Abstract

The purpose of this study was to analyze the implementation of the murabahah contract on the Multimanfaat iB financing product at BTN Syariah KCPS Kudus, and its compliance with the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) No. 04/DSN-MUI/IV/2000. The method used in this study was a descriptive qualitative approach, data collection by interview, and observation. The results of the study indicate that the murabahah contract applied in this financing has adopted sharia principles, where the bank is the provider of goods and the customer is the buyer. However, there are challenges in its implementation, such as the lack of customer understanding of the contract mechanism and information transparency. The objects of financing that are traded are in accordance with sharia provisions, and the collateral system applied is different between general customers and BTN employees. Margin determination also varies based on the financing period. This study recommends increasing sharia financial literacy and evaluating information transparency to customers, as well as developing a more innovative murabahah contract scheme to improve the efficiency of sharia banking transactions.

Abstract

Islamic banking in Indonesia has experienced significant growth, driven by increased public awareness, supportive regulations, and product innovations such as hajj and umroh savings. This study analyzes the application of the mudharabah contract in hajj and umroh savings products at BTN Syariah KCPS Kudus, focusing on compliance with sharia principles and economic effectiveness. Employing a qualitative approach through interviews, observations, and documentation, the study finds that the applied mudharabah muthlaqah contract complies with the DSN-MUI Fatwa, with a profit-sharing ratio of 45:55 and fund management through sharia-compliant instruments. However, low customer literacy and lack of transparency in fund management pose significant challenges. Economically, the product supports the growth of third-party funds (from IDR 3.8 billion in 2022 to IDR 4.5 billion in 2023), but the economic benefits for customers are less significant, as their primary motivation is hajj registration rather than profit sharing. The study recommends enhancing sharia education, transparency, and product innovation to optimize sharia compliance and economic benefits.

Abstract

In the context of murabahah financing, default (wanprestasi) is a common issue that can lead to losses for Islamic banks. According to the Fatwa of the National Sharia Council MUI No. 43/DSN-MUI/VIII/2004, dhaman or compensation can be imposed on customers who fail to meet their payment obligations as stipulated in the contract. This study employs a qualitative descriptive method to analyze the mechanism of dhaman and its implications for customers experiencing default. The findings indicate that banks have the right to impose penalties in the form of fines (ta'zir) and/or compensation (dhaman) on customers who are able to pay but are late in fulfilling their obligations. However, it is recommended that Islamic banks first offer restructuring options to customers before taking further action. This research emphasizes the need for a balance between protecting customer rights and the bank's interests to achieve fairness in Islamic banking practicef.

Abstract

This study aims to assess the current views of the Jepara community towards sharia banking products, as well as the factors that influence these perceptions. This thesis was prepared using descriptive-qualitative research methods. A study of citizens' perceptions shows that sharia banking products are considered easy to use, cost-effective, and convenient. They appreciate the availability of ATM cards and BSI banking facilities for transactions anytime and anywhere. For interbank transfers, the administration fee is cheap—only 2,500. Sharia People's Economic Bank (SPEB) products are not subject to any administration fees or deductions, thus ensuring security, reliability, and compliance with Islamic principles. Factors that influence public perception of sharia banking products include understanding determinants, motivation factors, size factors, and movement factors. These factors have contributed to the perception that people are reluctant to use Islamic banks due to a lack of understanding of banking products. Compliance with Sharia is now very minimal.

Abstract

This study aims to analyze the perceptions of PT Kanindo Makmur Jaya 2 employees regarding the ease of access to financing through Islamic banks and informal financing institutions. The research method used qualitative data collection techniques through interviews, observation, and documentation. The results showed that employees perceived Islamic banks as having complicated procedures, requiring numerous documents, and taking a long time to disburse funds, while informal financing institutions were considered more accessible, fast, and flexible despite having high interest risks. Convenience and speed were the main reasons employees chose informal institutions to meet urgent economic needs. This study concluded that low levels of Islamic financial literacy and minimal product socialization have led to negative perceptions of Islamic banks, so strategies to improve education and simplify procedures are needed to expand Islamic financial inclusion among factory workers.
