the provisions of shara', namely, a man is prohibited from marrying a woman who is still in the same village with the man. Therefore, the author is interested in conducting research with the type of qualitative research that aims to understand the prohibition of marriage in one village. The results showed that one village marriage in the version of the Bandar Mas jorong community is a pantang marriage. Kawin pantang in Minangkabau custom can be understood as a marriage that is prohibited by custom or a marriage that cannot be carried out or held based on the values agreed upon in custom. In Islamic law, women who cannot be married are called mahrams. Linguistically, the term mahram comes from the word haram, which means forbidden or not allowed. The prohibition of marriage in the same village is not known in Islam. Regarding the prohibition of marriage in the same village, a common ground can be found between the two. Customary law can be considered to strengthen Islamic law. Marriage with someone other than a relative will strengthen the offspring, as reported by the Companions and the opinion of Imam Ghazali.

Abstract

Indonesia possesses significant potential for productive waqf as an instrument of socio-economic development; however, its realisation remains limited due to persistent managerial, institutional, and governance challenges. This study examines the model of productive waqf management in South Tapanuli (Tabagsel), covering Mandailing Natal, South Tapanuli, Padang Lawas, North Padang Lawas, and Padangsidimpuan City. Situated within the discourse of Islamic economic law and waqf governance, the research employs a descriptive qualitative approach based on field data and relevant documentary sources. The findings reveal substantial disparities in productive waqf development across the region. Among the five areas studied, Mandailing Natal demonstrates the most successful implementation through an integrated management system that combines agricultural, commercial, and community-based economic activities. In contrast, productive waqf in the other regions remains largely traditional and underutilised due to limited institutional capacity, weak managerial professionalism, and inadequate governance support. The study argues that the effectiveness of productive waqf management depends on the integration of spiritual, social, and economic functions through collaborative stakeholder engagement. As its principal contribution, this research proposes an integrative–participatory model of productive waqf governance as a novel framework for strengthening regional waqf management and enhancing its socio-economic impact.

Abstract

Abstract

Abstract

The judiciary should not become the mouthpiece of the law by overriding the values of justice. In order to find the values of justice in every decision, judges should explore the values that live in society. Indonesian legal figure, Prof. Dr. Satcipto Rahardjo expressed progressive legal thinking that prioritizes the deepest meaning of the law, namely justice. This progressive legal theory needs to be studied in the midst of various kinds of judge decisions that are considered to be an obstacle to the achievement of the values of justice. By conducting a literature search, researchers interpreted and expressed arguments about the progressive legal theory put forward by Prof. Dr. Satcipto Rahardjo. The search results showed that he argued that judges are an important factor in determining whether the court is a place to seek victory or justice. For this reason, it is necessary to interpret progressive law to humanize the rigid law so that the law becomes alive and touches aspects of justice for the achievement of human happiness.

Abstract

In the new trend of the transformation of women's roles from the 19th century to the present, a number of issues have emerged within religious communities, causing women to face ethical and psychological dilemmas. Therefore, this study aims to describe gender and family welfare; the Islamic perspective on the transformation of women's roles in the era of globalization. This research applies the library research method with a philosophical approach and analyzes the data using an interdisciplinary perspective. The findings of the study are as follows: First, through education and the development of communication technology, both women and men have equal opportunities to access information, which allows for equality between women and men, both inside and outside the household. Second, spiritually, socially, economically, and politically, Islam, through various verses in the Qur'an, has allowed women to become modern individuals by engaging in activities just like other human beings. Third, family empowerment can be achieved by building the principle of Tawhid; making the Qur'an the guide for family life; using the criteria of faith and piety as measures of success; fostering friendly, polite, and gentle behavior within the family; and nurturing a balance between modernity and spirituality in the family. In principle, all families desire modernization, happiness, and faith. In realizing a modern family full of happiness, a woman occupies a key position
